THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to N.C. Department of
Transportation pursuant to an application filed on the 29th day of May,
1986 to place fill in Pinch Gut Creek associated with the US 17 Bypass.
The Application provides adequate assurance that the discharge of ..
fill material into a wetlands area adjacent to the waters of Pinch Gut
Creek in conjunction with the proposed roadway construction in Brunswick
County will not result in a violation of applicable Water Quality
Standards and discharge guidelines. Therefore, the State of North
Carolina certifies that this activity will not violate Sections 301,
302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance
with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 50 NTU's or less
are not considered significant).
2. That prior to any earthen movement in an area
adjacent to any of the eleven wetland areas to
be filled, erosion control measures should be
in place.
3. That fill material should be from a clean upland
source and free from any toxic materials.
4. That the side slopes of all of the filled areas be
stabilized with vegetation to minimize erosion and
sedimentation.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

The applicant proposes to place fill across 24.4 acres of land to
build U.S. 17 bypass around Bolivia. The construction will include
the filling of 11 individual wetland areas. The wetlands occur
adjacent to Lockwoods Folly River, Pinch Gut Creek, and Grove Creek,
all classified C swamp.
The project has been reviewed to determine impacts to water quality.
The following comments are offered:
1. The project will require a 401 certification for the filling of
the wetlands. The certification should contain the following
conditions:
a. Prior to any earthen movement in an area adjacent to any of
the eleven wetland areas to be filled, erosion control
measures, i.e. containment dikes and silt fences, should be
in place.
b. That all the fill material be from a clean upland source
free from any toxic material.
c. That the turbidity in any of the creeks not exceed 50 N.T.U.
due to the project.
d. That the side slopes of all of the filled areas be
stabilized with vegetation to prevent erosion.
This office has no objections to the project provided the above
conditions are met.

NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, Post
Office Box 25201, Raleigh, North Carolina 27611, has applied for renewed and
modified Department of the Army authorization TO PLACE FILL MATERIAL IN
WETLANDS ADJACENT TO PINCH GUT CREEK, GROVE SWAMP AND THE LOCKWOODS FOLLY
RIVER ASSOCIATED WITH THE CONSTRUCTION OF U.S. HIGHWAY 17 BYPASS NORTH OF
BOLIVIA in Brunswick County, North Carolina.
Formal planning for this project began in 1975. Federal, State, and local
agencies--including the Corps of Engineers, the U.S. Fish and Wildlife
Service, the U.S. Protection Agency, the National Marine Fisheries Service,
the North Carolina Wildlife Resources Commission, the North Carolina
Department of Cultural Resources, and others--provided input for an
environmental assessment that was prepared by the North Carolina Department of
Transportation and the Federal Highway Administration. In 1979, after a
thorough public interest review, the North Carolina Department of
Transportation was provided Department of the Army authorization, permit No.
SAWC079-N-010-0257, for the placement of fill materials in wetlands of Pinch
Gut Creek. This earlier permit included design changes as recommended by the
U.S. Fish and Wildlife Service and the U.S. Environmental Protection Agency to
maintain surface flow through wetlands. This authorization expired in
December 1983. This latest application provides for renewal of the expired
permit, including the recommended designs, and authorization to work in other
areas, headwaters, which have come under the Corps of Engineers regulatory
jurisdiction since issuance of the original permit.
The following description of the proposed work is taken from data provided
by the applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show the placement of fill material in wetlands at 11 individual
locations between where the new four-lane U.S. Highway 17 is to leave the old
alignment northeast of Bolivia and where it is to rejoin the old alignment
northeast of Supply. Approximately 98,000 cubic yards of fill material,
obtained from upland sites, is to be placed in a total of 24.4 acres to
facilitate construction of the four-lane bypass. Containment dikes and silt
fences are to be used to control erosion and sedimentation. Specific
construction dimensions are shown by the plans included with this public
notice. The right-of-way for the new highway has been obtained. The purpose
of the work is to provide for safer, improved surface transportation.

The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed.
On July 27, 1979, the North Carolina Department of Natural Resources and
Community Development, Division of Environmental Management, provided Water
Quality Certification No. 1342 for the placement of fill materials in wetlands
of Pinch Gut Creek. A renewed Department of the Army permit will not be
issued until the North Carolina Division of Environmental Management has
determined the applicability of a Water Quality Certificate as required by PL
92-500 for the modified proposal.
This application is being considered pursuant to Section 404(b) of the
Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within
the comment period specified_in the notice,-that a public hearing-be held to-
consider thin appl i Kati on _ Requests for pubile-firearm- _, , state, _, .,_
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
__ - -
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general

environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street; Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished'
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
July 22, 1986.

Water Act certification should do so in writing delivered to the North

PUBLIC NOTICE
NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, Post
Office Box 25201, Raleigh, North Carolina 27611, has applied for renewed and
modified Department of the Army authorization TO PLACE FILL MATERIAL IN
WETLANDS ADJACENT TO PINCH GUT CREEK, GROVE SWAMP AND THE LOCKWOODS FOLLY
RIVER ASSOCIATED WITH THE CONSTRUCTION OF U.S. HIGHWAY 17 BYPASS NORTH OF
BOLIVIA in Brunswick County, North Carolina.
Formal planning for this project began in 1975. Federal, State, and local
agencies--including the Corps of Engineers, the U.S. Fish and Wildlife
Service, the U.S. Protection Agency, the National-Marine Fisheries Service,
the North Carolina Wildlife Resources Commission, the North Carolina
Department of Cultural Resources, and others--provided input for an
environmental assessment that was prepared by the North Carolina Department of
Transportation and the Federal Highway Administration. In 1979, after a
thorough public interest review, the North Carolina Department of
Transportation was provided Department of the Army authorization, permit No.
SAWC079-N-010-0257, for the placement of fill materials in wetlands of Pinch
Gut Creek. This earlier permit included design changes as recommended by the
U.S. Fish and Wildlife Service and the U.S. Environmental Protection Agency to
maintain surface flow through wetlands. This authorization expired in
December 1983. This latest application provides for renewal of the expired
permit, including the recommended designs, and authorization to work in other
areas, headwaters, which have come under the Corps of Engineers regulatory
jurisdiction since issuance of the original permit.
The following description of the proposed work is taken from data provided
by the applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show the placement of fill material in wetlands at 11 individual
locations between where the new four-lane U.S. Highway 17 is to leave the old
alignment northeast of Bolivia and where it is to rejoin the old alignment
northeast of Supply. Approximately 98,000 cubic yards of fill material,.
obtained from upland sites, is to be placed in a total of 24.4 acres to
facilitate construction of the four-lane bypass. Containment dikes and silt
fences are to be used to control erosion and sedimentation. Specific
construction dimensions are shown by the plans included with this public
notice. The right-of-way for the new highway has been obtained. The purpose
of the work is to provide for safer, improved surface transportation.

The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed.
On July 27, 1979, the North Carolina Department of Natural Resources and
Community Development, Division of Environmental Management, provided Water
Quality Certification No. 1342 for the placement of fill materials in wetlands
of Pinch Gut Creek. A renewed Department of the Army permit will not be
issued until the North Carolina Division of Environmental Management has
determined the applicability of a Water Quality Certificate as required by PL
92-500 for the modified proposal.

This application is being cons idered_pursuant_to Section 40..4(b)of_-the-
Clean Water Act (33 U S C 1344)- Any narann mg> re^uect iu Writing within
the comment period specified in the notice, that a public hearing be held to
consider this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general

environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of
property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies- 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished.
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
July 22, 1986.

Water Act certification should do so in writing delivered to the North

Enclosed is the application of the North Carolina Department
of Transportation, Division of Highways, for a Department of the
Army permit and a State Water Quality Certification to place fill
materials in wetlands of Pinch Gut Creek, Grove Swamp and the
Lockwoods Folly River associated with the construction of the
U.S. Highway 17 Bypass of Bolivia in Brunswick County, North
Carolina. Your receipt of this letter verifies your acceptance of
a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a renewed, modified water quality certification
may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by August 4, 1986, the District Engineer
will deem that waiver has occurred.

The North Carolina Department of Transportation proposes to construct
the subject highway as a four-lane divided facility. The Final
Environmental Statement was approved in 1977 and the right-of-way
has been acquired.
Planning for the project began in 1973. Federal, State and Local
Agencies (including, among others: U. S. Army Corps of Engineers,
U. S. Fish and Wildlife Service, Environmental Protection Agency,
National Marine Fisheries Service, N. C. Wildlife Resources
Commission, and N. C. Department of Cultural Resources.) were requested
to provide information for the draft environmental report. Their
input was included in the draft report which was circulated to each
of the agencies for review and comment. Following circulation of
the draft report, a public hearing was held. Comments voiced at the
hearing and those received on the draft report were considered in
the preparation of the final environmental report. The agencies
involved in the planning process were provided a copy of the final
environmental document.
In 1979 we received a Department of the ArmN- permit (SAWC079-N-010-00027)
for the crossing of Pinch Gut Creek. Before obtaining that permit we
made design changes at the creek at the request of the U. S. Fish and
Wildlife Service and the Environmental Protection Agency to improve
the distribution of floodflows through.the wetland. The permit, which
was extended once, expired December 31, 1983. Because of the changes

in Corps of Engineer regulations it is our understanding that permits
are now required at several locations along the project.
Application is hereby made for a Department of the Army permit as
required for the subject work. The permit application and drawings
depicting the proposed work are attached. The application is based
on twelve sites which will require filling a total of 24.4 acres of
wetland.
Application is being made, by copy of this letter, for a Section 401
Water Quality Certification from the Division of Environmental
Management, N. C. Department of Natural Resources and Community
Development. Water Quality Certification No. 1342 was issued
July 27, 1979, for the Pinch Gut Creek Crossing.
In addition, by copy of this letter, we are requesting the Division
of Coastal Management, NRCD, to review each of the sites and make a
determination as to whether or not a CAMA permit is required.
Application is hereby made if a CAMA permit is required for one or
more of the sites. CAMA permit 122-79 was issued September 25, 1979,
for Pinch Gut Creek; however, that permit has expired.

The North Carolina Department of Transportation proposes to construct
the subject highway as a four-.lane divided facility. The Final
Environmental Statement was approved in 1977 .and the, right-of-way
has been acquired.
Planning for the project began in 1975. Federal, State and Local
Agencies (including, among others: U. S. Army Corps of Engineers,
U. S. Fish and Wildlife Service, Environmental Protection Agency,
National Marine Fisheries- Service, N. C. Wildlife Resources
Commission, and N. C. Department of Cultural Resources.) were requested
to provide information for the draft environmental report. Their
input was included 'n the draft report which was circulated to each
of the agencies for review and comment. Following circulation of
the draft report, a public hearing was held. Comments voiced at the
hearing and those received on the draft report were considered in
the preparation of the final environmental report. The agencies
involved in the planning process were provided a copy of the final
environmental document.
In 1979 we received a Department of th.e Army permit (SAWC079-N-010-000257)
for the crossing of Pinch Gut Creek. Before obtaining that permit we
made design changes at the creek at the request of the U. S. Fish and
Wildlife Service and the Environmental Protection Agency to improve
the distribution of floodflows through--the wetland. The permit, which
was extended once, expired December 31, 19.83. Because of the changes

in Corps of Engineer regulations it is our understanding that permits
are.now required at several locations along the project.
Application is hereby made for a Department of the Army permit as
required for the subject work.. The permit application and drawings
depicting the proposed work are attached. The application is based
on twelve sites which will require filling a total of 24.4 acres of
wetland.
Application is being made, by copy of this letter, for a Section 401
Water Quality Certification from the Division of Environmental
Management, N. C. Department of Natural Resources and Community
Development. Water Quality Certification No. 1342 was issued
July 27, 1979, for the Pinch Gut Creek Crossing.
In addition, by copy of this letter, we are requesting the Division
of Coastal Management, NRCD, to review each of the sites and make a
determination as to whether or not a CAMA permit is required.
Application is hereby made if a CAMA permit is required for one or
more of the sites. CAMA permit 122-79 was issued September 25, 1979,
for Pinch Gut Creek; however, that permit has expired.
