(1) The project must be carried out in accordance with attached plats, narrative description and letters of agreement identified by DCM for clarity as sheets 1-15 of 15. Any deviation from these attachments will require a modification of this permit unless otherwise waived by DCM as being an insignificant change. (2) This permit is issued contingent upon the Town of Indian Beach approving the development of a new wastewater treatment plant, which has been permitted by the Division of Environmental Management at the Colony By-The-Sea development, and upon the Town subsequently authorizing sewage from "Pirate Island" develop- ment being pumped by forcemain to such plant. The permittee shall, prior to construction authorized by this permit, submit a letter to the DCM containing evidence that the Town has taken favorable action on the matter described above. (3) A 50' wide vegetated buffer zone will be maintained between the new bulkhead and all new construction as shown on the work plat drawing. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Our record includes a clear objection from the Division of Health Services on the applicant's initial plan to tie into the existing subsurface plant at Colony-By-The-Sea. Carteret County The Subject application has been reviewed for water quality impacts and the following comments are offered: 1. The proposed project will require a 401 Certification but does meet the requirements of our General Certification No. 1272 for bulkhead construction. 2. The stormwater designs for the project have been reviewed a number of times and there is no overall final plan. Major changes to the original plan involve: raising the overflow weir pipe to an elevation of 11.4 feet MSL and changing the storm drain pipe from parking lots to a percolation bed conduit to increase infiltration capacity of the system. With these changes the system should adequately accommodate the 10-year storm event and protect adjacent SA waters from runoff. 3. The project includes replacing 410' of bulkhead, constructing a pier, and covering 53% of the site with impervious cover. Since the project is adjacent to Bogue Sound, classified SA and open to shellfishing, a stormwater control plan was submitted. The project has been reviewed to determine impacts to water quality and the effectiveness of the stormwater control plan. The following comments are offered: 1. That a 401 certification is required for bulkheading but should meet the conditions of a general 401 for bulkhead construction. 2. The stormwater control plans have been evaluated subject to the 10-year storm, with respect to both 24-hour duration and 1-hour intensity. The plan has gone through a number of changes and an overall final plan was not submitted. The changes involved were; raising the overflow weir pipe to an elevation of 11.4' MSL to accommodate the 1-hour intensity flow, and changing the storm drain pipe from the parking lots to a percolation bed conduit to increase infiltration capacity of the system. As a result of the changes the system should not discharge due to a 10-year storm-event and the retention pond should resume its normal level within 2 days after the storm event. As stated by the applicant, it is strongly recommended that slotted PVC well pipe be used in the percolation bed. 3. The stormwater plan has been reviewed for the currently proposed level of development and may not be adequate with any additional development.. Storage capacity within the fountain and the "stream" flowing through the center of the island were omitted; space required for the boat foundation was eliminated; and volumetric calculations were made based on the discussions at our meeting in your office on July 24 (See attachments). With the overflow pipe raised to an elevation of 11.4 feet above the mean sea level, the calculations result in storage capacity equating to 32,097 cubic feet. Whereas the required capacity is 30,195 cubic feet. Box 471 Salter Path, N.C. 28575 2e: Pirate's Island Project Dear Mr. Zoner : A review of the existing calculation and comments indicates that the variable of ground water infiltration and lateral transport was not considered. Russnow, Kane and Andrews, Inc. has had the opportunity to perform a soil boring and double ring infiltrometer tests. The boring revealed fine to medium very well sorted permeable regressive beach ridge sands. These sand typically exhibit extremely high infiltration rates. The bench test at one foot revealed an infiltration rate of 67.5 in./hr. and the test at two feet. had a 123.7 in. /hr.. . If storm water only covers the 8.9 foot contour, the infiltration rate for 550,000 gallons per day would be 2.07 in./hr. in a 17,800 ft2 basin. For design purpose and infiltration rate will exceed the ability of the aquifer to laterally transmit the storm water baser,' on the Darcy.-Equation. The remainder will be transmitted after the first day. It is understood that this model only defines steady state. At lesser gradients other conditions will be met. Use of the available storaae area should only be needed in very intense rainfall periods or for extended periods of continual rainfall beyond the ten year event. Narrative Description Indian Beach Development Corp. has recently acquired a 5.13 acre tract of land shown on the vicinity map as in the community of Salter Path'off Hwy. 58'on Bogue Sound, just about 8 miles west of the Atlantic Beach stop light.. The site is just west of Indian Beach East in Carteret County. A'deteriorating mobile home park and vacant lot characterize the site which immediately adjoins the east side of the Mariners Point Condominium project. the applicant proposes to develop a commercial amusement park to be known as Pirates Island. The plans-for the highground develop- ment.call fora series of gift shops with a cluster of buildings forming an arcade, as well as a water slid, golf course, restaurant and parking lot area will complete the highground amenities. As part of the central attraction to the park, the applicant plans to ferry people to the park from various locations along Bogue Sound. This will require the construction of a pier as shown on the re- vised work.plat drawings. The maximum overall total length of the proposed pier (6' wide) will be 3751. This will include a floating platform measuring.18' wide by 251. One ferry boat or skiff will be parked al'ing the west side of the platform where the MLW depths approximate -1'. The project has been designed, with a 50' wide buffer zone between the existing bulkhead and any of the highground development.. A series of well vegetated sand dunes will be created within this 50' buffer zone to control runoff as well as to accent the tempo of the Pirates Island Park. In terms of other water related development; the applicant plans to replace the entire 410' long existing bulkhead. Although the exist- ing bulkhead abuts an intermittent marsh fringe, the new bulkhead will.be installed along the old alignment.and landward of the salt marsh cordgrass. The applicant has provided a humber of fact sheets and data relating to the amounts of pervious versus impervious areas throughout the total development. This information, in combination with:itae,interior drainage system, represents the stormwater manage- ment plan for the total development. A series of grass swales lead- ing to porous retention ponds will filter any runoff before it enters Bogue Sound, Wastewater treatment is another important issue in the review of this project. At this time, the developer plans to pump wastewater from the project site east along Hwv. 58 to an existing package.,plant operated under the guise of Colony By the Sea Condos. At present, this aeration plant with tertiary filters, is rated at 22000 gals. per day and will be expanded to 38,000 gals. per day to accommodate the Pirates Island requirements. 10. Anticipated impacts liThe..SA waters of Bogue Sound always deserve a special review when ,r;major development is planned along the shoreline- Preliminary indi- Ications are that water quality will not be significantly impacted iby the proposed project. This .is contingent upon the implementation is of the 50' vegetated buffer zone and a one boat ferry operation, as well as a viable wastewater treatment system. A professional re- view of the stormwater management plan-may very well discover weak- nesses in the design which are not so obvious to this reviewer. Sur- face water maps show that the waters in an around the project site of Bogue Sound are closed to shellfishing and have been in that con- dition for some time. Primary influence appears to be from the Salter Path Community to the west. . Although patches of submerged aquatic vegetation exist in and around the proposed pier, no dredging is planned or required for the ferry boat access. CAMA REVIEW The Carteret County LUP dated September 6, 1985, classifies the high ground project site as "community" and.the surface waters of Bogue Sound as "conservation." No specific developmental constraints can be identified in the review of the LUP. The project site is located in an unincorporated area of Carteret County and contains approxi- mately 90.acres of land, most of which has already been developed. Carteret County has been given a copy of the CAMA application and .has been asked to review and comment on the proposed project. Narrative Description Indian Beach Development Corp. has recently-acquired a.5.13 acre tract of land shown on the vicinity map as in the community of Salter Path•off Hwy. 58'on Bogue Sound, just•about 8 miles west of the Atlantic Beach stop light.. The site is just west of Indian Beach East in Carteret County. A deteriorating mobile home park and vacant lot characterize the site which immediately adjoins the east side of the Mariners Point Condominium project. '(he applicant proposes to develop a commercial amusement park to .be known as Pirates Island. The plans for the highground develop- ment.call for a series of gift shops with a cluster of buildings forming an arcade, as well as a water slid, golf course, restaurant and parking lot area will complete the highground amenities. As part of the central attraction to the park, the applicant plans to ferry people to the park from various locations along Bogue Sound. This will require the construction of a pier as shown on the re- vised work plat drawings. The maximum overall total,length of the proposed pier (6' wide) will be 3751. This will include a floating platform measuring 18' wide by 251. One ferry boat or skiff will be parked al'-3ng the west side of the platform where the.MLW depths approximate-1'. The project has been designed with a 50' wide buffer zone between the existing bulkhead and.any of the highground development.. A series of well vegetated sand dunes will be created within this 50' buffer zone to control runoff as well as to accent the tempo of the Pirates Island Park. In terms of other water related development, the.applicant plans to replace the entire 410' long existing bulkhead. Although the exist- ing bulkhead abuts an intermittent marsh fringe, the new bulkhead will.be installed along the old alignment and landward of the salt marsh cordgrass. The applicant has provided a humber of fact sheets and data relating to the amounts of Pervious versus impervious areas throughout the total development This information, in combination with=tae: interior drainage system, represents the stormwater manage- ment plan for the total development. A series of grass swales lead- ing to porous retention ponds will.filter any runoff before it enters Bogue Sound, Wastewater treatment is another important issue in the review of this project. At this time, the developer plans to pump wastewater from the project site east along Hwy. 58 to an existing package.,plant operated under the guise of Colony By the Sea Condos. At present, this aeration plant with tertiary filters, is rated at 22000 gals. per day and will be expanded to 38,000 gals. per day to accommodate the Pirates Island requirements. 10. Anticipated impacts <<The.SA waters of Bogue Sound always deserve a special review when ,;major development is planned along the shoreline. Preliminary indi- I;eations are that water quality will not be significantly impacted ??i?by the proposed project. This..is contingent upon the implementation ,.2 of the 50' vegetated buffer zone and a one boat ferry .operation, as well as aviable wastewater treatment system. A professional re- view of the "stormwater management plan may very well discover weak- nesses in the design which are not so obvious to.this reviewer. Sur- face water maps show that the waters in an around the project site of Bogue Sound are closed to shellfishing and have been in that.con dition for some time. Primary influence appears to be from the Salter Path Community to the west. , Although patches of submerged aquatic vegetation exist in and around the proposed pier,.no dredging is planned or required for the ferry boat access. CAMA REVIEW The Carteret County LUP dated September 6, 1985, classifies the high ground project site as "community and. the surface waters of Bogue Sound as "conservation. No specific developmental constraints can be identified in the review of the LUP. The project site is located in an unincorporated area of Carteret County and contains approxi- mately 90.acres of land, most of which has already been developed. Carteret County has been given a copy of the CAMA application and .has been asked to review and comment on the proposed project. Be- cause-the proposed project involves multi-use activities, the de- velopment o'f the property may need authorization from the County .Planning and Board of Commissioners. The land use designations on the properties immediately adjoining the project site in Indian Beach are classified as "developed" for those areas on the west side of the project, and "transition to.the east side of,the project. Presently there are extended air wastewater treatment plants serving the Colony by the Sea condominium complex of approximately 22,0.00 gallons per day. It is estimated that the flows from Pirates Island will not exceed 38,000 gallons per day. We intend to, construct on the present site allocated to sewage disposal a new 60,000 gallon per day extended air wastewater treatment plant, tertiary filter, sludge holding facilities, and adequate surge capabilities. Effluent disposal will be accomplished by enlarging the present low pressure dosing field using the 1.5 gallon per square foot standard, and setting aside a 100% green area for future repair, if necessary. This combined system will insure many years of trouble free wastewater disposal. Sheet drainage directed to grassed swales, and into retention ponds will trap nutrients and sediment, which would prevent degradation of water quality. 3.
