Hwy. 13-17 crossing at Wi l l i amston as requested in the permittee's application dated 11/4/85 including attached plats, sheets 1-/12 of 12 dated 9/85. This permit, issued on _ SS, I 0 6 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject pemiittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) (a) The proposed structures will be located as close as possible to the existing bridge/roadway alignment to eliminate further habitat fragmentation and minimize wetland habitat. (b) Wildlife underpass structures will be incorporated midway between the primary bridge spans and overflow structures. (c) The length of the primary bridge spans will be increased by 280 feet to ensure that. the .entire riverbank Levee is -bridged on piles rather than filled, so that' it may continue to serve as an important wildlife travel corridor. (d) Collector (upstream) and distributor (downstream) systems of ditches will be excavated to facilitate the distribution of surface waters through- out the palustrine forested wetlands to maintain sheet flow. (e) An area of three acres, presently occupied by the existing roadway/bridge, (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (f) Seven acres of palustrine forested wetlands will be created by filling, grading and planting with appropriate vegetation to existing upland borrow-pit ponds. (g) Sides slopes of 2 to 1 will be employed throughout the impacted wetlands. (h) Any remaining unavoidable habitat value losses will be mitigated by the withdrawal of an appropriate amount of credit from the NCDOT Mitigation Bank, pursuant to the Memorandum of Understanding (MOU) signed by the NCDOT, the U. S. Fish and Wildlife Service, the N. C. Wildlife Resources Commission and the Nature Conservancy. (i) To help offset unavoidable fisheries habitat losses, suitable discarded bridge material will be placed by D.O.T. on approved reef sites in western Albemarle Sound. (2) Upon issuance of this permit, the NCDOT will immediately initiate coordination with the appropriate Federal and State review agencies to develop a detailed mitigation plan. This plan will include, at a minimum, a list of acceptable species for planting in restored and created wetlands, parameters necessary to establish those species, and a monitoring schedule to be followed for assessing the success of the mitigation features. (3) No construction in? the river, tributaries or wetlands will be conducted between the dates of March 15 and June 15 of any year to minimize impacts on anadromous fish spawning without prior approval of the Division of Coastal Management. (4) The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (5) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTUs or less are not considered significant. (6) The project must remain consistent with the N. C. Sedimentation Pollution Control Act throughout its duration. (7) All fill material must be contained by artificial barriers such as silt .fences until permanent stabilization is achieved. (8) All cut or fill slopes must be provided with a vegetative cover within 30 working days of placement. (9) All borrow pits must be operated in accordance with the Mining Act and/or with any memoranda or understanding between the Dept. of Transportation and the Division of Land Resources. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plans. HARRINGTON SECRETARY The North Carolina Department of Transportation proposes to replace the existing drawbridge and approach structures on US 13-17 over the Roanoke River at Williamston. A pair of medium-level, fixed span bridges along an alignment generally parallel and immediately adjacent to the existing bridge is proposed. The total project length is approximately 4950 feet, including 1154 feet of structure and 3796 feet of approaches of which approximately 2800 feet of embankment will be fill in wetland. The new structures-will provide four lanes of travel, a 45-foot vertical clearance, and a horizontal navigational clearance of at least 85 feet. On December 14, 1983, the Department of Transportation made application for a Section 404 permit and a CAMA permit to construct the project. This application was revised in February 1984. After a lengthy review and numerous discussions it was concluded that agreement could not be reached on the issuance of the permit for the work as proposed. In January 1985 we agreed with the Corps of Engineers' request to retire the application as extensive coordination remained to be accomplished before a mutually acceptable plan could be developed. There has been a great deal of coordination with the State and Federal environmental review agencies and we believe we now have a project which, with the mitigation we are proposing, will be acceptable and appropriate permits may be issued. Therefore, we are submitting a new application for a Section 404 and State Permits as required for the subject work. Application is being made, by copy of this letter, for those permits required from the North Carolina Department of Natural Resources and Community Development. Attached is a copy of the permit application and drawings depicting proposed work. Also attached is a copy of the hydrologic and hydraulic analysis for the proposed bridge. An Equal Opportunity /Affirmative Action Employer District Engineer Page 2 November 6, 1985 The proposed project will require the placement of fill in approximately 6.8 acres of wetland; of which, 2.7 acres have been previously disturbed by the construction of the existing bridge. In the absence of feasible alternatives which would completely avoid all the wetland areas, all practical measures to minimize harm to wetlands will be utilized. The measures to minimize harm to be employed on this project include the following: The "existing location replacement was selected to minimize harm to wetlands. Initial planning studies had all study alignments further removed from the existing US 13-17 highway. The recommended alignment was originally placed beyond the limits of the existing fender system of the existing bridge. In order to minimize wetland losses, the proposed alignment was shifted as close to the existing highway as possible. As proposed, it will be constructed within the fender system of the existing bridge, and have the least negative impact on the area's wetlands. In order to allow for wildlife movement through the wetland, NCDOT has incorporated a pair of wildlife underpasses in its plans. Based on studies conducted by the NCDOT Hydrographics Unit, only one pair of overflow structures is required for hydrological purposes. The proposed wildlife underpass structures which are being added to accommodate the passage of animals, will have 100 feet of opening and will be placed midway between the river bridges and the overflow structures. In order to offset unavoidable wetland losses on the subject project and future highway projects, a mitigation banking program has been instituted. This "banking" concept will provide mitigation for bottomland hardwoods lost as a result of highway and bridge construction projects. This program, as agreed to in a formal Memorandum of Understanding by the North Carolina Department of Transportation, North Carolina Wildlife Resources Commission, U. S. Fish and Wildlife Service and the North Carolina Nature Conservancy, offers a unique approach to satisfying mitigation requirements associated with the Fish and Wildlife Coordination Act and Clean Water Act. In an effort to achieve compensation for unavoidable bottomland hardwood losses, the program requires that fish and wildlife habitat be purchased in future highway projects. `? 41 ,, District Engineer Page 3 November 6, 1985 Establishment of such a bank requires extensive site selection studies, development of a management program, analysis of credits using a credible habitat-based methodology such as the Habitat Evaluation Procedure, and the establishment of guidelines for administration of the bank. Such methodologies have been worked out with the cooperating agencies mentioned earlier. Company Swamp, a 1436 acre tract of land which was in immediate danger of being timbered, was recently purchased by North Carolina for $836,300. Of this sum, NCDOT provided $500,000 toward the purchase and management cost. This will result in NCDOT gaining 1000 ownership of approximately 700 acres of selectively cut-over bottomland forest and approximately 44% interest in the remaining 736 acres which presently exists as a gum-cypress climax forest. The entire Company Swamp tract, which is adjacent to the Roanoke River Swamp, contains some of the finest alluvial bottomland forests in the Southeastern United States. This swamp complex is located in a portion of the Roanoke River floodplain that is frequently inundated. A diversity of geomorphic features including natural levees, relic channels, meander scars and black swamp deposits are present. Bottomland hardwoods containing gum and cypress, and the alluvial hardwood communities that are present, are valuable resources because they provide food, water, breeding territories and cover for waterfowl, forbearers, wading and shorebirds, songbirds, and numerous small mammals, amphibians and reptiles. When flooded, such areas may be used by anadromous species as a forage site. Since the subject project was instrumental in the development of the "banking" plan, credits will be withdrawn as part of the mitigation plan. - The length of the main river structures have been increased by 280 feet (all on north side). This additional length will span a natural levee to facilitate wildlife movement. In addition, an improved flow of water underneath the structure will result. - To further facilitate the flow of water, a collector (upstream) and distributor (downstream) ditch system will be provided to transfer water from one side of the embankment to the other side. This ditch system wi-11 have no outlet connection and will serve to collect flow coming to the area of the proposed embankment and redistribute it to the adjoining wetland along the entire ditch length. The ditches will parallel the roadway and will District Engineer Page 4 November 6, 1985 be constructed along and just outside the base of the embankment. These ditches will be interconnected by two ditch systems perpendicular to the roadway. One will pass underneath the overflow structures. The second will pass underneath the wildlife underpasses. This ditch system should maintain sheet flow as close to its original pattern as possible. Approximately 3 acres of wetland vegetation will be reestablished during project construction. This area is primarily underneath and along the west edge of the existing bridge. This previously disturbed area is one to two feet higher than the original elevation of the area. The area has been built up by the deposition of debris. This 3-acre area will be lowered to natural elevation, thereby enabling the regeneration of characteristic wetland species. Bottomland wetlands will be created in old borrow site areas at the edge of the wooded floodplain, a few miles north of the US 13-17 bridge. One 2.2 acre pond will be totally filled with remnants of the old bridge and a second pond, 7.1 acres in size, will be partially filled in the same manner. Both of these ponds will be "topped off" with mineral soils taken from the borrow site, and planted with appropriate hardwood species. Proper elevations for wetland species survival, fertilization, weed control, and berm removal between created and natural wetlands will be incorporated into project construction. A total of 7.0 acres of wetland will be re-established in this manner. Standard side slopes will be reduced from 6:1 to 2:1 through the wetland areas. Since the construction of the existing structures at this site, Roanoke River flow has been regulated by construction of the John H. Kerr Dam upstream. Substantially reduced peak flows indicate the feasibility of reducing bridge lengths downstream of Kerr Lake . pT:M01 nTMV . The USGS computer step backwater model E-431 was used for analysis and design. An attempt was made to calibrate the model using known stage and discharge values supplied by the Corps of Engineers. The flow across the entire flood plain was then "split up", apportioning flow to each existing bridge in the flood plain based an calculated conveyance values at each bridge. Having verified a reasonable conveyance and width of influence -1- of the main river bridge, the proposed bridges were inserted into the model. Due to the complexity of this analysis the three proposed bridges replacing the existing main channel bridge were combined and considered as one bridge for the purpose of computer analysis. RESULTS: Comparison of measured data'and computer analysis of existing structures for the entire flood plain are listed in Table 2 . Comparison of backwater elevations and average velocities for the proposed bridges and the existing main channel bridge are listed in Table 1. Table 1. See Table 2 CONCLUSIONS: Expected proposed backwater should be somewhat 'Less than values indicated by computer analysis because the contraction ratio is less than that shown in the computer model due to location and spacing of the overflow bridges. -2- It should also be noted that a proposed main channel bridge length of 610 feet was used in the computer analysis. During subsequent design changes this length was increased to 890 feet, which increased the waterway area of the bridge by 1,340 square feet. This change was not reflected in the computer analysis, but would further reduce proposed backwater pd average velocities. Proposed Design: 1. Project summary The project involves the replacement of the bridge across the Roanoke River at Williamston with dual fixed span bridges. Environmental setting At the Bertie-Martin County line near Williamston, U.S. 13 and U.S. 17 cross the Roanoke River. On the Martin County side of the river the area is developed with various types of businesses. On the Bertie County side, the shoreline is an undeveloped vast wooded swamp area. The area is vegetated with bald cypress, tupelo gush, black gum, red maple and various other wetland types. At the crossing, there is a low level swing span drawbridge which was constructed in 1948. The structure has a total length of 2,770' which includes 200' of drawbridge and 2,570' of approach spans. The bridge in closed position provides a 16' vertical clearance over the Roanoke River. The horizontal navigational clearance is 83'. Project proposal The applicant is proposing to replace the existing drawbridge and approach structures with a pair of medium-level, fixed span bridges along an alignment generally parallel and immediately adjacent to the existing bridge. The total project length will be 4,950', including 1,154' of structure and 3,796' of approaches, of which approximately 2,800' of enbankment will be in wetlands. The new structure will provide four lanes of travel, a 45' vertical clearance, and a horizontal navigational clearance of 85. The N.C. Departnent of Transportation applied for a similar project in 1983, however, due to concerns from various agencies about the loss of wetlands, the project was temporarily placed on hold until the suhcnittal of the present application. The N.C. DOT has tried to address the wetland losses more adequately in the present application. The attached narrative from the N.C. DOT further addresses the project proposal. Environmental impact The project as proposed will involve the placement of fill materials within 6.8 acres of wetlands, of which 2.7 acres have been previously disturbed by construction of the existing highway and bridge. To help mitigate for the loss of the wetlands, the applicant is proposing wildlife movement underpasses, mitigation banking, the re-establishment of 3 acres of wetlands during project construction, and the creation of wetlands at two borrow sites.
