By copy of North Carolina Department of Natural Resources and
Community Development letter to you of September 16, 1986, we have
been informed that you have a significant problem regarding your
plans to accomplish work adjacent to the Harkers Island Harbor of
Refuge, Harkers Island, Carteret County, North Carolina. Until
you have settled matters with the Carteret County Harbor
Authority, we cannot give favorable consideration to Federal
authorization. Accordingly, your Department of the Army
application is hereby denied, with prejudice, and your file has
been retired.
Additionally, we received unfavorable comments from the U.S.
Fish and Wildlife Service (copy enclosed). Their reaction to your
proposal is the result of anticipated adverse impacts. I have
provided this Federal agency's comments to alert you to concerns
in addition to that identified in the State's letter. While
settling your problem with the Carteret County Harbor Authority is
the next step in pursuing State authorization, you should be aware
that Federal agency comments will be unchanged by the outcome of
that appeal. Because of the Federal agencies' influence on
Department of the Army permit decisions, it is unlikely a
Department of the Army permit would be available unless your
project is modified to consider their concerns.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Robert L. Moore pursuant to
an application filed on the 18th day of April, 1986 to place fill behind
a bulkhead associated with a boat basin.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of the Straits
in conjunction with the proposed boat basin #1 in Carteret County will
not result in a violation of applicable Water Quality Standards and
discharge guidelines. Therefore, the State of North Carolina certifies
that this activity will not violate Sections 301, 302, 303, 306, 307 of
PL 92-500 and PL 95-217 if conducted in accordance with the application
and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NTU's or less
are not considered significant).
2. That the fill placed behind the bulkheads, below
mean high water be done in such a way as to
minimize the turbidity in the Straits. Silt
screens should be utilized.
3. That the total area to be filled below mean high
water be less than one-half of an acre.
4. That the basin not dock any more than ten boats
at any time.
5. That a locked-head policy be posted and enforced.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Carteret County
The applicant proposes to perform excavation of a high ground basin
that was dug and not used. The project also includes replacement and
repair of existing free standing bulkheads. The applicant also
intends to excavate an entrance channel that may or may not have been
dredged previously. The project is on Harkers Island adjacent to the
Straits, classified SA and open to shellfishing.
The project has been reviewed to determine impacts to water quality.
The following comments are offered:
1. The project will require a 401 certification for the bulkhead
construction and should contain the following requirements:
a. That the fill placed behind the.bulkheads, below MHW be done
in such away as to minimize the turbidity in the Straits.
Silk screens should be utilized.
b. That the total area below MHW that is filled be less than
one-half one acre.
2. According to a memo from Nelson Paul to George Matthis, dated
7/7/86, this project should be considered a marina as defined by
DCM. The proposed project is located in open shellfishing. Bob
Benton of Shellfish Sanitation, has commented that the
construction of this marina would cause automatic closure of the
shellfishing in the immediate area. This would violate
antidegredation standards and the MOA between DEM, DCM and DHS.

9. Narrative description
This is the second in-a series of two proposals submitted by the appli-
cant for the development of boat basins and boat slips on his 65-acre
tract located adjacent to SR 1335 bordering The Straits and North River
on the west end of Harkers Island in Carteret County.
The Carteret County Harbor of Refuge divides the parcel into northern
and southern tracts and this particular development is for the recon-
struction of the existing boat basin on The Straits on the north side
of the northern parcel.
The land is about 4-6' in elevation with mature live oaks and pines
growing on sandy soils. Approximately 1500' of shoreline borders the
Straits characterized by a 10-30' wide sandy beach. Traces of subtidal
seagrass are evident in the MLW zone.
On the estreme western property line a basin exists apparently exca-
vated prior to permit requirements. This basin is about 150' square
and was dug entirely into the high ground with a-301 wide by 30' long
bulkheaded entrance channel. Bulkheads paralleling the shoreline ex-
ten4 about 250' in both directions from the edge to the bulkheaded
channel. The original bulkhead material was relic, recycled bridge
timbers.
In 1972, the applicant was issued a D&F permit (No. 691) to excavate a
harbor entrance to -7' MLW. This entrance was to be 130' offshore and
was to connect to the -5' MLW line. The record shows that the request
was not. a simple permit to issue, receiving objections from the adja-
cent riparian property owners and having much legal controvers?4
It is not known whether this access channel was ever actually dug; how-
ever.since construction, the basin was never used for any appreciable
amount, and the structures and land forms surrounding the basin fell
into disrepair. At the present time the bulkhead bordering the Straits
is only a skeleton of the original structure with the MHW level reaching.
up to 451-landward of this. A significant area of smooth cordgrass is
growing west of the bulkheaded channel and large amounts of sand are
clogging the channel entrance.
With this application, the applicant is proposing to reconstruct and
backfill the bulkhead before maintenance excavation in the basin, ex-
cavation of an access channel and construction of piers and docks to
accommodate five vessels:
10. Anticipated impacts
Construction of the bulkhead adjacent to The Straits and backfilling the
structure will result in filling 7,230 sq.ft. of intertidal area,
563 sq. ft. of which is smooth cordgrass marsh. Approximately 300 cu.
Yds. of fill material will be placed below MHW in this area, the bulkhead
being a maximum of 45' offshore at one place and averaging 25' offshore
over its entire length. Excavation of this access channel will involve
another 4,000sq.ft. of subtidal estuarine area, producing X600 cu.yds. of
spoil material which will be used in backfilling the bulkhead. The

maintenance will involve the excavation of 2,500 cu.yds. from 22,500
sq.ft. of man-made bottom, the area of which is evenly divided be-
tween intertidal and subtidal bottoms. Another 300 sq.ft. of in-
tertidal area will be filled in the areas around the basin in repair-
ing the bulkhead. Thls filling will involve approximately .10 cu.yds.
of fill placement below the MHW level.
Adjacent waters are classified as SA according to DEM and are cur-
rently open to shellfishing according to the Div. of Health Ser-
vices.

This office in the original review of these proposals by Mr. .
Moore did not consider the individual basins as "marinas" based
on the small number of slips and other facilities which were be-
ing proposed.-
Our further consideration indicates that the capabilities of
these basins are far in excess of the criteria used in the
"marina" definition as outlined in 15NCAC 7H.0208(b)(5). Be-
cause of this fact, review of these proposals should consider
these projects "marinas" as defined by Coastal Management regu-
lations.
Please take this into account in considering these two proposals
by Mr. Moore.

Concerning Mr. Moore's application Number 1, the Division of Marine
Fisheries has no biological objection to the excavation of the basin or access
channel in the vicinity. There are concerns, however, over the proposed
spoil disposal methods effects on the 560 square feet of marsh grass and the
extent of backfilling to the old bulkhead. Possible alternatives include
removal of spoil to another site to avoid covering the marsh and stabilizing
the channel entrance with riprap and abandoning the proposed backf illing of
the bulkhead. If these or other alternatives were incorporated in the
application to avoid destruction of the marsh grass, the Division of Marine
Fisheries would not recommend denial.

Reference the application of Mr. Robert L. Moore for a
Department of the Army permit to maintain a channel/canal, repair
and construct bulkheads and construct piers off The Straits,
Harkers Island, Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included;, n the
State authorization:
a. The existing bulkhead will not be backfilled. It may be
reconstructed on its present alignment as a breakwater structure
provided openings of not less than 24 inches are provided at
intervals of 10 feet or less. If a bulkhead is considered
necessary, it will be constructed at or landward of the mean high
water (MHW) elevation contour and any regularly or irregularly
flooded marsh vegetation.
b. All excavated materials will be confined landward of the
mean high water (MHW) elevation contour and any regularly or
irregularly flooded vegetated wetlands.
c. No excavated or fill materials will be placed at any time
in any vegetated wetlands or waters of the State.

d. Vegetated wetlands will not be excavated or filled.
e. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
f. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.

9. Narrative description
This is the second in a series of two proposals submitted by the appli-
cant for the development of boat basins and boat slips on his 65-acre
tract located adjacent to SR 1335 bordering The Straits and North River
on the west end of Harkers Island in Carteret County.
The Carteret County Harbor of Refuge divides the parcel into northern
and southern tracts and this particular development-is for the recon-
struction of the existing boat basin on The Straits on the north side
of the northern parcel.
The land is about 4-6' in elevation with mature live oaks and pines
growing on sandy soils. Approximately 1500' of shoreline borders the
Straits characterized by a 10-30 wide sandy beach. Traces of subtidal
seagrass are evident in the YILW .one.
On the estreme western property line a basin exists apparently exca-
vated prior to permit requirements. This basin is about 150' square '
and was dug entirely into the high ground with a 30' wide by 30' long
bulkheaded entrance, channel. Bulkheads paralleling the shoreline ex
ten4 about 250' in both directions from the edge to the bulkheaded
channel. The original bulkhead material was relic, recycled bridge
timbers.
In 1972, the applicant was issued a D&F permit (No. 691)to excavate a
harbor entrance to 7 MLW.. This entrance was to be 1301 offshore and
was to connect to the -5' MLW line. The record shows that the request
was not a simple permit to issue, receiving objections from the adja-
cent riparian property owners and having much legal controversy
It is not known whether this access channel was ever actually dug; how-
ever since construction, the basin was never used for any appreciable
amount, and the structures and land forms surrounding the basin fell
into disrepair. At the present time the bulkhead bordering the Straits
is only a skeleton of the original structure with the MHW level reaching
up to -45' landward of this. A significant area of smooth cordgrass is
growing west of the bulkheaded channel and large amounts of sand are
clogging the channel entrance.
With this application, the applicant is proposing to reconstruct and
backfill the bulkhead before maintenance excavation in the basin, ex-
cavation of an access channel and construction of piers and docks to
accommodate five vessels.
10. Anticipated impacts-
Construction of the bulkhead adjacent to The Straits and backfilling the
structure will result in filling 7,230.sq.ft. of intertidal area,
563 sq. ft. of which is smooth cordgrass marsh Approximately 300 cu.
Yds. of fill material will be.placed below MHW in this area, the bulkhead
being a maximum of. 45' offshore at one place and averaging 25' offshore
over its entire length. Excavation of this access channel will involve
another 4,000sq.ft. of subtidal estuarine area, producing 600 cu.yds. of
spoil material which will be used in backfilling the bulkhead. The
maintenance will involve the excavation of 2,500 cu.yds. from 22,500
sq.ft. of man-made bottom, the area of which'is evenly divided be-
tween intertidal and subtidal bottoms. Another 300 sq.ft. of in-
tertidal area will be filled in the areas around the basin in repair-
ing the bulkhead. Thls filling will involve approximately .10 cu.yds.
of fill placement below the MHW level.
Adjacent waters are classified as SA according to DEM and are cur-
rently open to shellfishing according to the Div. of Health Ser-
vices.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received May 30, 1986, for a
Department of the Army permit to maintain a channel/canal, repair
and construct bulkheads and construct piers off The Straits,
Harkers Island, Carteret County, North Carolina, indicates it to
be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of
Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act and Section 404 of the Clean Water Act, has been
assigned No. SAWC086-N-016-0332 and will be coordinated by

Department of the Army permit and a State Water Quality
Certification to maintain a channel/canal, repair and construct
bulkheads and construct piers off The Straits, Harkers Island,
Carteret County, North Carolina. Your receipt of this letter
verifies your acceptAace of a valid request for certification in

regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by July 30, 1986, the District Engineer
will deem that waiver has occurred.
