This permit, issued on / ? 6 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject pemtittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) No excavated or fill materials will be placed at any time in the existing channel of Moores Creek. This condition prohibits the originally proposed placement of fill materials in the area of Moores Creek immediately downstream of the existing N. C. Highway 210 bridge. (2) In order to protect'anadromous fishery resources, work will not be accomplished in wetlands between the dates of March 15 and June 1 of any year. (3) Three 36-inch diameter pipes will be installed between Stations 37+00 and 40+00. An 18-inch diameter pipe will be installed at Station 43+00. (4) A culvert must- be installed at Station 59.0 adequately sized to pass the flow of the existing stream at this site. (5) The existing N. C. Highway 210 bridge will be removed. The existing N. C. Highway 210 approach fills in wetlands will be removed, the elevation of surrounding wetlands will be established and wetland tree species characte- (See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989- - In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. On March 20, 1985, this office commented on the project which required the filling of 1.36 acres of wetlands and the dredging of .42 acres from the old bridge approaches. The applicant has now revised the application by proposing to fill approximately .93 acres of wetlands, and dredge .36.acres of Moore's Creek, classified "C-Swap". The project has been reviewed to determine impacts to water quality. The following comments are provided: 1. The project will require 401 certification. 2. The project as proposed will require fill.in excess of 1/2 acre area. The EMC policy states that areas not to exceed 1/2 acre of fill may be approved without-prior declassification by the EMC. The project as proposed exceeds 1/2 acre area of wetlands to be filled. 3. Project summary Applicant proposes to reroute existing N.C. 210 by aligning the naw roadway along the southerly edge of the Moores Creek National Battlefield (outside the park). The existing bridge and fill will be removed. The new crossing of Moores Creek will be by bridge and filled causeway. e North Carolina Department of Transportation Page 2 9. PROJECT DESCRIPTION: The project has been modified to only address the rerouting of N.C. 210 to the alternate identified as #3 on the gatefold plat of the originial application. (Figure #3). This alignment crosses an area acquired during the 70s for the reasons indicated on Figure 3. Alternate 3 crosses two major and one minor wetland area. In addition several wetland (pocossin) pockets are included within the right-of-way east of Moores Creek. The first of the two major wetland areas is Moores Creek Channel and the wooded swamp wetland to either side of the run. Plans presented with the application indicated that the combination of the wooded swamp and creek is approximately 240' wide. There is a small berm on the west bank of the creek surrounded by this wetland. This wetland is separated from the second area by a highground island which is approximately 365' wide. This second area is (based on field observations and Figure 3 examination) approximately 325' wide. This differs from the same area shown on Sheet 2 of 4 by being approximately 45' wider than the 280' shown on Sheet 2. The minor wetland area is not shown on the plans but occurs just west of Station 59.0. It is a small drain which was flowing at the time of the field investigation. The applicants propose to construct a new roadway to divert N.C. 210 to the southern portion of the park grounds. The total length of the roadway fill is approximately 9,100' long x 80' wide average x 1.75' deep average (0-'16'). A new bridge is proposed over the main run of Moores Creek. This bridge will be approximately 150' long x 30' wid4. The clearance is not clearly shown. Fill will encroach into the wetlands to either side of the actual bridge so that the bridge does not cross from highground to highground but from this fill on either side (see Sheet 2 of 4). The entire 325' wide second wetland area will be covered by fill (approxi- mately 100' wide). Three 36" culverts are now propsed to replace the single 72" concrete pipe originally proposed. (See Sheet 2 of 4). The stream at Station 59.0 is not addressed in the plans. It appears to be wet enough to require culverting. Approximately 46.750 cubic yards of material will be used for fill of this approximately 4,255 cubic yards will be placed below the MW contour, as estimated by the applicant. 10. ANTICIPATED IMPACTS: The new alignment will cause to be consumed approximately 47,950 s.f. (1.1 acres) of wooded swamp and/or stream habitat. At the old bridge site the applicant's are proposing to remove approximately 19,500 s.f. of existing fill associated with the approaches. A net wetland loss of approximately 28,450 s.f. (.65 ac) will result based on our calculations. The applicant has estimated that only .57 ac will be lost. The addition of two extra culverts should provide for better interchange through the wetland area east of the bridge. We still believe that a culvert is required at ,or near Station 59.0 to provide for the stream at that location. SUBMITTED BY: C. Department of Transportation filed an application on January 28, 1986 for a permit from the Divison of Coastal Management to develop in an Area of Environmental Concern and for Certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable Water Quality Standards. According to said application, N.C. Dep. of Transportation proposes to reroute existing N.C. 210 by aligning the new roadway along the southerly edge of the Moores Creek National Battlefield (outside the park). The existing bridge and fill will be removed. The new crossing of Moores Creek will be by bridge and filled causeway. S. HIGHWAY 74-76 near Bolton, Columbus County, North Carolina. The following description of the work is taken from data provided by the applicant and from observations made during an onsite visit by a representative of the Corps of Engineers. Plans submitted with the application show a permit was issued in 1980 for the majority of wetland work along the 74-76 relocation. With the change in Corps of Engineers regulations on October 5, 1984, concerning the Corps jurisdiction and regulatory authority, the applicant realized that the two areas being considered by this application would requirea valid Corps of Engineers permit prior to the placement of any fill material. The proposed fill area consists of two sites. Site No. 1 is located east of S. R. 1800 and involves the clearing, excavating, and subsequent filling of about 2 acres of wooded swamp. Site No. 2 is approximately 0.5 mile east of site No. 1 and calls for the clearing, excavating, and filling of about 14 acres of wooded swamp. The total length of the proposed the widest point, it is about 240 feet included with this public notice. wetland fill is about 3,000 feet; and at wide. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404(b) of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. u %* r -2- The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observations, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards, flood plain values, land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. Generally, the decision whether to issue this Department of the Army permit will not be made until the North Carolina Division of Environmental Management (DEM), issues, denies or waives State certification required by Section 401 of the Clean Water Act. The DEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. SUBJECT: Pender County, NC 210 in the Vicinity of Moores Creek National Battlefield (R-604 & B-704) In October, 1984, the North Carolina Department of Transportation made application for Federal and State permits to construct the subject project. The project.as proposed, met with objections from several environmental review agencies. In an attempt to resolve these differences a meeting was held on September 20, 1985, with representatives from: National Park Service, U. S. Fish and Wildlife Service, National Marine Fisheries Service, N. C. Division of Coastal Management, N. C. Division of Marine Fisheries, Corps of Engineers, and N. C. Department of Transportation. There were three major areas of concern. They were: (1) the proposed alteration of the present channel of Moores Creek; (2) the size and number of culverts to be placed in the wetlands and; (3) amount of wetland to be lost. At the request of the National Park Service, the original application included the restoration of the Moores Creek channel to its pre 1950 alignment at the present bridge site. This required opening the old channel and filling the existing channel. With Park Service approval, we agreed to delete this channel change from the application. The old bridge will be removed and the approach fills be removed to wetland elevation. The original application included a 72 inch pipe at Station 38+70. We agreed to substitute three 36 inch pipes between Station 37+00 and Station 40+00. The plans also include an 18 inch pipe near Station 43+00, which is not included in the area that requires a permit. An Equal Opportunity /Affirmative Action Employer . % 1 .V District Engineer Page 2 November 27, 1985 The total area of wetlands being filled by this project is 0.93 acre; including, 0.31 acre in approach fills at Moores Creek and 0.62 acre in wooded swamp approximately four hundred feet east of the creek. Approximately 0.36 acre of fill will be removed to wetland elevation at the present bridge site. Therefore, there will be a net loss of approximately 0.57 acre of wetland. Attached is a copy of a revised permit application which includes the changes as discussed above. The N. C. Box 1890 Wilmington, North Carolina 28402 ATTENTION: Mr. Ken Jolly SUBJECT: NCDOT Crossing of Moores Creek (Public Notice No. SAWCO 85-N-071-0038) Dear Colonel Hanson: This is in response to the subject public notice proposing to reroute the existing N.C. 210 by aligning the new roadway along the southerly edge of the Moores Creek National Battlefield. The existing bridge and fill would be removed and the new crossing of Moores Creek accomplished by a bridge. and fill causeway. There are two major wetland areas impacted by the subject proposal. The first wetland site is Moores Creek channel and the bottomland hardwoods on both of its sides. The applicant proposed to cross this area utilizing a bridge approximately 150' long by 30' wide. Additionally, the rerouting of N.C. 210 will require a fill road about 9,100' long by 80' wide. This fill road will completely cross another wooded wetland area to the east about 325' in length. A single 72" culvert will be placed at this location. It appears that this culvert will be inadequate to maintain sufficient flow. As a result of this action, approximately 47,750 cubic yards of fill will be placed in wetlands eliminating 1.1 acres of bottomland hardwoods. The second major wetland is located at the existing N.C. 210 bridge site. At this area, the original channel was eliminated in the 1950's by road fill, and a new one constructed out of the existing wetlands of Moore Creek. Based on conversations with the Corps project officer, it is evident that the "new" channel is stabilized and functioning as a valuable aquatic system. Also at this location are two fingers of old bridge approach fill covering about 18,255 square feet of wetlands. As mitigation, the applicant proposed to remove the existing approach material, fill in the new channel (11,200 square feet) and reconstruct the original, one. RECEIVED M AY O 31985 WATER QUALITY SECTION OPERATIONS BRANCH *.. . ? %J -2- The overall proposed activity would eliminate about 1.1 acres of mature, valuable bottomland hardwoods dominated by red maple (Acer rubrum), black gum (Nyssa sylvatica) and cypress (Taxodium disticum). In addition, the mitigation would eliminate a valuable aquatic resource and replace it with a disturbed area that would take several years to become stabilized. Bottomland hardwood wetlands perform valuable functions to the aquatic systems such as fish and wildlife habitat values, detrital export, water quality services, and storm water retention capabilities. Consequently, because of the important ecological values associated with these wetlands, we recommend that the permit not be issued unless the applicant agrees to the following conditions. 1) It is very questionable if the single 72" culvert will provide adequate flow through the fill road. We recommend additional 72" culverts be placed at this location to alleviate this oversight. 2) Culverts should be placed at Station 59 to insure hydrological integrity of the wetland areas. 3) The "new" channel shall not be filled. 4) 18,255 square feet of old bridge approach fill shall be removed. 5) A 1:1 replacement of bottomland hardwoods habitat be provided for the wetlands eliminated by fill activities. An upland site should be selected in the immediate vicinity of the project area and contiguous ithsthe forestedto an wetland community. The site should elevation conducive to the growth of bottomland hardwood vegetation, and planted with the same wetland tree species eliminated by the proposed project. The trees should be about 5 feet in height, planted approximately 15 feet apart, and transplanted to the mitigation site in late winter to encourage a successful transplanting. The first of these is the I r reroutin,; of -C. 210 to the alternate ide: ti._ied as "3 on the gatefold plat (Figure 3). This ali nment crosses am area acquired during the 70s for the reasons indicated on Figure 3. Alternate.. 3 crosses two major and one minor wetland area. In addition several wetland (pocossin) pockets are included within the right-of-way east of Moores Creek. The first of the two major wetland areas is Moores Creek Channel and the wooded swamp wetland to either side of the run. Plans presented with the application indicated that the combination of the wooded swamp and creek is approximately 240' wide. There is a small berm or, the west bank of the creek surrounded by this wetland. This wetland is seperated from the second area by a highground island which is approximately 365' wide. This second area is (based on field observations and Figure 3 examination) --jproximately 325' wide. This differs from the same area shown on Sheet 2 of 4 by being approximately 45' wider than the 280' shown on Sheet 2. The minor wetland area is not shown on the plans but occurs just west of Station 59.0. It is a small drain which was flowing at the time of the field investigation. The second part of this project is sited at the existing N.C. 210 Bridge location. The run of Moores Creek was diverted in the 1950s in order to straighten a severe bend in the creek at the road location. The original channel. was filled by the road fill. It appears that this new channel was cut out of the existing wetlands adjacent to Moores Creek. The new run also exhibits a stable appearance when compared to other segments of the unaltered stream. There are two fingers of bridge approach fill which total approx- imately 18,255 s.f. of impact on the existing wetland. The Moores Creek National Battlefield is east of the stream at this location. Paved roads, brick buildings, concrete paths and monuments are located through the park grounds. The applicants propose to construct. a new roadway to divert N.C. 210 to the southern portion of the park grounds. The total length of the roadway fill is approximately 9,100' long x 80' wide average x 1.75' deep average (0'-16'). A new bridge is proposed over the main run of Moores Creek. This bridge will be approximately 150' long x 30' wide. The clearance is not clearly shown. Fill will encroach into the wetlands to either side of the actual brides so that the bridge does not cross from highground to highground but from this fi_11 on either side (see Sheet 2 of 4). The entire 325' wide second wetland area will be covered by fill (approximately 100' wide). A single 72" concrete pipe will be provided for interchange across the area now unencumbered. The stream at Station 59.0 is not addressed in the plans. It appears to be wet enough to require culverting. Approximately 47,750 cubic yards of material will be used for fill of this approximately 4,255 cubic yards will be placed below the ??kd contour, as estimated by the applicant. /RTli CAROLI'ivA DEPART?,' NT OF T"ILAlNSPORTATIOi i .AGE 3 The second project covered by the application is the removal of the N.C. 21.0 Bridge and associated fill. Also proposed is the refilling of what is con- sidered the new run of the creek at the bridge and the reopening of the old run which is now filled by the bridge approach on the east side of Mioor.es Creek. Approximately 18,255 s.f. of area would be restored by the bridge fill removal. The new channel involves approximately 11,200 s.f. of area and 6,250 cubic yards of material would be used to raise the elevation to that of the existing wetlands to either side of the creek. The old run excavation would be as part of the bridge fill removal and involves approxi- mately 1,500 s.f. 10. ANTICIPATED IMPACTS: The new alignment will cause to be consumed approximately 47,950 s.f. (1.1 acres) of wooded swamp and/or stream habitat. At the old bridge site the applicant's are proposing to remove approximately 18,255 s.f. of existing fill associated with the approaches. However, the applicants are also pro- prosing to fill approximately 11,200 s.f. of open water back to the elevation of the existing wetlands to either side and will convert one habitat type for another. It appears that it may take several years for the proposed filled area to become stabilized. In addition to the question of fill the project area is also located within a 100-year floodway. The existing bridge approach fill at the N.C. 210 crossing blocks all but 35' of a 375' wetland area (Sheet 4 of 4). The new crossing involves two wetland areas. The bridge site is approximately 240' wide and the opening between the two approach fills is approximately 110' wide. This area is seperated from the second wetland by the highground island.. The entire 325' width of this second wetland would be filled except for a 72" culvert placed approximately in the middle of the fill. Based on the visual inspection of the site at this second location it does not appear that a single culvert will adequately replace the existing interchange of water or the existing free passage of fishery resources now using the area. There is also the question of the flowing stream at Station 59.0. It appears that a culvert is needed at this site also. The siting of this new alignment through the wetlands is also within the conservation classification of the Pender County Land Use Plan. In that we are replacing a bridge with a culvert, we understand that a CAMA permit may be required. If it is determined that a permit is required, please process the attached permit application. The project has been processed by the Federal Highway Administration as a "categorical exclusion"; therefore, an individual 404 permit will not be required but is permitted under a nationwide permit by the Corps of Engineers. C. Highway 210 in the vicinity of the Moores Creek National Battlefield, Pender County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The proposed placement of fill material in the run of Moores Creek, south of the existing N. C. Highway 210 bridge, will be deleted from the plans. b. In order to protect anadromous fishery resources, work will not be accomplished in wetlands between the dates of March 15 and June 1 of any year. c. Additional bridging and/or culverts will be placed at Station 59, between Stations 37 and 38 and between Stations 39 and 40. -2- wF- d. A mitigation plan that compensates for all unavoidable wetland losses will be developed and provided for review by the Federal review agencies. The Corps of Engineers will determine the adequacy of the mitigation plan. (1) Forested wetlands habitat will be created to fully compensate for unavoidable wetlands habitat losses. (2) Wetland plant species characteristic of adjacent wetlands will be planted in all restored areas. e. Temporary bulkheads and silt curtains will be placed to minimize the impacts of fill placement and wetlands restoration at the existing N. C. Highway crossing. f. Work at the existing N. C.
