The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded marshlands. b. No excavated or fill materials will be placed at any time in any marshes or waters of the State. c. No marshland will be excavated or filled. d. Excavation will not exceed 6 feet below the elevation of mean low water (MLW). e. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile shrimp populations, no excavation or filling will be permitted between April 1 and September 30 of any year without prior approval of the Division of Coastal Management. (2) A temporary silt curtain will be maintained across the mouth of the canal during dredging to' avoid elevated turbidity levels in adjacent waters. (3) No marsh grass will be excavated and/or filled. (4)- Al_l: excavated materials will be confined above MHW and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. (5) Excavation will not exceed 6 feet below the elevation of mean low water (MLW). (6) The temporary placement or double handling of excavated or fill materials within waters or-wetlands is not authorized. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Grading must be adequately smooth to prevent water pockets and subsequent mosquito breeding areas. (8) At or prior to the time work under this permit is completed, the permittee will place a sign or signs, clearly visible to marina patrons, stating that no discharge of sewage from boats is allowed in the-basin and canal area. NOTE: To prevent an inadvertent violation of the requirements of this permit, representatives of the Corps of Engineers and the Division of Coastal Management are available to stake spoil areas and review permit conditions. Narrative description The,applicant's property is a tract approximately 20 acres in size located adjacent to Cedar Creek off SR 1376 in Sea Level. The tract varies in elevation from approximately 4' on the high ground to about +1' at the marsh. Approximately 4 acres bordering Cedar Creek is a mixed marsh composed of black needlerush, salt meadow grass and salt grass. This marsh is dissected by mosquito control ditches with adjacent intermittent spoil islands. Other natural islands occur in these wetlands also. A canal borders the eastern property line and was dug through the marsh prior to permit requirements. The spoil was placed and leveled to the west of this feature during construction. This berm is ap- proximately 60 to 80' wide and is now vegetated with domestic spe-' cies and kept mowed as a yard. The canal is about 30' wide, 525' long, and terminates in a highground basin about 75' long by 1.00' wide. Existing depths are an average of 2.5' in the canal and basin. The applicant proposes to maintain the canal to a depth of -6' NWL. Spoil will be placed on the existing berm temporarily to later be removed to another permanent location on the property. Cedar Creek is a primary nursery area as designated by DMF. DEC currently de- signates the adjacent waters as SA, and the Div. of Health Services also designates these waters as being open to shellfishing at this time. 10. Anticipated imp"acts This project will involve the disturbance of about 13,500 sq.ft. of shallow man-made canal bottom by the,removal of about 1,750 cu.yds. of spoil material. Another 25,000 sq.ft. should be disturbed in disposal of the anticipated spoils. Short term turbidities can be expected to occur around the dredging operation, and some minor impacts should be'?experienced by the marine resources that exist in adjacent Cedar Creek.. Narrative description The applicant's property is a tract approximately 20 acres in size located adjacent to Cedar Creek off SR 1376 in Sea Level. The tract varies in elevation from approximately 4' on the high ground to about +1' at the marsh. Approximately 4 acres bordering Cedar Creek is a mixed marsh composed of black needlerush, salt meadow grass and salt grass. This marsh is dissected by mosquito control ditches.with adjacent intermittent spoil islands. Other natural islands occur in these wetlands also. A canal borders the eastern property line and was dug through the marsh prior to permit requirements. The spoil was placed and leveled to the west of this feature during construction. This berm is ap= proximately 60 to 80' wide and is now vegetated with domestic spe-' Gies and kept mowed as a yard. The canal is about 30' wide, 525' long, and terminates in a highground basin about 75' long by 100' wide. Existing depths are an average of 2.5' in the canal and basin. The applicant proposes to maintain the canal to a depth of -6' NWL. Spoil will be placed on the existing berm temporarily to later be removed to another permanent location on the property. Cedar Creek is a primary nursery area as designated by DMF. DEC currently de- signates the adjacent waters as SA, and the Div. of Health Services also designates these waters as being open to shellfishing at this time. 10. Anticipated impacts This project will involve the disturbance of about 13,500 sq.-ft. of shallow man-made canal bottom by the removal of about 1,750 cu.yds. of spoil material. Another 25,000.sq.ft. should be disturbed in disposal of the anticipated spoils. Short term turbidities can be expected to occur around the dredging operation, and some minor impacts should be'x--xperienced by the marine resources that exist in adjacent Cedar Creek.
