This is in response to the above-referenced public notice regarding
a proposal by the City of Havelock, North Carolina, to construct a
roadway some 80 feet wide and 310 feet long across the east prong of
Slocum Creek and to channelize 550 feet of the creek downstream from
the crossing.
While we will not inspect the site, we have discussed the proposed
work with National Marine Fishery Service and U. S. Fish and Wild-
life personnel who have inspected the area. They, as well as the
Office of Coastal Management, find the area to be crossed a high
quality, four-acre wooded swamp vegetated with bald cypress, tupelo,
red maple and gum. Some 23,000 square feet of this area will be
permanently altered by the proposed road. In addition the down-
stream channelization of 550 feet of the stream will result in the
alteration of another 8000 square feet of wetlands as a result of
spoil deposition and may contribute to draining of the existing
wetlands... Channelization will also reduce the overbank storage
capacity of the wetland system exacerbating both high and low flow
conditions and. will reduce the swamp's ability to remove sediment
and associated pollutants from flood waters and surface runoff.
In our opinion, the proposed work is contrary to the Section 404
Guidelines and should be denied. Hdrwever, if no practicable

alternatives are available to the City of Havelock for gaining
additional access to the Woodhaven area, this office would
reconsider our recommendation for denial provided the project is
modified to minimize wetland impacts.

The subject project is located near the intersection of the Atlantic and East Caro-
lina Railroad and US Hwy 70, in the City of Havelock. A site investigation was
conducted on June 15, 1982.
The city of Havelock proposes to construct a street across the East Prong of Slocum
Creek in order to provide access from Belltown Road (SR1739) to US 70. The proposal
will include (1) filling approximately 31,000 square feet of wooded swamp, (2) Approxi-
mately 2000 square feet of stream bed and (3) the excavation of a channel 550' long
X 30' wide X 2' + deep. The main purpose of the channel is to provide drainage.
Culverts will be placed in the stream bed to provide drainage through the fill area.
There will likely be an increase in stream turbidities and possibly an increase of
other pollutants above background levels. However, it is not anticipated that this
project activity will have a significant adverse impact on water quality.
It is recommended that-a 401 certification be issued.

310 ft long across the east prong of Slocum Creek The project also involves

9. Narrative description
The project site is located some 1000 ft. upstream of the US Hwy. 70 bridge which
intersects w
i ith the east branch of Slocum Creek in the City of Havelock, Craven
County. The inland waters of Slocum Creek at this point are also considered a pub-
r
lic trust ar ea of environmental concern. Access via land is next to impossible due
g to the dense stand of wooded swamp on either side of the str eam. Therefore, field
observations were made from a more accessible location both above and below the pro-
' ject.
The City of Havelock is requesting authorization to construct a.major road connect-
ing a large portion of the town known as "Woodhaven" on the west side of the creek
with the east side of town. At present, only Belltown Road provides access to this
area. In order to accomplish their needs, a corridor some 100' wide by 300' long
will be cut through the wooded swamp and across the upstream bed. Plans inclu_dg_a
causeway fill to the center line of the stream where 3-5 culvert pip s will be in-
stal a to accommo ate normal stream flow as we 1 a? ?r.,r?, L*arPrs.
In addition, Alternative Plan B-x&quires channelizing downstream of the new road
for a distance of 550' with a project width of 30'. Dred Zed-material from this
operation will be stock.]gd ?n alternating fashion on either side of the creek.
The reader is encouraged to review the attached application plans and the narra-
tive supplement provided by the City of Havelock.
10. Anticipated impacts
The proposed project will directly displace 2,000 sq.ft. of stream bed considered
public trust waters, and some 23,200 sq.ft. of adjoining wooded swamp. The appli-
cant has provided supportive statements as to the necessity of this road and the
public benefits that will be derived from-its construction. This office is reminded
that the navi abilit of the creek-will be-reinstated (to some de ree b the ro-
? posed culvert pipes under t e roa Problems associated with erosion and sedimenta-
tion appear to be the most important issues during the actual construction of the
road.
Lone term adverse imvacts mav_o_c as a result of channelizing the 550' section of
the creek. These impacts. include the possible- drainingo-f the wooded swamp and.
shif intint g the hydrologica_l.__functions of the stream further down Slocum Creek. As a
result, water quality of Slocum Creek m_ay decrease as levels_of sediments and other
pollutants enter the waterway further down. These conditions will become more evi-
dent during periods of heavy rains and runoff. Additional losses to the wooded swamp
habitat will be sustained as the dredged spoils are stockpiled along the new channel
alignment. At least 8000 sg.ft. of additional vegetation will be destroved by the
spoil. This will most certainly ter the natural flow of the.wate.rs through the
wooded swamp.
CAMA Review
The land classification scheme within the land use plan for Havelock designates the
waters and wooded swamps of the east prong of Slocum Creek as "conservation." On
Pages 61 and 62 of that document, we find the purpose and description of the conserva-
tion class and they read as follows:
"The purpose of the conservation class is to provide for effective long term manage-
ment of significant, limited, or irreplaceable areas. This management may be needed
because of its natural, cultural, recreational, productive, or scenic values. These
areas should not be identified as transition lands in the future. The conservation
class should be applied to lands that.-contain major wetlands, essential undeveloped
shorelines that are not unique, fragile or hazardous for development, necessary
wildlife habitat, or areas that have a high probability for providing necessary
habitat conditions, publicly owned water supply, watersheds and aquifers and forest-
lands that are undeveloped and will remain undeveloped for commercial purposes."
The above quotations are then followed by another statement that supports the city's
need to construct the proposed road, and it reads....
"The City of Havelock will allow development within conservation class lands to en-
sure public access. Examples of this type will include boat ramps, docks, power
easements, etc. "
This observer is confident that the proposed road qualifies for such an exemption
under their requirement to "ensure public access." However, it is unclear if the
land use plan supports the proposed channelization of Slocum Creek.
The land classification map further supports the City's request by showing that
the proposed road will connect large developed and transition areas on the west
side of the creek with the rest of the town on the east.
In terms of CAMA's Use Standards for the public trust areas of environmental con-
cern, the project has demonstrated the public benefit which will be derived from
the proposed road crossing. However, the problems associated with channelizing
the creek remain questionable, and such activities are generally considered incon-
sistent with the state's management objectives.

The City of Havelock has over the past several years, witnessed a great amount
of development. A good portion of this development has been in the area lying to
the West of U.S. Highway 70, the major traffic generator for the Havelock area. A
great portion of this development lies within an area subtented by Miller Boulevard
and Belltown Road. Miller Boulevard is the major thoroughfare for vehicular move-
ment West of U.S. Highway 70 with Belltown Road being the only access to the
Woodhaven Development and Belltown. Belltown presently has some minor development
but has a considerable amount of land area that can and is expected to soon be
developed.
The convergence of the traffic from Miller Boulevard and Belltown Road together
upon the intersection of Miller Boulevard and U.S. Highway 70, along with the
location of the Atlantic and East Carolina Railroad, create two major traffic
problems. The first problem is due to the closeness of the two intersections,

approximately 150 feet. During the early morning rush-hour and other peak traffic
flows, the "bottlenecking" of the traffic from both these arteries create enough
spontaneous waiting traffic at the intersection of Miller Boulevard and U.S. Highway
70 that the waiting traffic quite often extends well beyond the intersection of
Miller Boulevard and Belltown Road. This prevents any traffic access, for a turn
in either direction,from Belltown Road onto Ydller Boulevard. Vahicular ingress
to or emergency egress from the Woodhaven/Belltown area is considerably restricted.
The second, and probably the most significant problem, is created at the
intersection of Belltown Road and the Atlantic and East Carolina Railroad. A
previous derailment near this intersection has inspired the undertaking of this
project. Should a derailment occur at the intersection, or within sufficient
distance of the intersection to prevent free-flow of traffic, the Woodhaven/Belltown
area would be completely isolated from the remainder of Havelock.
Thus, the City of Havelock is budgeting for and is prepared to proceed with
the construction of the "Woodhaven Drive Extension" as second means of access to
the above areas. The"project will begin at the intersection of Woodhaven Drive
and Belltown Road and proceed across the East Prong of Slocum Creek to an
intersection to be created with U.S. Highway 70.
There are presently two alternatives in the nature of the actual crossing of
the creek. Alternate "A" is based on an existing 60-foot access held by the City
of Havelock: Alternate "B" is based on a recommended access width of 80-feet.
As a supplement to the major project, the cleaning-out of the area lying between
"Woodhaven Drive Extension" and the Atlantic and East Carolina, Railroad, is being
requested in order to allow for a better "free-flow" movement_of waters in this
area.
It is respectfully requested by the citizens and the Board of Commissioners
of the City of Havelock, that all due expeditience and consideration be given in
the approval of this application.

SUBJECT: General Certification for Emergency Activities
City of Havelock
Craven County
The city of Havelock has requested permission to conduct emergency repairs to an
existing roadway. The roadway crosses the east prong of Slocum Creek in the city
of Havelock.
Due to heavy rains and excessive flooding, an 80 ft. section of roadway washed out,
depositing fill material in the stream bed and the adjacent swamp. I met with Mr.
Ralph Kennedy, city manager, and Rudy Smithwick, land quality engineers on 11/8/85,
at the site. We discussed repair work proposed by the city to protect the remaining
roadway structure and prevent further deposition of fill material downstream.
The repair work involves:
(1) Placement of stone and rip-rap in the breached area approximately
80 ft. long x 85 ft. wide, and 3 ft. deep.
(This work should not extend beyond the areas already disturbed by
the roadway)
(2) Construction and repair of silt fences along the slopes of the roadway
(no fill in wetlands or surface water).
(3) Any new work involved in the completion of the roadway should be covered
under a 401 water quality certification.
After conferring with Mr. L. P. Benton on 11-8-85, I phoned Mr. Kennedy and told
him that the proposed repair work could be covered under the general certification
for emergency activities (WQC 13.33). It is suggested that this information be
confirtped by letter to Mr. Kennedy as soon as possible.

of US 70 at Woodhaven Drive) as requested in the permittee's application dated 10/10/85 including
attached plats, sheets 1-3 of 3, dated 10/10/85.
This permit, issued on //,4/,85- , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) This permit authorizes causeway construction as described in the revised
work plat drawings for a total base width of no more than 95'.
(2) All fill material and construction must be confined to the alignment as
shown on the work plat drawings in such a way as to prevent erosion of
the solid materials into the east prong of Slocum Creek and its adjacent
wetland areas.
(3) The permittee is required to revegetate the outer slopes of the causeway
fill with wetlands vegetation as originally described in the application
request.
NOTE: The permittee is strongly urged to protect the waters and wetlands of
the Slocum Creek system from encroachment, fill and other alterations
because of its value to local citizens in the form of fish and wildlife
resources; flood control and open space.
(See attached sheet for Additional Conditions
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department,
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1986
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

SUBJECT: Modification of City of Havelock CAMA Permit
DATE: November 1, 1985
The attached material was submitted by the City of Havelock to request
a relatively minor modification to a permit it received in 1982. The
permit authorized road construction across the east prong of Slocum Creek.
There has been a failure of the road shoulder, and subsequently, a small
portion of the paved surface. Shoulder widening to decrease the grade
is the main reason for the request. DCM plans to take action on this
project in several days. However, Section 404 conditions and/or notations
will be placed on the CAMA permit as requested. Additionally, the C.O.E.
has been notified of a preliminary finding by your office that a 401 is
required.

I have no objections with the issuance of a modified permit
to- the City of Havelock per their current request. The condi-
tions of the modified permit, however, should reflect the
change in projet alignments.
Condition No. l should read that the permit authorizes causeway
construction as described in the revised work plat drawings
for a total base width of no more than. 95°.
Condition No. 2 - that all fill material and construction must
be confined to the alignment as shown on the work plat draw-
ings in such a way as to prevent erosion of the solid materials
into the east prong of Slocum Creek and its adjacent wetland
areas.
Condition No. 3 - that the applicant is required to revegetate
the outer slopes of the causeway fill with wetlands vegetation
as originally described in their application request.

Permit 159-82 - The City of Havelock
Narrative description
The project site, known as Woodhaven Drive, crosses the east
prong of Slocum Creek in Havelock just off. Hwy. 70 next to
the Toyota dealership in Craven County.
In December'of 1982, the DCM issued Permit 159-82 to the City
of Havelock, Craven County.' The permit authorized construction
of a causeway road identified as "Alternative B." The width
of the road as prescribed by Alternative B. was a total of 80'.
This included two ten ft. wide sections of riprap on the.shoul-
ders of the 60' wide base. Construction of Woodhaven Road, as
it is known, was completed in the summer of 1983. Unfortunately,
about two years ago, shortly after completion, the side slopes
(at a ration of 3/4:1) of the new roadway started to sag, slump,
and erode, preportedly due to rainwater runoff. At that time
the City of Havelock closed the road to vehicular traffic.
On October 10, 1985, .a representative of DCM stopped the City as
they were engaged. in widening the base of the causeway by fill-
ing the wooded swamp on either side with marl riprap. On October
16, the City applied to this office for a minor modification to
their currently active CAMA permit - No, 159-82 which expires on
December 31, 1985.
As proposed, the base of the causeway will be widened by 7-1/2'
on each side of the base. Marl riprap will be used to fill the
shoulders on each side of the road. About 4,350 sq,ft. of wooded
swamp will be displaced along the31O' alignment of the road. The
increased shoulder widths will help support the roadway and also
allow the side slopes to be increased up to.a ratio of 2' hori-
zontal for 1' vertical. The elevation of the new roadway will be
1' less than the original height. Additional sections of steel cul-
vert pipe will be attached to the existing culverts in order to
accommodate the increased. width.

As you are already aware, due to the design of the original
connector street the roadbed failed. A complete and thorough study by
the geo-technical engineers concludes that the proposed work set out in
the modification application is totally necessary to rectify the situtation.
Time is of essence as the need for this road is urgent. The road be-
fore its failure received much higher usage than was even anticipated.
Therefore I urge the agencies involved to work as expediently as possible
to act on the modification request. The adjoining property owners have
been notified.
Additionally, we would like to request an extension of the expiration
date from December 31, 1985.
If I can be of service to you or can do anything to speed things up
please let me know.

Public Notice of Application for
Water Quality Certification
The North Carolina Division of Environmental Management of the
Department of Natural Resources and Community Development has received
an application from the City of Havelock, P.O. Box 368, Havelock, NC
28532, for a Water Quality Certification pursuant to Section 401 of the
Federal Clean Water Act as amended. The activity for which the
Certification is sought is the widening of the existing road fill for an
access road crossing East Prong Slocum Creek. The road was built in
1983, but bank erosion has resulted in a need to reslope the sides of
the embankment.
The public is invited to comment on the impact of the proposed
project on water quality. A copy of the application may be inspected at
the Department's office in Raleigh, Archdale Building, 512 N. Salisbury
Street, Room 923 or the Washington Regional Office, P.O. Box 1507,
Washington, N.C. 27889, telephone (919) 946-6481, during normal work
hours. Comments must be submitted in writing no later than November 27,
1985. Any comments should be addressed to the N.C. Division of
Environmental Management, Water Quality Section, P.O. Box 27687,
