Construction (1) This permit authorizes only the bulkheading and backfilling of the existing ramp, installation of proposed pumpout facility, concrete drive and necessary grading and parking area stabilization with pervious materials. (2) The 20 slip "Floating Dock" and "Proposed Open Deck" and "Proposed Covered Deck" is hereby deleted as required by Rules of the Coastal Resources Commis- sion. Rule 07H.0208(b)(6)(F) requires that docks and piers not interfere with the access of any riparian owner. Access for lot 15, and perhaps others, would be blocked. (3) The 20 linear feet of bulkhead will be constructed across the waterward end of the existing boat ramp as shown on permit plans. (4) All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. (9) The permittee will post a sign in clear view of boating public stating that a no sewage discharge policy will be enforced at the marina. (10) Living aboard boats docked at the marina is not authorized. (11) Overflow from the pumpout holding tank is not authorized and would constitute a violation of stale water quality standards. The land based holding tank must be pumped out and the waste disposed of in a manner approved by the County Health Department. This project does require a 401 certification but does meet the requirements of general certification for bulkhead construction. 2. The land surface should be sloped away from the bulkhead to prevent runoff from the forklift road and parking area entering adjacent surface waters. 3. Any discharge of sewage from this facility or boats using this facility will violate the fecal coliform water quality standards. The following should be included to reduce the potential for such violations: a. Transient or live-aboards should be prohibited at the marina. b. Pump-out facilities must be provided. If the pump-out facility utilizes a holding tank, the septage should be pumped out and disposed of in an approved manner. Discharge or overflow from the tank is prohibited. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. High Page 2 9(a) SITE DESCRIPTION: The project site is located on Lot #16, Block 3 of the "Riverview Acres" Subdivision which is also situated along the northern shoreline of Calabash River in the Town of Calabash on the end of S.R. 1204. An existing fish/beverage house; "L" shaped dock; 12' wide concrete boat ramp; and sand/gravel parking area exists at the site. This commercial fishhouse is located between two single family residential units and is the last commercial establishment along the federally dredged channel of Calabash River. Cordgrass marsh (Spartina alterniflora) is found growing vigorously throught the area right up to the upland banks. The river is classified as a secondary nursery area but exhibits productive mud flat characteristics adjacent to the main channel. The waters are classified as S.A. and this area has been closed to shellf ishing. existing oat basin measuring 30' x 60' to a -4' MLW depth was dug two years ago under CAMA permit #274-84 along side the concrete dock. The High brothers have been using the property as a commercial business (fishhouse, beverage sales, ramp fees, etc.) since 1979. 9(b) PROJECT DESCRIPTION: The applicant's propose to convert the business more into a marina and yacht club operation. The fishhouse business will remain. In addition, a 280' long by 6' wide floating dock will moor 20 vessels between 16' by 3' floating finger docks. Some additional transient docking could be aligned on the north side of the main dock just northeast of the existing elevated building. A 10' x 20' covered deck and 15' by 20' open deck is proposed along this northeastern side as well. A pump out station with a 850 gallon, underground storage tank is also proposed as an amenity for the marina facility. This application wishes.to bulkhead across the boat ramp and backfill it up to the original lot elevation of #8' (MSL). This bulkhead would follow the original alignment that was existing back in 1984 before the ramp was permitted. The purpose of backfilling the ramp is to achieve boat haul-out capabilities with a fork lift. A 12' wide 6" thick concrete roadway will run across S.R. 1204 to six lots the applicants own and are presently storing boats. The boat dry storage and haul-out facility is a vital part of the applicant's marina plans. No additional dredging is anticipated at this time. 10. ANTICIPATED IMPACTS: The operation of a commercial marina at this location most certainly will be in violation of the subdivision's restrictive covenants and is not in keeping with the residential character of the lots on either side. The permanent docking of 20 large boats in this upper section of the Calabash River may cause degradation of S.A. classified waters. The haul-out operation should not add to bacterial contamination but depending on the size of the operation it could deteriorate water quality as well. Heavy boat activity around the ramp area and on the north side of the proposed dock could accelerate the undermining of productive cordgrass marshland. About 50 s.f. of alterniflora will be impacted by shading from the covered decks. The rest of the two decks will be over an old spoil Jerry & James L. High Page 3 pile vegetated with predominately marsh elder and sea oxeye and open water of approximately -4' depth (MLW). This 280' long floating dock may also interfere with the riparian rights of adjacent property owners. The applicants claim their mother owns the low tidal wetlands in front (waterward) of other adjacent property owners in this subdivision. A 205 claim may have not been filed. As to stormwater the existing tract is sand and marl and runs towards the ramp. The proposed bulkhead could change the existing slope back from the water. The proposed concrete fork lift road would account for 21% impervious cover. The rest of the parking lot surface will be coquina on sand. High, Mr. Jerry High and Ms. Ella High for a Department of the Army permit to construct a bulkhead, backfill a boat ramp, construct docks and piers and install mooring piles on the Calabash River, Calabash, Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The 20 linear feet of bulkhead will be constructed across the waterward end of the existing boat ramp as shown on permit plans. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or -2- I. adjacent to the authorized work. Use of the permitted activity must not interfere with the public"s right to free navigation on all navigable waters of the United States. e. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. f. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. The permittee will not hold the United States liable for any such damage. g. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. h. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU-s or less are not considered significant. i. This permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and it does not authorize any injury to property or invasion of rights, or any infringement of Federal, State or local laws or regulations.
