Department of Transportation of filed an application on December 16, 1986 or a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a 'discharge of fill material. in project wetlands will not violate applicable water quality standards. All persons desiring to make comments should do so in writing to Mr. David Owens, Director, Division of Coastal Management, PO-Box 27687, Raleigh, N. C. 27611 prior to January 12, 1987 for consideration in.the CAMA permit decision, and to Mr. Bill Mills, Division of Envron- mental Management, PO Box 27687, Raleigh, N. This permit, issued on YAA , is subject to compliance with the application (where consistent with the permit), all appli, able regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit-to be null and void. (1) No fill material will be placed at any time in any marsh outside of the fill. area indicated on the plat. (2) All fill material will be obtained from an upland source. (3) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (4) The disturbed areas will be properly graded and provided a ground cover suffi- cient to restrain erosion within thirty (30) days of project completion. (5) Mechanical devices -or structures must be utilized to prevent sediment from entering adjacent wetlands or properties. (6) This project must adhere to the rules and regulations set forth by the Sedimen- tation Pollution Control Act at all times. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. . Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Dare County CERTIFICATION THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of Environmental Management Regulations in 15 NCAC 2H, Section .0500 to N.C. Dept. of Transportation pursuant to an application filed on the 14th day of November, 1986 to grade and pave a section of SR1210 near Kitty Hawk. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of tributaries of Currituck Sound in conjunction with the proposed road work in Dare County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition (s) of Certification: 1. Project summary The Department of Transportation proposes to grade and pave S.R. 1210 adjacent to the Currituck Sound in Kitty Hawk, N.C. N.C. DEPARTMENT OF TRANSPORTATION - S.R. 1210 BIO REPORT PAGE 2 SITE DESCRIPTION: The Department of Transportation proposes to grade and pave S.R. 1210 adjacent to Currituck Sound in Kitty Hawk. This existing dirt road winds towards the "Barge Landing" in Kitty Hawk and is surrounded by residential property and gum and maple swamp. The paving is currently being accomplished within the right of way and on highground, however, the shoulder improvements will encroach upon the adjacent wetlands. The Department of Transportation proposes to improve the shoulder of S.R. 1210 which will result in the placement of fill material in the maple and gum swamp. This fill will also be within 75 feet of the estuarine waters, however, no fill is proposed to be placed below the normal water level. ANTICIPATED IMPACTS: The proposed shoulder improvements will result in the filling of approximately 4,000 square feet of gum and maple "404" wetlands. Also filled will be two small coastal wetland areas which support 100 square feet of cat tails and 75 square feet of sawgrass. The improved surface will be constructed to divert the runoff into drainage ditches which will flow into the adjacent wetlands. CAMA REVIEW: The project site is classified as transition in the Kitty Hawk Land Use Plan. The proposal is consistent with that plan. Submitted by: George H.
