L. Moore (Boat Basin #2) Carteret County The Subject application has been reviewed for water quality impacts and the following comments are offered: 1. This project will not require a 401 certification. 2. Spoil material shall be retained behind a silt screen to prevent excessive siltation of adjacent waters. 3. Plans indicate approximately 2 feet of spoil to be placed over 21,250 sq. ft. of area; however, the 4,500 cubic yards of spoil over this area would be 5.7 feet deep. We therefore presume that some spoil will be transported offsite. Any spoil transported offsite should be dried before transporting. 4. The following should be required to assure protection of adjacent waters from fecal coliform violations: a. Pumpout facilities. b. Locked head policy established and enforced. C. Live aboards and transient dockage prohibited. d. Signs posted on docks prohibiting overboard discharges of sewage and addressing conditions b. and c. above. Moore (Boat Basin #2) Harkers Island Carteret County The applicant proposes to excavate a high ground boat basin 90' x 135' to a depth of -6 MLW. Within the basin the applicant proposes 5 boat slips, 4 - 30' x 401, 1 - 20' x 401. The project is located adjacent to Harkers Island Harbor of Refuge, classified SA currently closed to shellfishing. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. The project will not require a 401 certification. 2. The spoils shall be placed behind a silt screen and in such as to prevent any discharge to the water. The plans indicate an average of 2 feet of fill to be placed over 21,250 square feet. The 4,500 cubic yards of spoil material spread over 21,250 square feet would represent an average depth of 5.7 feet of fill. It is therefore assumed that some of the spoils will need to be trucked off site; any spoils removed from site shall be dried prior to removal. 3. It is recommended that the following conditions be required to protect the waters from fecal coliform violations: a. That a pump out facility be installed. b. That a lock head policy be established and enforced. c. Live aboards and transient dockage not be allowed. d. That signs be posed on the dock prohibiting overboard discharge of sewage, and addressing conditions b and c above. 4. Narrative description The applicant has submitted two separate proposals for de- velopment of boat basins and boat slips on the 65-acre tract he owns located adjacen to SR 1335 bordering The Straits and North River on.the west end-of Harkers Island in Carteret County. The property is physically divided by the Carteret County Harbor of Refuge into two parcels: northern and sou- thern tracts each having similar characteristics. This application 4s for the development of a boat basin adja- cent to the Harbor of Refuge on the southernmost parcel. The property is typically sandy soil, vegetated by various types of scrub species. Adjacent to the Harbor it appears that spoil was deposited possibly from the Harbor excavation raising the ele- vation in this area from 5-81. The remaining high ground is relic dune ridges which grade into wooded wetlands moving towards North River and turning into a large body of black needlerush and smooth cordgrass wetlands. The shoreline of the harbor basin on this parcel is bordered by a smooth cordgradd fringe measuring 0-50' in width. In the project area, this fringe has been severely altered or elimina- ted during an offloading exercise of junk cars from Core Banks. Much relic car debris is resting on and mixed with the soil in the project area. The applicant is proposing to excavate a 90' wide by 135' long by 61.deep basin into the high ground. Piers and.pilings to ac- commodate five vessels are proposed in the basin. The basin is to accommodate the applicant's private vessels and remaining slips will be lent-leased or rented. The plans for the adjacent property are currently unsettled; however, a single family subdivision has been discussed with the a lica nt pp . 10. Anticipated im acts Conducting the project as proposed will involve the excavation of about 700 sq.ft. of smooth cordgrass, 2700 sq.ft. of shallow, subtidal, man-made basin area, and 11,450 sq.ft. of adjacent high ground for the proposed basin. Moore, Jr., for a Department of the Army permit to excavate a basin and construct piers and docks on the Harkers Island Harbor of Refuge, Harkers Island, Carteret County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included,,-.in the State authorization: a. An earthen plug will be left between the basin and the Harkers Island Harbor of Refuge until excavation landward of the plug has been completed. To prevent unnecessary sediments from reaching adjacent waters, 24 hours will be allowed to elapse before the plug is removed. b. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. c. Excavation will not exceed 6 feet below the elevation of mean low water (MLW). d. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or -2- adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. e. To offset the excavation and loss of the regularly flooded (Spartina alterniflora) wetlands, a smooth cordgrass fringe marsh not less than 900 square feet will be created within the basin.
