This permit, issued on /UV , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The material to be placed below the mean high water contour must be stabilized by use of a physical barrier (i.e., filter cloth, retaining wall, etc.) in order to prevent unnecessary siltation from entering the primary nursery area. (2) All existing channels must be left undisturbed so as to not block existing navigation use. (3) Finished height of the new bridge must maintain or exceed the existing vertical and horizontal clearances in the navigation channels. (4) All debris associated with demolition of the existing bridge must be removed concurrent with completion of the project. (5) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. (See attached sheet for Additional Conditions) I This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. D.O.T. - Bradley Creek Bridge #14 New Hanover County The applicant proposes to replace an existing bridge on the same alignment. The project calls for the filling of approximately 200 square feet of intertidal area. The new structure will have a smaller foot print than the original bridge; therefore the stormwater runoff should be reduced. The bridge spans Bradley Creek which is currently classified SA, closed to shellfishing. However, a hearing has been scheduled for November 17, 1986, to consider reclassifying Bradley Creek to Class SC. The project has been reviewed using SA criteria. The project has been reviewed to determine impacts to water quality. The following comment is offered: That a 401 Certification is required but should meet the requirements of the General 401 Certification #1734, for Bridge Modifications. PROJECT DESCRIPTION: The project site is the location of the existing U.S. 76 crossing of Bradley Creek. The bridge consists of two doublelane wood piling supported bridges which touch at the inside medians. The appearance is that of a single four lane structure. Advanced age and general deterioration of the structure has resulted in the.need for replacement. There are two navigation channels under the bridge. One at the north and .one at the south. The creek above the bridge is classified as a primary nursery area. Final action is pending on the water classification of the creek. The waters have been labeled both SC and SA in the recent past. The applicants propose to replace the bridge in the existing location through a staged procedure. The new bridge would be approximately 860' in length and approximately 60' in total width. (The travelway will be 48' wide with four 12' lanes. A 4' median and a 4' shoulder on each side will be provided.) The total project length will be approximately 1,300'. In order to complete the bridge approaches it will be necessary to fill an intertidal area of approxi- mately 40' x 5'. A total of four cubic yards of material will be used. 10. ANTICIPATED IMPACTS: The applicants have indicated that existing navigation heights under the bridge will be maintained. It will also be necessary to provide the same width spans at the navigation channels. If the remainder of the project is completed as proposed there will be no adverse impacts on coastal resources. States. Waterway and Location: Bradley Creek, mile 1.0 on US 76, near Wilmington, North Carolina. Character of Work: To construct a new four-lane fixed highway bridge that will replace the existing four lane fixed highway bridge. Minimum Navigation Clearances: Existing Horizontal: 19' between piers askew to the axis of the channel Proposed Horizontal: 431-6" between piers askew to the axis of the channel Vertical: 8' at mean high water, 11' at mean low water Environmental Considerations: Vertical: 8' at mean high water; 12' at mean low water The Federal Highway Administration, lead Federal agency for this project, approved a Categorical Exclusion on January 6, 1986. The Coast Guard has determined that the proposed project meets the criteria for a Categorical Exclusion.for purposes of the National Environmental Policy Act (NEPA) because it satisfies the criteria for such actions listed in the Coast Guard's NEPA implementing instructions. The bridge is located in the floodplain. The proposed project will have no significant impact on the human environment and the project will not,have any impact on public parks, recreational areas, wildlife and waterfowl refuges, historic sites or archeological sites since none are located in the right-of-way or vicinity of the bridge or its approaches. No families or 4 businesses will be displaced by the proposed project. It is anticipated that only 0.005 acres of wetlands will be effected by fill material. The only mitigation measures that will be required of the contractor will be the use of berms, silt fences and other control measures as outlined in the state approved Erosion and Sedimentation Control Program. The Office of Coastal Management has advised the applicant that a Coastal Zone Management consistency statement is not required in that the state's position on consistency is included as part of the CAMA Permit, 227-86 issued on December 5, 1986. The applicant has obtained a Water Quality Certification No. 1734 issued August 28, 1984. Solicitation of Comments: Interested parties are requested to express their views, in writing, on the proposed bridge project giving sufficient detail to establish a clear understanding of their reasons for support of or opposition to the proposed work.
