Narrative description The applicant's property is a half acre lot •located adjacent to the east branch of Whittaker Creek, Lot 8 of the Yacht Point Subdivision, Oriental. The site is presently developed as a residential lot and development consists of a residential structure, driveway and minor landscaping on the adjacent land. Most vegetation is left natural and consists of pines and various hardwoods. The soils in.the area are basically of a clay consistency. The shoreline is characterized by a bulkhead and adjacent waters have been dredged prior to permit requirements. Water depths drop off very steeply in the project area to about a 5' water depth. An existing deck is over the. water adjacent to the bulkhead. The applicant is proposing toconstruct an "L" shaped pier con- figuration adjacent to the deck along with piles extendign into Whittaker Creek. 10. Anticipated impacts Conducting the•_aroject as'.proposed-will involve.. the disturbance of the existing bottom with the pilings of the proposed pier. It is expected to result in some short term turbidity in the project area. Adjacent waters are classified as SA by the Div. of Env. (1) In order to protect juvenile shrimp populations, no excavation or filling will be permitted between the dates of April 1 through September 30 of any year without the approval of the Division of Coastal Management. (2) The basin and channel alignment as approved must be staked by representatives of the Corps of Engineers and Division of Coastal Management prior to any construction. (3) In order to avoid undue loss of vegetated wetlands, all portions of the channel which cross through these areas must be stabilized by jetties and the maximum channel width must remain at 20'. (4) The basin must occupy the highground portion of the property. (5) All excavated materials must be confined on highground behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding.waters. This permit action may be appealed by the pemmittee or other qualitied persons within twenty (20) days of the issuing date. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Hall Permit #81-82 Page 2 of 2 ADDITIONAL CONDITIONS (6) The diked disposal area must be constructed a sufficient distance from the mean high water line or any marshland to eliminate the possibility of dike erosion into or upon the adjacent waters and/or marshland. (7) The disposal area effluent must be contained by pipe, trough or similar device to a point at or below the mean low water mark to prevent gully erosion and resultant unnecessary siltation. (8) The terminal end of the pipeline must be positioned at or greater than 50' from any part of the dike and a maximum distance from spillways to allow adequate settlement of suspended solids. (9) A water control structure must be installed at the intake end of the effluent pipe so as to assure compliance with Condition #11. (10) The resulting spoil material deposited in a highground disposal site must be leveled and smoothed to conform to surrounding areas and provided with ground cover sufficient to restrain, erosion within 30 working days after completion of project. (11) In' order to protect water quality, runoff from the construction area must not visibly increase the amount of suspended sediments in adjacent waters. NOTE: The project site is located in an area having a high probability of containing cultural resources such as artifacts, human remains, etc. If such materials are encountered, the permittee must immediately notify the District Engineer, Wilmington Corps of Engineers, 343-4629 and the N. C. Division of Coastal Management, Wilmington, NC 256-4161. Hall Post Office Box 117 Oriental, North Carolina 28571 Dear Mr. Hall: On February 6, 1986, we renewed general permit No. SAWCO80-N 000-0291 (enclosed), which provides Federal authorization for construction activities that receive authorization from the State of North Carolina. A review of your application received March 19, 1986, for a Department of the Army permit to extend a pier and install pilings on East Branch Whittaker Creek, Oriental, Pamlico County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit. Only after receiving such confirmation should you begin work. Narrative description The applicant's property is a half acre lot located adjacent to the east branch of Whittaker Creek, Lot 8 of the Yacht Point Subdivision, Oriental. The site is presently developed as a residential lot and development consists of a residential structure, driveway and minor landscaping on the adjacent land. Most vegetation is left natural and consists of.pines and various hardwoods. The soils in the area are basically of a clay consistency. The shoreline is characterized by a bulkhead and adjacent waters have been dredged prior to permit requirements. Water depths drop off very steeply in the project area to about a 5' water depth. An existing deck is over the water adjacent to the bulkhead. The applicant is proposing toconstruct an "L" shaped pier con- figuration adjacent to the deck along with piles extendign into Whittaker Creek. 10. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. b. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. The permittee will not hold the United States or the State of North Carolina liable for any such damage. -2- c.
