SUBJECT: Regional Office Review & Recommendations Application for Permit for Excavation and/or Fill Corps of Engineers - Beaufort Turning Basin Carteret County The applicant proposes to perform maintenance dredging of, Beaufort Turning Basin, a 15' x 100' channel through Taylors Creek, a 12, x 100' channel to Lenoxville Point, and a 7' x 75' channel to the Waterway connecting Pamlico Sound and Beaufort Harbor. The waters concerned are classified SA and closed to shellfishing. The project has been reviewed to determine impacts to water quality. The following comment is offered: That a 401 certification is required but should meet the conditions for the 401 general certification for the construction of boat ramps and 401 general certification for the discharge of liquid effluent from a dike disposal area resulting from hydraulic dredging. CONSISTENCY DETERMINATION BEAUFORT TURNING BASIN, TAYLORS CREEK CHANNEL AND CONNECTING CHANNELS CARTERET COUNTY, NORTH CAROLINA JUNE 1986 PROJECT DESCRIPTION. The authorized project at Beaufort Harbor includes a 12-foot x 600-foot turning basin in front of Beaufort, a 15-foot x 100-foot channel from the intersection with Bulkhead/Gallants channels, through Taylors Creek to a point about 3 miles east of Beaufort, a 12-foot x 100-foot channel to Lenoxville Point, and a 7-foot x 75-foot channel to the Waterway Connecting Pamlico Sound and Beaufort Harbor. The Beaufort Harbor Turning Basin, the 15-foot x 100-foot channel through Taylors Creek and the 12-foot x 100-foot connecting channel have a dredging frequency of once every fodr years. The 7- foot x 75-foot connecting channel to the Waterway Connecting Pamlico Sound and Beaufort Harbor has a dredging frequency of once every 10 to 15 years. Dredged material disposal will be on Town Aarsh and Carrot Island. - Approximately 200,000 cubic yards of coarse to medium sand with some silt will be dredged by a hydraulic pipeline dredge during FY 87 from the Beaufort Harbor Turning Basin and the channel through Taylors Creek. The material will be deposited on upland diked disposal areas located on Town Marsh and Carrot Island. The disposal areas are part of the N.C. National Estuarine Sanctuary, Carrot Island Complex. Use of these sites for dredged material disposal has been coordinated with Mr. John Taggart, Division of Coastal Management and Dr. James F. Parnell, University of North Carolina at Wilmington. Maintenance will be scheduled to occur during the fall and winter months of any year to avoid adverse impacts to biological resources. The disposal areas will be diked to a height of 6 to 8 feet and seeded to prevent erosion and wind blown sand. If access for on- and off-loading heavy equipment is-.not available, the contractor will construct ramps by placing about 30 cubic yards of fill material below the mhw line. The ramps will be approximately...12-feet wide x 20-feet long with a 3 or 4 vertical to 1 horizontal slope. Material to construct the ramps will be ob- tained from the disposal sites and returned to the disposal sites upon completion of the work. General water quality certification has been requested from the Division of Environmental Management, N.C. Department of Natural Resources and Community Development, for the construction of loading ramps. Three upland diked disposal sites are proposed for use in FY 87. Material from the Beaufort Turning Basin will be deposited on the 50 acre disposal site located on Town Marsh adjacent to the basin. , Material from Taylors Creek Channel will be disposed of on the 27 acre and 10 acre sites located adjacent to Taylors Creek Channel, shown on the attached map. The sites have been previously used for disposal of dredged material and consist of mounds of coarse sand and remnant dikes vegetated mainly with hydrocotyl. The sites are surrounded by wax myrtle and other low lying shrubs. The area is inhabited by feral horses which keep it free of other vegetation. The 100-year flood elevation from wind tides at Taylors Creek is about 8 feet above mean sea level (msl). The proposed maintenance dredging and disposal of the Beaufort Turning Basin, Taylors Creek Channel, and connecting channels are consistent with the Coastal Management Program of the State of North Carolina. The following information supports the consistency determination: Estuarine Waters: The proposed maintenance is defined as a second priority use of this AEC and is consistent with the.manage- ment objective. The proposed dredging and disposal in the estuarine system will maintain navigability. Public Trust Areas: The maintenance of navigation channels is an acceptable use within public trust areas, and the dredging and disposal operations will not be detrimental to the biological and physical functions of the estuary. Estuarine Shorelines: The proposed dredging and disposal will not have any significant adverse effects on the AEC. The main- tenance operations are compatible with both the dynamic nature of estuarine shorelines and the values of the estuarine system. Coastal Wetlands: The outer fringes of the upland diked disposal areas are marsh. The fringes will not be affected by the discharge of dredged material. If fill material is placed on marsh areas during construction of on- and off-loading ramps, it will be removed upon completion of the work. Impacts on the estuarine system are expected to be minimal. With respect to the pertinent general and specific use standards ?'or the estuarine system AEC's (15 NCAC 7H .0208): 1. Maintenance of the project is water dependent. (a)(1) 2. The need for the proposed work is for navigation, which is documented in the Final Environmental Impact Statement (FEIS), Maintenance of The Waterway Connecting Pamlico Sound and Beaufort Harbor, North Carolina (filed with CEQ on November 5, 1976). (a)(2)(A) 2 a s n , 3. Although alternative methods of disposal.are available, the proposed method of upland diked disposal will have minimal effects on important natural resources. (a)(2)(B) 4. The proposed activities will not violate water and air quality standards. Effluent from upland diked disposal Bites is covered under Section 401 (PL 95-217), Water Quality Certificate no. 1273, issued on November 10, 1978, and Nationwide Permit 33 CFR 330.5(a)(16). An application for a general water quality certifi- cate for placement of fill material in the water for the construction of temporary loading ramps has been sent to the Division of Environmental Management, N. C. Department of Natural Resources and Community Development. (a)(2).(C) 5. The proposed activities will not cause any major or irre- versible damage to documented archeological or historic resources. The sites have been previously used for dredged material disposal. (a)(2)(D) 6. The activities will cause a slight increase in siltation immediately adjacent to the channel being dredged and to:effluent plumes from the disposal areas. This impact will be temporary and minor. (a)(2)(E) 7. The proposed activity will not create stagnant water bodies. (a)(2)(F) 8. Life cycles of estuarine resources are not expected to be significantly affected by the proposed activity. Public economic interests require that channel shoals be promptly removed. (a)(2)(G) 9. The proposed activity will promote navigation and use of public trust and estuarine waters. (a)(2)(H) 10. 15 NCAC 7H .0208(a)(2)(I): Not applicable. (a)(2)(I) 11. The channel alignments do not alter or affect productive shellfish beds, submerged vegetation or regularly or irregularly flooded marsh areas. (b)(1) 12. The pipeline will be positioned a maximum distance from spillways in order to allow adequate settling of suspended solids. (b)(2)(A) 13. The material dredged by hydraulic pipeline dredge will be disposed of on.Town Marsh and Carrot Island. All the disposal areas are within the N.C. National Estuarine Sanctuary, Carrot Island Complex. The Corps of Engineers has a permanent easement for dis- charging dredged material in the designated disposal areas. (b)(2)(B) 14. The discharged material will be contained on high ground landward of regularly or irregularly flooded marshland. Adequate 3 soil stabilization measures will be used to prevent entry of dredged material into the water or marsh. (b)(2)(C) 15.. Effluent from the upland diked dispsal areas will be con- tained to a point waterward of emergent vegetation. (b)(2)(D) 16. The effluent from the diked disposal areas will be returned to the channels being dredged. (b)(2)(E) 17. Water control structures will be installed at the intake ends of the effluent pipes. (b)(2)(F) 18. The proposed dredging and disposal methods considered in this consistency determination are consistent with standard (b)(2)(B). (b)(2)(G) 19. The areas to be dredged are presently closed to shellfishing. The effluent will be returned to closed shellfishing areas. (b)(2)(H) B. Land Use Plans: The local land classification map indicates that the dredging is located in an area designated as "water" and the disposal areas are designated as "conservation" (lands iden- tified as fragile, present hazards to development, or are necessary to maintain a balanced environment). Such areas will be maintained basically in their natural state. Impacts on the "water" and "conservation" areas are expected to be minimal. C. State Guidelines: 1. For AEC's: See paragraph A. 2. For Land Use Plans: See paragraph B. 3. General Policy (15 NCAC 7M): Not applicable. D. Other State Policies: Review of the State policies found in Chapter 3 of the Coastal Management Program document indicates that the proposed action is in accordance with policies on navigation, dredging and spoil disposal, wetlands, water and air, recreational and tourism resources, Federal consistency and national interest. The major policies and laws of the State of North Carolina that were specifically reviewed were the following: 1. The Coastal Area Management Act of 1974. 2. The Dredge and Fill Law (see paragraphs A-C of this determination). 3. The N.C. Sedimentation Pollution Control Act. With respect to control of sedimentation and erosion, the district will submit plans and specifications containing erosion 4 control requirements to the Land Quality Regional Engineer for review and approval 30 days prior to beginning construction. 4. Water Quality Regulations. The discharge of effluent from upland diked disposal areas is covered under Section 401 (PL 95-217), Water Quality Certificate no. 1273 issued on November 10, 1978, and Nationwide Permit 33 CFR 330.5(a)(16). A Section 401 (PL 95-217) General Water Quality Certificate for temporary placement of fill material for construc- tion of loading ramps has been requested from the Division of Environmental Management, N.C. Department of Natural Resources and Community Development. E. Conclusion: Based on the above information, I have determined that the proposed maintenance of the Beaufort Turning Basin, Taylors Creek Channel and connecting channels is consistent with the Coastal Management Program of the State of North Carolina.
