(1) Excavation will not exceed two (2) feet below the elevation of normal water. This reduced depth is necessary under Rules of the Coastal Resources Commission which requires that a basin be no deeper than the immediate water area to which it connects. (2) All excavated materials will be confined landward of the permitted bulkheads or the normal water elevation contour. (3) The bulkheads will be positioned in strict accordance with the permit plans. (4) The double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (5) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTUs or less are not considered significant. (6) The proposed basin fill will be carried out after the bulkhead is in place (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. The proposed project will require a 401 certification but does meet the requirements of General Certification No. 1272 for bulkhead construction. 2. Silt screens should be used around the activity to minimize turbidity in adjacent waters. 3. The basin should continue to be used for small (less than 18-foot) boats; larger boats should not be allowed. 4. The dredged depth should not be more than -4 feet MLW. The excavated fill will be placed behind an existing bulkhead filling less than one cubic yard, per linear foot of bulkhead, below MHW. The project is located adjacent to Core Sound, classified SA and open to shellfishing. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. The project would require a 401 certification but should meet the requirements of a general 401 certification for bulkhead construction. 2. Narrative description The applicant's property is a 1 1/2 acre tract located adjacent to Core Sound off SP 1369 in the community of Davis, Carteret County. The property is typically +3' in elevation and bulkheaded next to the sound. The applicant's residence is the most dominent feature at the site and the surrounding vegetation is domestic trees, shrubs, and grasses. A canal dug prior to permit requirements extends along the southern side of the property for the full depth of the parcel. The basin water depth was originally dug to 8' deep and authorized to 6' deep on maintenance permits issued previously by this office. The pre- sent canal depths are about 1/2' deep at NWL. The applicant is proposing to maintain a portion of the basin and excavate an access channel into Core Sound. Spoils will he placed in the upper one-half of the basin and confined by a bulkhead. Other spoil will be placed north of the channel behind the exist- ing bulkhead. All excavation is proposed to -4' NWL deep. 10. Anticipated impacts This work will involve the disturbance of 2,650 sq.ft. of previously excavated mar.-made estuarine bottom by excavation, and 5,260 sq.ft. of similar bottom will be raised to become high ground. Another 4,000 sq.ft. will be disturbed.in the channel excavation. In all, about 850 cu.yds. will be removed and placed in the previously desig- nated spoil areas. Approximately 300 sq.ft. of salt meadow grass will be filled in the upper basin area by this project. Adjacent. waters are classified as SA by DEM and are currently ?pe__to she'l- fishing by the Div. of Health Services. Narrative description The applicant's property is a 1-1/2 acre tract located adjacent to Core Sound off SR 1369 in the community of Davis, Carteret County. The property is typically +3' in elevation and bulkheaded next to the sound. The applicant's residence is the most dominent feature at the site and the surrounding vegetation is domestic trees, shrubs, and grasses. A canal dug prior to permit requirements extends along the southern side of the property for the full depth of the parcel. The basin water depth was originally dug to 8' deep and authorized to 6' deep on maintenance permits issued previously by this office. The pre- sent canal depths are about.1/2' deep at NWL. The applicant is proposing to maintain a portion of the basin and excavate an access-channel into.Core Sound. Spoils will be placed in the upper one-half of the basin and confined by a bulkhead. Other spoil will be placed north of the channel behind the exist- ing bulkhead. All excavation is proposed to -4' NWL deep. 10. Anticipated impacts This work will involve the disturbance of 2,650 sq.ft. of previously excavated man-made estuarine bottom by excavation, and 5,260 sq.ft. of similar bottom mil-1 be raised to become high ground. Another 4,000 sq.ft. will be disturbed.in the channel excavation. In all, about 850. cu..yds. will be'removed and placed in the previously desig- nated spoil areas. Approximately 300 sq.ft. of salt meadow grass will be filled in the upper basin area by this project. Adjacent waters are classified as SA by DEM and are currently open-to shell- fishing by the Div. of Health Services.
