This permit, issued on 6??et? , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) When the permittee is ready to begin construction, he shall arrange a meeting with the appropriate field consultant at the site to determine the oceanfront setback. This setback determination shall replace the one done at the time the permit was processed and approved and construction must begin within a period of 60 days from the date of that meeting. In the case of a major shoreline change within that period, a new setback determination will be required before construction begins. Upon completion of the measurement, the field consultant will issue a written statement to the permittee certifying the same. (2) In order to avoid unreasonable danger to life and property, all development shall be designed and placed so as to minimize damage due to fluctuations in ground elevation and wave action in a 100 year storm. Any building con- structed within the ocean hazard area shall comply with Appendix D, "Windstorm Resistive Construction", of the N. C. Residential Building Code, except that when any provisions of that appendix are inconsistent with any of the following AEC standards, the more restrictive provisions shall control. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee 9 Tidewater Realty & Development Company Permit #150-86 Page 2 ADDITIONAL CONDITIONS (3) All structures in the ocean hazard area shall be on pilings not less than eight inches in diameter if round or eight inches to a side if square. (4) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structure. For those structures so located on the primary dune or nearer to the ocean, the pilings must extend to four feet below mean sea level. The pilings shall be appropriately treated to resist decay, insects and corrosion. (5) All foundations shall be adequately designed to be stable during applicable fluctuations in ground elevation and wave forces during a 100 year storm. Cantilevered decks and walkways shall meet this standard or shall be designed to break away without structural damage to the main structure. (6) The lowest portion of the structural member of the lowest floor (excluding the pilings or columns) shall be elevated to or above the 100 year storm elevation. (7) All exposed structural connections shall be adequately rustproofed or enclosed. (8) All utility systems shall be located and constructed so as to minimize or eliminate storm damage. (9) All walls below the 100 year base flood level shall be designed and installed to: (A) allow stormwaters to rise and flow freely under the structure, (B) not permit the break-away walls themselves to become water-borne debris, and (C) not cause the accumulation of water-borne debris. Break-away walls shall be intended to collapse under stress without jeopardizing the structural support of the structure. (10) The new dunes to be established will be aligned to the greatest extent possible with existing adjacent dune ridges and shall be of the same general configura- tion as adjacent natural dunes. (11) The structural accessways will be designed and constructed in a manner which entails negligible alteration on the primary dune. (12) The accessway will be exclusively for pedestrian use and will be less than six feet in width. The accessway must also be raised on posts or pilings of five feet or less depth, so that wherever possible, only the posts or pilings touch the frontal dune. (13) An erosion/sedimentation control plan must be submitted for approval and must contain all temporary and permanent devices, structures, and measures, etc., to be utilized during construction in preventing offsite sedimentation from occurring. The plan may be sent for review to: Land Quality Section, Division of Land Resources, N. C. Dept. of Natural Resources and Community Development, P. 0. Box 1507, Washington, N. C. 27889. Tidewater Realty & Development Company Permit #150-86 Page 3 ADDITIONAL CONDITIONS (14) Sand fences, silt fences, and other appropriate sediment control structures must be utilized during construction until a permanent ground cover has been established. (15) All cut and/or fill slopes must be provided with a vegetative or other form of ground cover, within 120 calendar days or 30 work days, whichever is shorter. NOTE: By signing this permit, the permittee acknowledges the risks associated with development in this hazardous area and the limited suitability of this area for permanent structures. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. NOTE: Prior to construction of each duplex unit, the sewage treatment and disposal system must be approved by the Dare County Health Department. NOTE: Plans and specifications of all water system improvements must be approved by the Division of Health Services prior to the award of a contract or the initiation of construction (as required by 19 NCAC 10D.0900) et. seq.). For information, contact the Engineering Planning Branch, 919/733- 2460. NOTE: Prior to the removal or demolition of dilapidated structures, an extensive rodent control program may be necessary in order to prevent the migration of the rodents to adjacent areas. For information concerning rodent control, contact the local health department or the Vector Control Branch, 919/733-6407. NOTE: The demolition wastes that are accumulated should not be delivered to a local sanitary landfill site since this volume of inert material would greatly reduce the life of a sanitary landfill. For information concerning landfills, contact the Solid and Hazardous Waste Management Branch, 919/733- 2178. NOTE: All lights on the building face, including balcony lights, on the oceanside of all structures should be eliminated to reduce the mortality rate of sea turtle hatchlings. Where oceanside lighting is required, alternatives include shading, screening, or replacing fixtures with modern alternative sources. The applicants now propose to construct 24 duplex condominium units, each having a septic tank system. Tidewater Realty and Development Company Dare County The applicant proposes to develop property located at the intersection of US158 and SR 1200 near Southern Shores. The property consists of 8.25 acres of sandy beach property and is bordered to the east by the Atlantic Ocean (SB). The original CAMA application was received October 21, 1985. The applicant submitted a stormwater management plan on December 23, 1985. The development involves 48 condo units with associated parking, tennis court and pool. Wastewater will be routed to a teritary treatment plant owned by Barclay Towers. The design parameters for the stormwater management plan are: (1) design storm 10 yr. - 1 hr. intensity (2 inches) (2) 2.51 acres impervious area '1 vol. 6779 Ft.3 3 (3) provide 2 storm retention basins with combined storage volume = 6900 Ft. The overall project will result in approximately 30% impervious area, however, there will not be a direct discharge to surface waters. The plan appears to be adequate to protect water quality standards. A 401 water quality certification will not be required. This office has no objections to the proposed project. Project summary The applicant proposes to construct 48 condominiums contained in 12 two story buildings on property north of the Kitty Hawk Pier adjacent to the Atlantic Ocean in Southern Shores SITE DESCRIPTION The applicants have an option to purchase 8025 acres of ocean front property north of the Kitty Hawk Fishing Pier in Southern Shores. The property 'can`be characterized as flat and sandy with a discontinuous primary dune adjacent to the Atlantic Ocean. Four buildings are presently onsite. A single family structure is nestled behind the dunes on the northern boundary, a large structure is in line with the dunes near the center of the property, a single family structure is located landward and behind the large structure and a gazebo is adjacent to the swimming pool. The annual erosion rate in this area is 2 feet per year.,., applicant proposes to demolish all the existing structures on the property and to construct 12 buildings to contain 48 condominium units. The structures on the first row will be two story less than 5,000 square feet,and contain two units each. They will be located more than 60 feet behind the FLSNV and behind the primary dune. The second row structures will be two story approximately 12,000"s'quare feet and contain eight units. These units will be constructed more than 120'-feet behind the FLSNV. Also proposed on ',the landward side of the property is"a new, swimming pool (the old one, will be removed), gazebo and tennis courts. The demolition of the structures onsite will leave some breaches in the primary dune line. The applicant proposes to reconstruct the`blow-outs to provide a continuous line of dunes. ANTICIPATED IMPACTS The removal of some of the.structures onsite will leave unprotected breaches in the dune line which the applicant proposes to repair immediately. The approval for this project must clearly be contingent on the ability to dispose of sewage in the yet unconstructed and unapproved sewage treatment facility.
