Hanson, informed the U.S. Fish and Wildlife Service and the Environmental Protection Agency (EPA) on July 2, 1986, of his intent to issue a Section 404 permit to the North Carolina Department of Transportation for filling of wetlands adjacent to Friars Swamp near Bolton, Columbus County, North Carolina (SAW0086-N-024- 0009). The purpose of the proposed fill activity is to relocate U.S. Highway 94-76. The Regional Director of the Service has informed me of his intent to elevate this decision in accordance with the Memorandum of Agreement between the Departments of Army and Interior. I am writing to inform you that I support the Service's position in this matter. In our letter dated November 26, 1985, we expressed concern over the loss of approximately 14 acres of pocosin wetlands which would be eliminated through clearing, excavating and filling for the highway relocation. In that letter we reccmmended that the permit application be denied unless the applicant agreed to mitigate unavoidable wetland losses through 1:1 replacement mitigation. The Service has since informed us that the overall highway project would result in filling approximately 66 acres of forested wetlands and hydrologically isolating an additional 10 acres. It is our opinion that all wetland impacts of the proposed highway construction should have been provided in one public notice so that the cumulative impacts of all wetland losses could have been evaluated. Also, it is my understanding that the Corps has concluded that if a project Jo in the public interest, environmental impacts are considered acceptable and no replacement mitigation is required. We do not agree with this decision. This new position on mitigation will lead to serious environmental consequences. . Ab v f. -2- I request a copy of your record of decision on this project and recommend that you-reconsider the decision to issue an individual permit for only a portion of the wetland losses and that you require replacement mitigation for unavoidable wetland losses. D.O.T. - Friar Swamp Columbus County The applicant proposes to fill two areas of wetland in conjunction with the relocation and widening of U.S. 74/76, The Bolton Bypass. The waters of Friar Swamp are classified as C swamp. This project has been reviewed to determine impacts to water quality. The following comments are offered: 1. The project will require a 401 certification for the filling of the wetlands. The certification should contain the following conditions: a. That silt fences and other erosion controls be in place prior to any earthen movement in the area of the wetlands. b. That all the fill material be from a clean upland source, free from any toxic material. c. That the turbidity in the water not exceed 50 N.T.U. due to the project. d. That the side slope of the filled area be stabilized with vegetation as soon as possible to prevent erosion. DHC:kc cc: WiRO CF DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 SAWC086-N-024-0364 PUBLIC NOTICE June 19, 1986 THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION, DIVISION OF HIGHWAYS, Post Office Box 25201, Raleigh, North Carolina 27611, has applied for a Department of the Army permit TO PLACE FILL MATERIALS IN HEADWATER WETLANDS ADJACENT TO FRIAR SWAMP ASSOCIATED WITH RELOCATION AND WIDENING OF U.S. HIGHWAY 74/76, THE-BOLTON BYPASS, Columbus County, North Carolina. This specific work was previously authorized by nationwide authority, 33 CFR 330.4(a)(1), which provided for the discharge of fill material in non- tidal rivers, streams and their lakes and impoundments, including adjacent wetlands, that are located above headwaters, the point on a non-tidal stream above which the average annual flow is less than five cubic feet per second. Before the actual work could begin, this nationwide permit became invalid as a result, of the North Carolina Department of Natural Resources and Community Development, Division of Environmental Management's decision to withhold general water quality certification. The North Carolina Department of Transportation has obtained all right-of-way properties and design has been completed. This proposal, the bypass of Bolton, involves the third, and most eastern, relocation of U.S. Highway 74/76. The first relocation, which is completed, involved the bypass of Whiteville and Lake Waccamaw, and the second relocation, for which Federal authorization is pending, No. SAWC086-N-024- 0009, involves the crossing of Friar's Swamp. This final relocation is to connect to the east with the existing four-lane roadway that extends to Wilmington. This proposal, prior to recent modifications, was previously announced by public notices on October 24, 1985, and February 13, 1986. The following description of the work is taken from data provided by the applicant and from observations made during several onsite visits by representatives of the Corps of Engineers and other State and Federal agencies. Plans submitted with the application show the placement of fill materials in two pocosin wetland areas located approximately 0.2 miles (site No. 1) and 0.6 miles (site No. 2) east of where the relocated roadway is to cross S.R. 1800. There are approximately 2 acres of wetlands at site No. 1 and approximately 14 acres of wetlands at site No. 2. Since the two previously mentioned public notices, further more detailed right-of-way investigation has disclosed two other pocosin wetland areas. Approximately 0.5 mile west of where the relocated highway is to cross N.C. Highway 211 is an area of about 9 acres (area A) and about 0.7 mile west of where the relocation is to cross S.R. 1800 is an area slightly greater than 1 acre (area B). Also, within the proposed roadway fill between the crossings of N.C. Highway 211 and S.R. 1800 are numerous pockets of isolated relic -2- wetlands, but this entire area has been historically and significantly disturbed by logging operations and ditching which have altered hydraulic and vegetative characteristics to the point that criteria for the Corps of Engineers regulatory jurisdiction is not satisfied. Planning for this project began in 1970, and State and Federal agencies have participated in various environmental investigations. Designs have been altered to lessen impacts on wetlands. The purpose of the work is to complete the relocation and widening of U.S. Highway 74/76 to bypass Whiteville, Lake Wacammaw, and Bolton providing for improved, safer roadway transportation. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed. On April 10, 1986, the North Carolina Division of Environmental Management issued Water Quality Certificate No. 1904 as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the -3- general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. You asked that we provide details concerning any changes in the proposed work. In 1983 the permit, which was issued in 1980, was extended through 1984. At that time the project was reviewed and certain changes were made from what was contained in the original permit. Those changes were discussed in letters dated May 13 and July 12, 1983 (attached). We have reviewed the design and have determined that there have been no changes made to the plans within the area of Friar Swamp from those discussed in the 1983 letters. There are two areas east of Friar Swamp that because of the October 5, 1984, changes in the Corps regulations may now require a permit. Attached is a separate application for the fill of approximately sixteen acres of wetlands in the vicinity of Bolton. Previously this fill was considered permitted by a nationwide permit in that it involves wetlands above headwaters. The application is provided for your consideration and application is hereby made for a Section 404 permit for these two additional sites, if required. Box 1890 Wilmington, North Carolina 28402 ATTENTION: Mr. Ken Jolly Regulatory Functions Branch Dear Sir: SUBJECT: SAWC079-N-024-0364 (Permit No. 79-213-267) Proposed Construction of Relocation of US 74-76 Between Whiteville and Wilmington— Placing Fill Material in Wetlands Bordering Friar Swamp--Columbus County (R-61B) Reference is made to your March 22, 1983 letter concerning general mitigation measures for Site "B" on the proposed project. Our comments below follow each of the suggested mitigation measures in your letter. a. Causeway side slopes will be restricted to a 2:1 grade through ali wetland areas-- We request that the 2:1 slope be revised to allow the use of 3:1 slopes through the wetland areas. This will allow us to construct the embankment without requiring guardrail. The difference in total width required for this is about 6 foot each side (12 foot total). The use of 3:1 slopes is more economical than using 2:1 slopes with guardrail. Using guardrail limits the aesthetic beauty of the natural environment as seen by the traveling public. It is noted the wetland involvement is considerably less than in the original permit (see item c). b. Natural areas within the right-of-way will be maintained (wetlands outside the fill limits will not be cleared and grubbed)-- We request this be revised to allow some work room outside the fill limits. This project is designed District Engineer Page 2 May 13, 1983 to allow a 40' clear recovery area outside the pavement edge. This allows the contractor some work room outside of the toe of fill and also maintains a 40' clear area for errant vehicles to recover without hitting a fixed object. C. Median and shoulder widths will be restricted to the minimum width possible through all wetland areas-- The median width has been decreased from 88 ft. to 46 ft. through the wetlands (this is the normal minimum for a divided freeway). Shoulders have been retained as standard for this type project. d. Abandoned roadways in wetlands will be removed, restoring all original wetland contours-- No roadways are in the wetlands to be abandoned but we will include provisions to obliterate and restore all roads within the right-of-way to the original contours matching the adjacent land. e. Disposal of all unsuitable excavated materials will be restricted to high ground-- All material excavated on the project through the wetlands will be disposed of on high ground out of the wetlands. f. Culverts will be constructed where necessary through wetland fills to facilitate sheet flow-- The existing road across Friar Swamp has three bridges on it somewhat limiting the sheet flow. We have planned to match or exceed the waterway area now available for sheet flow by constructing bridges compatible to the existing structures. The addition of culverts along the proposed facility without outlets through the existing roadway does not seem advantageous for any reason. (Site "A" has not been changed but remains as was approved in the permit.) It is requested that the permit, which is scheduled to expire June 30, 1983, be extended until December 31, 1984, based on the revised cross section and the mitigation measures as discussed above. At Site A the fill slopes through the from 6:1 to 3:1 to reduce the wetland has been revised to 1 @ 6' x 6' based data. Using a design flood frequency charge would be 175 cubic feet per se with a single 6' x 6' box culvert. wetland area have been reduced loss. Also, the box culvert on the latest hydrolic design of 50 years the design dis- cond. This can be accomodated At Site B (Friar Swamp) the fill slopes have been reduced to 3:1 and also the median width has been reduced to 46 feet. The 85 foot dimension between the undercut of the new roadway and the centerline of the old roadway has been increased to 96 feet due to the reduction of the median width. Any further efforts to reduce the area of the isolated wetlands between the two roadways would require a redesign of the roadway and six bridges which would cause the project to be delayed for several months. S. HIGHWAY 74-76 near Bolton, Columbus County, North Carolina. The proposed work was described in detail by public notice dated 24 October 1985. The public notice inadvertently stated that the wetlands were of the "wooded swamp" type, while in fact they are of the "pocosin" type wetlands. The whole U. S. 74-76 relocation project is divided into three sections. One section bypasses Whiteville and Lake Waccamaw. This section has been completed and was to open to the public in December 1985. The second section crosses Friar's Swamp, and the third section bypasses Bolton. The third section is the one addressed by the public notice. The second section was originally permitted by the Charleston District Corps of Engineers on 24 April 1980 under the number 79-26-267. S. HIGHWAY 74-76 near Bolton, Columbus County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show a permit was issued in 1980 for the majority of wetland work along the 74-76 relocation. With the change in Corps of Engineers regulations on October 5, 1984, concerning the Corps jurisdiction and regulatory authority, the applicant realized that the two areas being considered by this application would require a valid Corps of Engineers permit.prior to the placement of any fill material. The proposed fill area consists of two sites. Site No. I is located east of S. R. 1800 and involves the clearing, excavating, and subsequent filling of about 2 acres of wooded swamy Site No. 2 is approximately 0.5 mile east of site No. 1 and calls for the clearing, ,{? S k.excavating, and filling of about 14 acres of wooded swamp. 0C The total length of the proposed wetland fill is about 3,000 feet; and at ?1??y P the widest point, it is about 240 feet wide. Plans showing the work are Ot? lip' included with this public notice. , The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department-of the Army permit will be issued until the coordinated State -viewpoint on the proposal has been received and reviewed by this agency, nor will a Department. of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. OCT 28 1985 PERMITS & ENGINEERING -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is "otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and'any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM), issues, denies or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. -3- Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after December 9, 1985. Box 1890 Wilmington, North Carolina 28402 ATTENTION: Mr. Ken Jolly Regulatory Functions Branch Dear Sir: SUBJECT: SAWC079-N-024-0364 (Permit No. 79-2G-267) Proposed Construction of Relocation of US 74-76 Between Whiteville and Wilmington— Placing Fill Material in Wetlands Bordering Friar Swamp--Columbus County (R-61B) Reference is made to your March 22, 1983 letter concerning general mitigation measures for Site "B" on the proposed project. Our comments below follow each of the suggested mitigation measures in your letter. - a. Causeway side slopes will be restricted to a 2:1 grade through all wetland areas-- We-request that the 2:1 slope be revised to allow the use of 3:1 slopes through the wetland areas. This will allow us to construct the embankment without requiring guardrail. The difference in total width required for this is about 6 foot each side (12 foot total). The use of 3:1 slopes is more economical than using 2:1 slopes with guardrail. Using guardrail limits the aesthetic beauty of the natural environment as seen by the traveling public. It is noted the wetland involvement is considerably less than in the original permit (see item c). b. Natural areas within the right-of-way will be maintained (wetlands outside the fill limits will not be cleared and grubbed)-- We request this be revised to allow some work room outside the fill limits. This project is designed District Engineer Page 2 May 13, 1983 to allow a 40' clear recovery area outside the pavement edge. This allows the contractor some work room outside of the toe of fill and also maintains a 40' clear area for errant vehicles to recover without hitting a fixed object. C. Median and shoulder widths will be restricted to the minimum width possible through all wetland areas-- The median width has been decreased from 88 ft. to 46 ft. through the wetlands (this is the normal minimum for a divided freeway). Shoulders have been retained as standard for this type project. ' d. Abandoned roadways in wetlands will be removed, restoring all original wetland contours-- No roadways are in the wetlands to be abandoned but we will include provisions to obliterate and restore all roads within the right-of-way to the original contours matc4ing the adjacent land. e. Disposal of all unsuitable excavated materials will be restricted to high ground-- All material excavated on the project-through the wetlands will be disposed of on high ground out of the wetlands. f. Culverts will be constructed where necessary through wetland fills to facilitate sheet flow-- The existing road across Friar Swamp has three bridges on it somewhat limiting the sheet flow. We have planned to match or exceed the waterway area now available for sheet flow by constructinZ bridges compatible to the existing structures. The addition of culverts along the proposed facility without outlets through the existing roadway does not seem advantageous for any reason. District Engineer Page 3 May 13, 1983 Attached is a revised typical section that we propose to construct across the Friar Swamp wetlands. (Site "A" has not been changed but remains as was approved in the permit.) P 2) V ?41 57 SUBJECT: SAWC079-N-024-0364 (Permit No. 79-2G-267) Proposed Construction of Relocation of US 74-76 Between Whiteville and Wilmington— Placing Fill Material in Wetlands Bordering Friar Swamp--Columbus County (R-61B) Following up on our telephone conversation regarding the subject permit, I am forwarding revised sheet 2 of 8 for Site A.and revised sheet 8 of 8 for Site B. At Site A the fill slopes through the from 6:1 to 3:1 to reduce the wetland has been revised to 1 0 6' x 6' based data. Using a design flood frequency charge would be 17S cubic feet per sei with a single 6' x 6' box culvert. wetland area have been reduced loss. Also, the box culvert on the latest hydrolic design of 50 years the design dis- :ond. This can be accomodated At Site B (Friar Swamp) the fill slopes have been reduced to 3:1 and also the median width has been reduced to 46 feet. The 85 foot dimension between the undercut of the new roadway and the centerline of the old roadway has been increased to 96 feet due to the reduction of the median width. Any further efforts to reduce the area of the isolated wetlands between the two roadways would require a redesign of the;roadway and six bridges which would cause the project to be delayed for several months. 40t JUL 1zy r . DEPARTMENT OF THE ARMY Wilmington District, Corps of Engineers Post Office Box 1890 Wilmington, North Carolina 28402-1890 SAWCO86-N-024-0009 PUBLIC NOTICE October 24, 1985 THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION has applied for a Department of the Army permit TO PLACE FILL MATERIAL IN WETLANDS ADJACENT TO FRIARS SWAMP FOR THE PURPOSE OF RELOCATING U. S. HIGHWAY 74-76 near Bolton, Columbus County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show a permit was issued in 1980 for the majority of wetland work along the 74-76 relocation. With the change in Corps of Engineers regulations on October 5, 1984, concerning the Corps jurisdiction and regulatory authority, the applicant realized that the two areas being considered by this application would require a valid Corps of Engineers permit prior to the placement of any fill material. The proposed fill area consists of two sites. Site No. 1 is located east of S. R. 1800 and involves the clearing, excavating, and subsequent filling of about 2 acres of wooded swamp. Site No. 2 is approximately 0.5 mile east of site No. 1 and calls for the clearing, excavating, and filling of about 14 acres of wooded swamp. The total length of the proposed wetland fill is about 3,000 feet; and at the widest point, it is about 240 feet wide. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. OCT 28 1985 PERMITS & ENGINEERING %ft -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of t e p eluding cumulative impacts, of the proposed activity and its intended use on the pub c n of the probable impacts which the proposed activity may have on the public interest re careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the gener That decision should reflect the national concern for both protection and utilizat on o All factors which may be relevant to the proposal must be considered including the cumu_ -- effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and.any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM), issues, denies or waives State certification required by Section 401 of the Clean Water Act. The. DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army permit serves as application to the DEM for certification. -3- Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, North Carolina Division of Environmental Management, Salisbury Street, Archdale Building, Raleigh, North Carolina. Copies of such materials will be furnished to any person requesting copies upon payment of reproduction costs. The North Carolina Division of Environmental Management plans to take final action in the issuance of the Clean Water Act certification on or after December 9, 1985. You asked that we provide details concerning any changes in the proposed work. In 1983 the permit, which was issued in 1980, was extended through 1984. At that time the project was reviewed and certain changes were made from what was contained in the original permit. Those changes were discussed in letters dated May 13 and July 12, 1983 (attached). We have reviewed the design and have determined that there have been no changes made to the plans within the area of Friar Swamp from those discussed in the 1983 letters. There are two areas east of Friar Swamp that because of the October 5, 1984, changes in the Corps regulations may now require a permit. Attached is a separate application for the fill of approximately sixteen acres of wetlands in the vicinity of Bolton. Previously this fill was considered permitted by a nationwide permit in that it involves wetlands above headwaters. The application is provided for your consideration and application is hereby made for a Section 404 permit for these two additional sites, if required. Box 1890 Wilmington, North Carolina 28402 ATTENTION: Mr. Ken Jolly Regulatory Functions Branch Dear Sir: SUBJECT: SAWC079-N-024-0364 (Permit No. 7.9-213-267) Proposed Construction of Relocation of US 74-76 Between Whiteville and Wilmington— Placing Fill Material in Wetlands Bordering Friar Swamp--Columbus County (R-61B) Reference is made to your March 22, 1983 letter concerning general mitigation measures for Site "B" on the proposed project. Our comments below follow each of the suggested mitigation measures in your letter. a. Causeway side slopes will be restricted.to a 2:1 grade through ali wetland areas-- We request that the 2:1 slope be revised to allow the use of 3:1 slopes through the wetland areas. This will allow us to construct the embankment without requiring guardrail. The difference in total width required for this is about 6 foot each side (12 foot total). The use of 3:1 slopes is more economical than using 2:1 slopes with guardrail. Using guardrail limits the aesthetic beauty of the natural environment as s.-en by the traveling public. It is noted the wetland involvement is considerably less than in the original permit (see item c). b. Natural areas within the right-of-way will be maintained (wetlands outside the fill limits will not be cleared and grubbed)- We request this be revised to allow some work room outside the fill limits. This project is designed t District Page Z May 13, Engineer 1983 to allow a 40' clear recovery area outside the pavement edge. This allows the contractor some work room outside of the toe of fill and also maintains a 40' clear area for errant vehicles to recover without hitting a fixed object. C. Median and shoulder widths will be restricted to the minimum width possible through all wetland areas-- The median width has been decreased from 88 ft. to 46 ft. through the wetlands (this is the normal minimum for a divided freeway). Shoulders have been retained as standard for this type project. ' d. Abandoned roadways in wetlands will be removed, restoring all original wetland contours-- No roadways are in the wetlands to be abandoned but we will include provisions to obliterate and restore all roads within the right-of-way to the original contours matc4ing the adjacent land. e. Disposal of all unsuitable excavated materials will be restricted to high ground-- All material excavated on the project through the wetlands will be disposed of on high ground out of the wetlands. f. Culverts will be constructed where necessary through wetland fills to facilitate sheet flow-- The existing road across Friar Swamp has three bridges on it somewhat limiting the sheet flow. We have planned to match or exceed the waterway area now available for sheet flow by constructing bridges compatible to the existing structures. The addition of culverts along the proposed facility without outlets through the existing roadway does not seem advantageous for any reason. District Engineer Page 3 May 13, 1983 Attached is a revised typical section that we propose to construct across the Friar Swamp wetlands. (Site "A" has not been changed but remains as was approved in the permit.) It is requested that the permit, which is scheduled to expire June 30, 1983, be extended until December 31, 1984, based on the revised cross section and the mitigation measures as discussed above. At Site A the fill slopes through the from 6:1 to 3:1 to reduce the wetland has been revised to 1 @ 6' x 6' based data. Using a design flood frequency charge would be 175 cubic feet per se, with a single 6' x 6' box culvert. wetland area have been reduced loss. Also, the box culvert on the latest hydrolic design of 50 years the design dis- zond. This can be accomodated At Site B (Friar Swamp) the fill slopes have been reduced to 3:1 and also the median width has been reduced to 46 feet. The 85 foot dimension between the undercut of the new roadway and the centerline of the old roadway has been increased to 96 feet due to the reduction of the median width. Any further efforts to reduce the area of the isolated wetlands between the two roadways would require a redesign of the roadway and six bridges which would cause the project to be delayed for several months.
