Dear Mr. Parker:
Reference the application of Mr. Donza Lee Morris for a
Department of the Army permit to maintain and enlarge a canal and
construct and backfill a bulkhead off Core Sound near Atlantic,
Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The bulkhead will not be positioned farther than 5 feet
waterward from the normal water level (NWL) elevation contour at
any point along its alignment.
b. All excavated materials will be confined landward of the
normal water level (NWL) contour and any regularly or irregularly
flooded vegetated wetlands or landward of the permitted bulkhead.
c. Vegetated wetlands will not be excavated or filled.
d. Excavation will not exceed 6 feet below the elevation of
the normal water level (NWL).
e. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.

f. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.

Enclosed is the application of Mr. Donza Lee Morris for a
Department of the Army permit and a State Water Quality
Certification to maintain and enlarge a canal and construct and
backfill a bulkhead off Core Sound near Atlantic, Carteret County,
North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by July 9, 1986, the District Engineer
will deem that waiver has occurred.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received May 9, 1986, for a
Department of the Army permit to maintain and enlarge a canal and
construct and backfill a bulkhead off Core Sound, near Atlantic,
Carteret County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWCO86-N-016-0281 and will be coordinated by
Mr. David Baker. He is available to address questions or comments

Dear Mr. Morris:
Reference your application for a Department of the Army permit
to maintain and enlarge a canal and construct and backfill a
bulkhead off Core Sound, near Atlantic, Carteret County, North
Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Issued to Donza L. Morris
authorizing development in Carteret Countyat Core Sound at Atlantic
as requested in the permittee's application dated 2/17/86 including
attached plats, match line sheets 1-3 of 3 and section sheet dated received 2/24/86.
This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) Excavation will not exceed 6 feet below the elevation of the normal water
level (MWL).
(2) No marsh grass will be excavated and/or filled.
(3) All excavated material will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
(4) The temporary placement or double-handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
(5) All disturbed areas will be properly graded and provided a ground cover
sufficient to restrain erosion within 30 days of project completion.
(6) The activity will be conducted in such a manner as to prevent a significant

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Marina Operation
(7) The permittee will prominently post a sign(s) so that all patrons will under-
stand that a "no sewage discharge" policy will be enforced at the marina.
(d) Prior to February 28, 1987 the permittee will install and maintain operation
and the life of the project a pumpout facility to service boats with sewage
holding tanks.
NOTE: The permittee and/or his contractor is urged to meet with a representative
of the DCM and/or the U. S. Army Corps of Engineers prior to project
initiation.
NOTE: This project is authorized under General Water Quality Certification
#1272 issued by the Division of Environmental Management for bulkhead
construction.

and construct a seawall at property adjacent to Core Sound, north
, Carteret County
9. Narrative Description
The applicant's property is a 32-acre tract located adjacent to Core
Sound north of Atlantic off SR 1378 in Carteret County. The property
is composed of two segments of differing character. The east end is
primarily dredged and fill land which currently supports the applicant's
marina, bar,-ferry service, and sevefal residences; the western end
is dominated by pine and used for primative camping and storage.
The eastern end is the site of the proposed development and is bordered
by a man-made canal on the north which varies in'width from 30' to 751.
The canal is about 860' long overall, and is "L" shaped with a right-
angle crook prior to the last 2401. The canal is bulkheaded near the
boat ramp and the ferry landing area, and various docks and piers pro-
vice dockage for at least 25 vessels. Current depths in the canal range
from 3-5'.
The applicant proposes to maintain the existing canal area to -8' NWL
(previous-applications have been for -6' NWL). In addition, the appli-
cant is proposing the widen the upper 240' of canal an additional 401.
Bulkheads will be added along approximately 1,000' of the canal shore-
line. Presently no development is proposed for the western end of the
property.
The applicant has been involved with this office since 1972. Permits
authorizing the maintenance of this canal have been in effect (D&F No.
648) almost continuously since.
10. Anticipated impacts
Conducting the-project as proposed will involve the disruption of 24,000
sq.ft. of shallow, subtidal, man-made canal bottom with the proposed
maintenance excavation. The widening of the canal in the upper 240'
will involve 9,000 sq.ft. of adjacent high ground, and another 2.,000
sq.ft. will be filled by the construction and backfilling of the pro-
posed 1,000' of bulkhead. Spoil disposal will involve 36,800 sq.ft.
of high ground and 300 sq.ft. of existing canal bottom is proposed to
be filled by the widening of the existing road between the eastern and
western portions of the tract. In total, 70,100 sq.ft. will be disturbed
by the project activity.
Adjacent waters are classified as SA by DEM, and are currently open
for shellfishing according to the Div. of Health Services.

The Subject application has been reviewed for water quality
impacts and the following comments are offered:
1. It is expected that dissolved oxygen contraventions are
currently occurring from time to time in the canal, due to the
length and configuration of the canal, along with the fact
that there are two 5 foot culverts which empty into the upper
end of the canal. It is anticipated that the increased depth
and width resulting from the dredging will allow access for
larger boats in the canal. The bulkhead will also facilitate
the tying up of boats in the canal. It is further expected
that the proposed increase in dredged depth will increase the
likelihood of dissolved oxygen contraventions in the canal.
Some of these expected adverse effects on water quality would
be avoided if the dredging depth was restricted to -6 NWL, and
we would not object.
2. At the present time there are no development plans for the
area adjacent to the canal. Any future development in this
area should be done in such a way.as to prohibit any
stormwater runoff discharges up to the 10-year, 24-hour storm
event from entering surface waters.
3. The project does require a 401 certification, but does meet
the conditions of general certification No. 1272 for fill
behind bulkheads.

The applicant proposes to perform maintenance excavation of an existing canal,
860 feet in length, to a depth of -8' NWL. The applicant also proposes to

bulkhead along the canal shoreline. The project is located adjacent to Core
Sound, classified SA, currently closed to shellfishing.
The project has been reviewed to determine impacts to water quality. The
following comments are offered:
1. The project will pequire 401 certification, but should meet the conditions
of a general cer ification for bulkhead construction.

9. Narrative Description
The applicant's property.is a 32-acre tract located adjacent to Core
Sound north of Atlantic off SR 1378 in Carteret County. The property
is composed of two segments of differing character. The east end is
primarily dredged and fill land which currently supports the applicant's
marina, bar, ferry service, and sevefal residences; the western end
is dominated by pine and used for primative camping and storage.
The eastern end is the site of the proposed development and is bordered
by a man-made canal on the north which varies in width from 30' to 751.
The canal is about 860' long overall, and is "L" shaped with a right-
angle crook prior to the last 2401. The canal.is bulkheaded near the
boat ramp and the ferry landing area,e and various docks and piers pro-
vice dockage for at least 25 vessels. Current depths in the canal range
from 3-5'.
The applicant proposes to maintain the existing canal area to -8' NWL ,,
(previous applications have been for -6' NWL). In addition, the appli'=
cant is proposing the widen the upper 240' of canal an additional 401.
Bulkheads will be added along approximately 1,000' of the canal shore-
line. Presently no development is proposed for the western end of the
property.

10. -Anticipated impacts
Conducting the project as proposed will involve the disruption of 24,000
sq.ft. of shallow, subtidal, man-made canal bottom with the proposed
maintenance excavation. The widening of the canal in the upper 240'
will involve 9,000 sq.ft. of adjacent high ground, and another 2,000
sq.ft. will-be filled by the construction and backfilling of the pro-
posed 1,000' of bulkhead. Spoil disposal will involve 36,800 sq.ft.
of high ground and 300 sq.ft. of existing canal bottom is proposed to
be filled by the widening of the existing road between the eastern and
western portions of the tract. In total, 70,100 sq.ft. will be disturbed
by the project activity.
Adjacent waters are classified as SA by DEM, and are currently open
for shell,f.ishing according to the Div. of Health Services.
