Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. This permit, issued on/d , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The project will maintain a 75' wide natural vegetated buffer zone between the shoreline and any parking lot and development areas. (2) The proposed docks and pier facilities must not encroach on public navigation and will not extend more than 1/3 of the width of the existing water body. (3) The applicant must provide adequate restroom type facilities at the location. (4) All fill material to be placed below the NWL as associated with the construction and development of the four concrete boat ramps will be confined to the dimen- sions of the ramps as shown on the work plat drawings. (5) All excavated materials will be confined landward of the normal water elevation contour and any wetlands. (See attached sheet for Additional Condtions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (7) No marsh grass will be excavated or filled. (8) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. A,9) It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. (10) The permittee will maintain the authorized work in good condition and in con- formance with the terms and conditions of this permit. NOTE: If more than one contiguous acre is to be affected by the activities associated with this project, then an erosion/sediment control plan must be submitted for approval at least 30 days prior to construction. The Application provides adequate assurance that the discharge of fill material into a wetlands area adjacent to the waters of Lawson Creek in conjunction with the proposed boat launching area in Craven County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction- related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. That surface runoff be directed through wetland buffer areas as depicted in the revised plat. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal Permit. This the 16th day of September, 1986. A 2.5 ac. parking ,. ?i nlnnne.d. 9 Narrative description The project site consists of four-acres of high ground property within the City of New Bern's Lawson Creek Park situated on the east side of Hwy. 70 bypass at the Pembrook Exit' SR1200 off the Tent River and Lanes Branch of Lawson Creek in Craven County. Mr. Charles H.. Kimbrell, Director of Public Works, has submitted a CAMA application to develop a public boat launching facility that will include four concrete boat ramps, access piers and a 2.5 acre parking lot. Each ramp will measure 50' long and 13' wide and will be joined by a 5' wide wooden pier extending 50' into the creek. The center pier will measure 74' long. The design of the westernmost pier includes a 5' wide "L" head platform extending upstream 95'. The easternmost pier includes a 23' long "L" head extending down stream. A concrete apron approximately 25' wide by 100' long will join the actual ramps to the gravel parking lot area which will provide about 100 parking spaces on the 2.5 acres of land. Abnormal amounts of runoff water that occur will be directed along the grassed swales within the parking lot and through an existing culvert system to the SB waters of Lawson Creek. The natural water depths within Lawson Creek and Lanes Branch are 5-8' deep on NWL. The creek is approximately 200' wide in the area of the proposed project. A small patch of Spartina cynosuroides measuring about 150 sq.ft. occurs along the project shoreline near the east end and will not be involved with the.proposed construction activities. Historically, the project site is a former land fill for the City of New Bern and some of.the old debris can still be seen along the shore- line. The highground property is well vegetated with different types of natural grasses and other pioneering plant species. The project plans clearly show that a 75' wide vegetated buffer zone will be maintained between the proposed parking lot and the water's edge. Although not specifically mentioned in the applocation, the City of New Bern will provide restroom facilities at the site by using permanently installed porterjohnsd as are currently being used at the existing boat ramp further in the.park. This project will be funded by monies made available from Craven County working in conjunction with the City of New Bern. 10. 'Anticipated impacts The City has told this office that the reason this project is being pursued is that the two existing ramps are overcrowded and shoaling problems prohibit launching of boats during periods of low water. The presumption is that the two existing ramps on the Trent River will be closed to traffic or will be used only by smaller boats dur- ing periods of high water. There appears to be a strong need for the launching facility that includes the four boat ramps on Lanes Branch of Lawson Creek. Clearly, the natural water depths are deeper than at the existing boat ramps and the proposed parking lot area will i provide increased space for the users of the.facility. The loca- tion of these ramps', and the expanded facility, is strategic in its location near the confluence of the Trent and Neuse Rivers where boat traffic will have the option in which direction to pursue the recreational activities. The actual construction will displace ap- proximately 1500 sq.ft. of open creek bottom land and 1500 sq.ft. of hillside. The 2.5 acre parking lot will eliminate the existing vegetation, but will replace the same area with marl. The 75' vege- tated buffer zone will do much to prevent direct runoff from enter- ing the adjacent waters of Lawson Creek. In addition, the natural slope of the land will cause all runoff water to pass across the gravel parking lot before being directed through the culvert system. CAMA REVIEW The project has been revieweed with reference to the LUP for the. City of New Bern dated 1981. The project is considered consistent with that document where the highground property is classified as transitional and the surface waters of Lawson Creek as conservation. We recommend that the following conditions be included in the State authorization: a. All excavated materials will be confined landward of the normal water elevation contour and any wetlands. b. Vegetated wetlands will not be excavated or filled. c. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. d. It is possible that the authorized structure may be damaged by wavewash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. Parka (set of four). Each ramp will measure 50' x 13' and will provide a r pier access to Lanes Branch. A 2.5 ac. parking lot with restroom facilitie 9 Narrative description The project site consists of four acres of high ground property within the City of New Bern's Lawson Creek Park situated on the east side of Hwy. 70 bypass at the Pembrook Exit* SR1200 off the Trent River and Lanes Branch of Lawson Creek.in Craven County. Mr. Charles H. Kimbrell, Director of Public [corks, has submitted a CAMA application to develop a public boat launching facility that will include four concrete boat ramps, access piers and a 2.5 acre parking lot. Each ramp will measure 50'• long and 13' wide and will be joined by a 5' wide wooden pier extending 50' into the creek. The center pier will measure 74' long. The design of the westernmost pier includes a 5' wide "L" head platform extending upstream 951. The easternmost pier* includes a 23' long "L" head extending down stream. A concrete apron approximately 25' wide by 100' long will join the actual ramps to the gravel.parking lot area which will provide about 100 parking spaces on the 2.5 acres of land. Abnormal amounts of runoff water that occur will be directed along the grassed swales within the parking lot and through an existing culvert system to the SB waters of Lawson Creek. The natural water depths within Lawson Creek and Lanes Branch are 5-8' deep on NWL. The creek is approximately 200' wide in the area of the proposed project. A small patch of Spartina cynosuroides measuring about 150 sq.ft. occurs along the project shoreline near the east end and will not be involved with the proposed construction activities. Historically, the project site is a former land fill for the City of New Bern and some of the old debris can.still be seen along the shore- line. The highground property is well vegetated with different types of natural grasses and other pioneering plant species. The project plans clearly show. that a.75' wide vegetated buffer zone will be maintained between the proposed parking lot and the water's edge. Although not specifically mentioned in the applocation, the City of New Bern will provide restroom facilities at the site by using permanently installed porterjohnsd as are currently being used at the existing boat ramp further in the.park. This project will be funded by monies made available from Craven County working in conjunction with the City of New Bern. 10. Anticipated impacts The City has told this office that the reason this project is being pursued is that the two existing ramps are overcrowded and shoaling .problems prohibit launching of boats during periods of low water. The presumption is that the two existing ramps on the Trent River will be closed to traffic.or will be used only by smaller boats dur- ing periods of high water. There appears to be a strong need for the launching facility that includes the four boat ramps on Lanes Branch bf Lawson Creek. Clearly, the natural water depths are deeper than at the existing boat ramps and the proposed parking lot area will i provide increased space for the users of the facility. The loca- tion of these ramps, and the expanded facility, is strategic in its location near the confluence of the Trent and Neuse Rivers where boat traffic will have the option in which direction to pursue the recreational activities. The actual construction will displace ap- proximately 1500 sq.ft..of open creek bottom land and 1500 sq.ft. of hillside. The 2.5 acre parking lot will eliminate the existing vegetation, but will replace the same area with marl. The 75' vege- tated buffer zone will do much to prevent direct runoff from enter- ing the adjacent waters of Lawson Creek. In addition, the natural slope of the land will cause all runoff water to pass across the gravel parking lot before being directed through the culvert system. CAMA REVIEW The project has been revieweed with reference to the LUP for the City of New Bern dated 1981. The project is considered consistent with that document where the highground property is classified as transitional and the surface waters of Lawson Creek as conservation. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action.
