authorizing development in Paml i co County at the North Prong, Bay River, SR 1002,
near Bayboro as requested in the permittee's application dated 6/11 /86 including
attached plats, sheets 1-4 of 4 dated 5/86.
This permit, issued on fZ'_ VA` , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without the
prior approval of the Division of Coastal Management.
(2) No excavated or fill material will be placed at any time in any marsh or
surrounding waters 'outside of the alignment of the fill area indicated on
the plat.
(3) This project must remain consistent with' the N. C. Sedimentation Pollution
,}., Control Act at all times.
4) The proposed bridge will be constructed at or above the existing height above
the normal water level elevation of the North Prong Bay River.
NOTE: The permittee and/or his contractor is urged to meet with representatives
of the Div. of Coastal Management prior to undertaking any work authorized
by this permit.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the projectjs,inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to N.C. Department of
Transportation pursuant to an application filed on the 23rd day-of June,
1986 to replace the existing bridge of SR1002 over North Prong Bay
River.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of North Prong
Bay River in conjunction with the proposed bridge replacement in Pamlico
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That the fill material be clean material from an
upland source and free of any toxic material.-
3. That appropriate sedimentation and erosion control
measures shall be utilized to minimize siltation
and turbidity impacts.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Narrative description
The project site is north-of Bayboro on SR1002 where it crosses the
north prong of Bay River near the Town-of Bayboro ?n Pamlico County.
The project site is an existing causeway and bridge road system con-
structed prior to permit requirements. The causeway spans a 200' wide
marsh fringe that borders this prong of Bay River and a wooden bridge
structure spans the 80' distance across the creek body. The adja-
cent-marsh is composed primarily of black needlerush sometimes being
mixed with other indigenous species.
The applicants are proposing to replace the eixsting wood structure
with ,a concrete bridge. The approachs are proposed to be widened into
the adjacent waters and marsh-an average of 6' on each side.
10: Anticipated Impacts
This project will involve the disturbance and disruption of boat
traffic normally associated with bridge replacement activities.
The project, however, is in a location where the disruption is not.
expected to be significant. The filling of 3,000 sq.ft. of irregu-
larly flooded marsh and 300 sq.ft. of estuarine water could have
some significant to the estuarine resources of.the area. The adja-
cent waters are classified as SC by DEM and are currently closed to
the taking of shellfish by the Div. of Health Services.
