This permit, issued on h 3C ` ?( , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The buoy will be of a plastic type material, not metal, will be reflectorized
and will be painted or marked in keeping with the State Uniform Waterway
Marker System,.which is administered by the N. C. Wildlife Resources Commission.
(2) The buoy and anchor system will be properly maintained so as to reduce
the possibility of a moored boat breaking free and causeway damage to the
area piers,boats, etc.
(3) This mooring buoy is being authorized as a storm mooring only, and is not
intended for permanent or routine mooring.
NOTE: This mooring device is authorized under a U. S. Army Corps of Engineers
nationwide permit giving authorization for a non-commercial, single boat
mooring buoy.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
Ali work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

SUBJECT: Application for CAMA Permit
Hugh Todd

The Subject application has been reviewed for water quality impacts
and the following comments are offered:
1. The proposed off-shore mooring facility would create a real
potential for violations of fecal coliform water quality
standards from the discharge of sewage overboard. The
potential for violations of fecal coliform standards are
greater for this type of mooring structure than they would be
at a marina which provided on-shore bathroom facilities. Due.
to the location of such a mooring facility, adequate
monitoring for compliance with any operating permit condition
regarding sewage disposal would be impractical by Division of
Coastal Management or this Division. It is recommended that
the permit be denied.
2. A 401 Certification would not be required for the proposed
project.

Final review and recommendations 11/25/85
A 401 [eater Quality Certification will not be required, this office
has no objections to the proposed project.
It is recommended that a 401 Water Quality Certification be issued
containing a turbidity limit of 25 : 50 NTU. This office has no
objections to the proposed project.
The proposed project appears to meet the conditions of the General

Additional. Comments:
The applicant proposes to place a permanent off-shore storm mooring structure
in Broad Creek (SB) near McCotters Marina. The structure will consist of a
buoy, chain and anchor. The applicant owns a large boat which is normally
docked at McCotter's Marina. According to the applicant, the mooring structure
would be used during severe storm events.
The mooring structure should not cause any significant environmental impacts;
however, the.future docking of vessels at-the structure would create the potential
for water quality problems. Once the structure is in place, the DEM or DCM would
have no control over who docks at the structure or how they manage their waste
facilities. The potential for violations of the fecal coliform standard are
greater at this type of mooring structure than they would be at a marina which
provided on-shore bathrooms.

I am not aware of any conditions that could be placed in the CAMA permit which
would eliminate our concerns regarding water quality. Further, I feel that the
random placement of similar off-shore mooring structures would create a potential
pollution source each and every time.
It is recommended that the Division object to the issuance of the CAMA permit.

8. Project summary The applicant is proposing to placea permanent storm mooring
consisting of anchor, chain and buoy on the east side of Broad Creek.
Environmental settin
The project site is Broad Creek east of Washington in Beaufort County. Broad Creek
is heavily utilized by commercial marinas on the west side. Also on the west side
is Washington Yacht and Country Club which also has several marina piers located
in the creek. On the east side is Pamlico Plantation, a multi-family, single
family and marina development. Its marina pier also extends into Broad Creek.
The creek has an established channel which has been historically dredged as needed.
Project proposal
The applicant is proposing to place a permanent storm mooring on the east side of
the Broad Creek channel. The mooring will consist of anchor, chain and buoy. The
exact location is latitude 35 degrees, 29 minutes, 22 seconds and longitude 76
degrees, 57 minutes, 15 seconds.
Environmental impact
The project as proposed should have a minimal environmental impact.
