Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The dimensions of the concrete ramp will not exceed 12' wide by 20' long. (2) No ,filling' of marsh grass or the canal will be permitted outside of the boat ramp alignment as shown on the work plat drawing. (3) The proposed ramp will be located in the same position on the shoreline as the existing wood ramp..-. (4) The new ramp and associated activities will not cause a navigational problem in the canal. (5) The ramp is for only private residential use. (6) Any change in the plans for development, such as the construction of a house or a driveway within 75' of the canal will requre a modification of this permit with the appropriate reevaluation. (See attached sheet for Additional Conditions) Signed by the authority of the Secretary of DNRCD and the Chairman of the Coastal Resources Commission. This permit action maybe appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. . This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. We recommend that the following conditions be included in the State authorization: a. The boat ramp and associated activity will not cause an unacceptable interference with navigation. b. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. c. Sedimentation and erosion control measures will be employed. The magnitude and scope of this project allows it to be covered under the General 401 Certification for boat ramp construction, #1431. This area is c?rrent_-ly occupied by a 10 ft. wide fringe of_saltmarsh cord grass. FAST TRACK 9. Narrative description * The project site is an undeveloped residential lot in Sound View Park Subdivision located off Hwy. 24 just west of Morehead City. Dorothy Hardy owns Lot 14A situated at the end of Myrtle Drive on the east side of the main canal leading in from Bogue Sound. The size of the lot is .4 of an acre and measures 170' on the canal and 104' deep. This lot is one of the few remaining lots within the en- tire subdivision which has not been bulkheaded. A fringe of salt marsh cordgrass measuring 10-15' wide runs the length of the lot. One of the adjacent riparian property owners, Dr. T. F. Adkins, is working in conjunction with the applicant to replace an old wooden boat ramp with a new concrete ramp. The new ramp will measure 20' long by 12' wide and will displace about 100 sq.ft. of sparsely vege- tated salt marsh cordgras. Little to no highground land disturbance will be required in order to install the new concrete pad. The boat ramp will be for a limited private use of two families. 10. Anticipated impacts The proposed boat ramp will displace approximately 100 sq.ft. of cord- grass located along the man-made canal. The existing ramp is about 15-20 years old and the marsh has slowly taken over the shoreline during tuat period of time. If it were not for the existence of the marsh vegetation, the proposed boat ramp could have been authorized through the CAMA General Permit procedure. No significant impact or loss to estuarine resources.is anticipated by the construction of the proposed ramp. CAMA REVIEW The 1985 LUP for Carteret County was consulted in the review of the proposed project. No development constraints can be identified where the highground property is shown as Transitional and the fringe marsh area of the canal as Conservation. A review of your application received December 17, 1986, for a Department of the Army permit to replace a deteriorated wooden boat ramp with a concrete ramp on a canal off Bogue Sound, Sound View Park, Carteret County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. Therefore, if your office has not acted on the request by February 24, 1987, the District Engineer will deem that waiver has occurred. This area is W currently occupied bya 10 ft. wide fringe of_saltmarsh cordgrass__ 7 ,. FAST TRACK 9. Narrative. description The project site is an undeveloped residential lot in Sound View Park Subdivision located off Hwy. 24 just west of Morehead City. Dorothy Hardy owns Lot 14A situated at the end of Myrtle Drive on the east side of the main canal leading in from Bogue Sound. The size of the lot is .4 of an acre and measures 170' on the canal and 104' deep. This lot is one of the few remaining lots within the en- tire subdivision which has not been bulkheaded. A fringe of salt marsh cordgrass measuring 10-15' wide runs the length of the lot. One of the adjacent riparian property owners, Dr. T. F. Adkins, is working in conjunction with the applicant to replace an old wooden boat ramp with a new concrete ramp. The new ramp will measure 20' long by 12' wide and will displace about 100 sq.ft. of sparsely vege- tated salt marsh cordgras. Little to no highground land disturbance will be required in order to install.the new concrete pad. The boat ramp will be for a limited private use of two families. 10. Anticipated impacts The proposed boat ramp will displace approximately 100 sq.ft. of cord- grass located along the man-made canal. The existing ramp is about 15-20 years old and the marsh has slowl?r taken over the shoreline during znat period of time. If it were not for the existence of the marsh vegetation, the proposed boat ramp could have been authorized through the CAMA General Permit procedure. No significant impact or loss to estuarine resources.is anticipated by the construction of the proposed ramp. CAMA REVIEW The 1985 LUP for Carteret County was consulted in the review of the proposed project. No development constraints can be identified where the highground property is shown as Transitional and the fringe marsh area of the canal as Conservation.
