Gray, Superintendent District 1, Dredge Operations Ferry Division North Carolina Department of Transportation Room 116, Maritime Building 113 Arendell Street Morehead City, North Carolina 28557 Dear Mr. Gray: RECEIVED VIA QUALITY SECTION Reference your Department of the Army permit, issued on December 30, 1977, which authorizes maintenance excavation of the basins and channels required for ferry operations between Hatteras Island and Ocracoke, Hatteras Inlet, Pamlico Sound, Dare an.4 Hyde Counties, North Carolina and your written request of October 18, 1985, for permit modification to place approximately 26,000 cubic yards of excavated material on and adjacent to the shorelines of Hatteras Inlet and the Atlantic Ocean, Ocracoke Island, Hyde County, North Carolina. You requested this modification to facilitate the removal of shoals within the 800-foot-long, 200-foot wide, 12-foot-deep channel created by Hurricane Gloria. The permit is hereby modified to include the work as shown on the enclosed plan. It is understood that all conditions of the original permit remain applicable and that the expiration date is unchanged. The following special conditions are hereby made part of this authorization: a. This modification to place excavated material on the shorelines indicated on the enclosed plans is a one-time authorization. Should this work not be initiated before December 31, 1985, the authorization provided by this modification will become null and void. b. In order to protect neating areas of the loggerhead turtle, excavated material will not be placed on the Atlantic Ocean beaches until after November 1. c. Excavated material will be placed and retained strictly in accordance with the enclosed plan. No vegetated wetlands will be filled. 10 It . . -2- d. This activity will be consistent with applicable water quality standards, effluent limitations and standards of performance, prohibitions and practices. The North Carolina Division of Environmental Management will be satisifed regarding the need to obtain a Water Quality Certification in accordance with Section 401 of the Clean Water Act. 'i 7RANCH On January 27, 1981, we issued general permit No. SAWC080-N- 000-0291 (enclosed), which provides Federal authorization for construction activities that receive authorization from the State of North Carolina. A review of your application received August 21, 1985, for a Department of the Army permit to authorize an upland excavated material retention area for maintenance dredging and an open water excavated material retention area for emergency dredging for the Hatteras-Ocracoke Ferry, Pamlico Sound, Hyde County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. If there are no unresolved differences of State-Federal positions or policy, the final action taken on your application by the State will result in your receiving written notice from us that your application has been successfully processed under our general permit. OF TRANSPORTATION, FERRY DIVISIO DATE: SEPTEMBER 17, 1985 This permit has a long history which includes two renewals, two modifications and a 10 year maintenance permit which is valid until November 1, 1987. This office has received a request to modify the permit to authorize two additional spoil disposal areas. The current permit authorizes beach disposal for spoil, however, the agreement between DOT and the National Park Service has expired. Since the beach has chanaed orientation, it is necessary to depict the new agreement. Several conditions are express, in the new agreement which should also be placed on the CAMA permit. These include: (1) Any materials- deposited on the beach will be deposited on the beach berm and not cover the intertidal sand flats behind the berm. (2) In order to protect potential loggerhead sea tuttle nests, no material may be placed on the ocean beach during May through October of any year without the prior approval of the National Parks Service. Spoil may be placed adjacent to the inlet channel during this period. (3) Beach access for equipment necessary to accomplish spoil disposal will be over designated trails approved by the NPS. (4) Material placed on the beach will not be allowed to pile up and will be contoured to no greater than two feet above the adjacent beach berm elevation. Though area two was requested by DOT, the NPS did not allow its use. This area should be deleted from the plans by the following condition: Area #2 will not be used for spoil disposal. Area #3 is a relic spoil disposal site and is suitable for use for spoil disposal. I have no objection subject to the following conditions: P.O. (2) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spill-over of solids into any marsh or surrounding waters. (3) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or below the mean low level to prevent gully erosion and unnecessary siltation. (4) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. (5) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. (6) The diked disposal area will be constructed a sufficient distance from the mean high water level or any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. (7) The dike and excavated areas will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. C??
