This permit, issued on 9-1 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) All excavated materials will be confined on high ground behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (2) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or below the normal low water mark to prevent gully erosion and resultant unnecessary siltation. (3) The terminal end of the pipeline will be positioned at or greater than 50' from any part of the dike and a maximum distance from spillways to allow adequate settlement of suspended solids. (4) A water control structure will be installed at the intake end of the effluent pipe so as to assure compliance with Condition No. 6. (5) The diked disposal area must be constructed a sufficient distance from the MHW line or any marshland to eliminate the possibility of dike erosion See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on June 30, 1991 _ In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (7) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. (8) Flow from the diked retention area will be confined by pipe, trough or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and resultant unnecessary -siltation. Disposal effluent will be returned to waters "closed to shellfishing" of the facility basin. (9) The dike will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (10) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related --- -- discharge (increases- of 25 NTUs or less -are not considered -significant). (11) This project must remain consistent with the N. C. Sedimentation Pollution Control Act throughout its duration. NOTE: This project may create moderate to severe mosquito problems. For information regarding appropriate mosquito control measures, contact the Vector Control Branch (919) 733-6407. NOTE: The proposed project is certified under General Water Quality Certification No. 1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. Washington Regional Office SUBJECT: DF/CAMA Comments NCDOT - Manns Harbor Dare County The DOT proposes to maintenance dredge three areas at their Manns Harbor facility. Area 4 is the existing turn basin 1300 x 150; Area 2 is a channel in Spencer Creek 4860 x 80 feet wide; Area 3 is an access channel in Croatan Sound 4500 x 100 feet wide. These areas would be maintained to a depth of nine feet MLW. A hydraulic dredge would be used to pump the spoil to an existing three million feet3 diked storage area. This dike area is an integral part of a storm water management plan prepared earlier this year. Also proposed is maintenance excavation of Spencer's Creek and Croatan Sound. N.C. D.O.T. MANNS HARBOR FERRY DIVISION - CHANNEL MAINTENANCE BIO REPORT PAGE 2 SITE DESCRIPTION: The Department of Transportation is approaching completion to the marine maintenance facility at Manns Harbor as approved under CAMA Permit #168-78. The turning basin, Spencer's Creek and some of the channel between marker 1110" and "3" have experienced some shoaling and now exhibit water depths as low as 6.3 feet below mean low water. The applicants are requesting authorization to maintenance dredge these areas. Originally the request was to dig to -12 feet MLW but they cut the request to -9 feet MLW to allow joining the proposed channel with water as deep or deeper than that proposed. The access channel will extend 4,500 feet into Croatan Sound and will be 100 feet wide. The channel into Spencer Creek will be 4,860 feet long by 80 feet wide. Two new areas in this creek will be widened to accomodate the needs to negotiate the bends in Spencer Creek with the large ferries. The turning basin dimensions will be 1,300 feet long by 150 feet wide. The excavation will be accomplished by hydraulic dredge and all spoil-will be retained in the existing diked disposal area adjacent to the maintenance facility. Since the proposed project is within areas closed to shellfishing, it will be necessary to return the disposal effluent to "closed" waters. The spoil disposal area is adequate to retain the spoils generated by this project. ANTICIPATED IMPACTS: The dredging will result in the deepening of Spencer Creek and Croatan Sound.
