Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. Please note that this authorization does not allow bulkhead construction beyond or waterward of the interface between high ground and the wooded swamp (see revised plan). If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Box 5329, High Point,, NC authorizing development in Chowan County at Chowan Ri ver at White's Landing as requested in the permittee's application dated 5/12/86 including attached plats, 4, dated 5/8/86 and marked plat for bulkhead alignment. This permit, issued on 1D?9?b is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will not extend waterward more then 5 feet from the normal water level inside the boat basin. (2) The bulkhead, to be constructed on the basin perimeter, will be aligned so as to not extend waterward of the interface between highground and the wooded swamp (see enclosure). To prevent an unintentional violation of this authorization, representatives of the Corps of Engineers and the N. C. Division of Coastal Management are available to delineate and stake the bulkhead alignment prior to construction. (3) All fill material to be placed below normal water level will be confined behind the permitted bulkhead. (4) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (5) All excavated materials will be confined above mean high water and landward of This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Also, reference our letter to you of June 16, 1986. The following are revised recommended conditions based on more careful consideration. We recommend that the following conditions be included in the State authorization: a. The bulkhead, to be constructed on the basin parameter, will be aligned so as to not extend waterward of the interface between highground and the wooded swamp (see enclosure). b. To prevent an unintentional violation of this authorization, representatives of the Corps of Engineers and the North Carolina Division of Coastal Management are available to delineate and stake the bulkhead alignment prior to construction. c. All excavated materials will be confined landward of the normal water level (NWL) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. d. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet " -2- from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. e. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. e. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the normal water level (NWL) elevation contour to prevent gully erosion and resultant unnecessary siltation. f. Excavation will not exceed. 8 feet below the elevation of' normal water. g. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Project summary The applicant proposes to perform maintenance excavation on a boat basin and access channel and to bulkhead the boat basin at his property located near White's Landing in Chowan County on the Chowan River. THOMAS BIO REPORT PAGE 2 PROJECT.DESCRIPTION The applicant's property is located on the Chowan River at the end of a private dirt road which is almost at the terminal end of S.R. 1215. The property has an existing single family residence and a boat basin which was excavated into the applicant's high ground property years ago. The applicant proposes to undertake maintenance excavation of the basin and access channel, which under a previous permit (#204-75) to Mrs. Belle T. Reynolds was excavated to a depth of minus 8'. The applicant proposes to excavate the boat basin (84'X56') and access channel (220' longX28' wide) out to connecting waters of minus 8'. The average excavation for the boat basin is minus 5.1' and for the access channel is minus 4.0'. The applicant proposes to use a clam shell to excavate the boat basin and access channel. The spoil material from the excavation of the access channel will be placed onto a spoil barge which has a metal skirt on top to prevent runoff and transported to Waff Contracting, Inc. and unloaded and trucked to their spoil disposal site. The spoil material from the excavation of the boat basin will be placed at the spoil site on the property and retained behind silt screen fencing. The applicant also proposes to bulkhead the existing boat basin, resulting in 465' of bulkhead, with the proposed bulkhead being constructed approximately 5' waterward of NWL. The bulkhead is to be constructed of salt-treated timbers. ANTICIPATED IMPACTS The proposed maintenance excavation of the access channel will result in the removal of approximately 7952 square feet of river bottom, resulting in 1178 cubic yards of spoil material. The proposed maintenance of the boat basin will result in the removal of approximately 4704 square feet of basin bottom, resulting in 871 cubic yards of spoil material. This spoil is primarily sand materials which will be removed;by clam shell bucket. The excavated materials will be either placed on a barge or on highground property adjoining the basin. The p mposed bulkheading will be within a man-made basin and will result in the filling of approximately 2325 square feet of bottom area with approximately 517 cubic yards of fill material.
