Reference your Department of the Army permit, issued April 7, 1986, which authorized the excavation of a basin area, construction of a pier and the installation of a pump platform and line in Pamlico Sound, Ducan's Creek Landing in Hatteras, Dare County, North Carolina. Your modification proposal, which was authorized by State permit No. 61-86 on September 3, 1986, has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080-N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) To avoid elevated turbidity levels during time periods of peak biological activity, excavation will not be permitted between the dates of March 1 through November 30 of any year without the prior approval of the N. C. Division of Coastal Management. (2) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (3) The disposal area effluent will be contained by pipe, trough, or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. (4) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. See attached sheet for Additional Conditions This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Midgett ADDITIONAL CONDITIONS Permit #61-86 Page 2 of 2 (5) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. (6) The temporary placement or double-handling of excavated or fill materials within waters or wetlands is not authorized. No marsh grass will be excavated and/or filled. (7) Excavation will not exceed 2 feet below the elevation of mean low water (MLW). (8) The excavated areas will be properly graded and provided a ground cover suffi- cient to restrain erosion within thirty (30) days of project completion. (9) The intake pipe will be elevated over the marsh to preclude the disturbance of that marsh. (10) The intake pipe and pump platform will be appropriately marked to avoid a potential navigational hazard. Standard waterway marking will be used. (11) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized structures. (12) The pier and pump platform will be properly maintained. NOTE: A copy of this permit is being forwarded to the Department of Administration, State Property Office from which you must receive an Easement prior to proceeding with ybur'project. NOTE: The proposed project is certified under General Water Quality Certification #1273 issued on November 10, 1978, for discharges of liquid effluent from diked upland disposal areas. NOTE: Because the intake line and pump platform will be located in relatively shallow water, some problems with the clam hatchery and crab shedders may be experienced. MAXTON MIDGETT BIO REPORT PAGE 2 SITE DESCRIPTION The applicant owns two lots on Duncan's Creek Landing off of Pamlico Sound near Hatteras, N.C. The two low lying lots are grassed and a single family residential structure has been constructed on the southern lot. The lots grade toward the water and a fringe of myrtle and Juncus marsh separates the highground from the shallow creek. The marsh has been staked and are delineated on the plat. The shallow creek deepens to 2-3 feet in the Pamlico Sound where the applicant states that he owns a shellfish lease or grant to raise clams. I cannot find a record of this lease or grant. The applicant proposes to develop a crab shedding and clam house with associated structures. The house will be constructed on highground, landward of the staked marsh line. In order to obtain clear water for the operation, the applicant proposes to run a 3" PVC pipe under the marsh and then raised on pilings 100 feet into Pamlico Sound to a proposed 6X6 foot pump platform. The return will run into Duncan's Creek adjacent to the shedding house. In order to obtain water access from his lot, the applicant proposes to dredge the shallow creek to make a 20 foot wide by 150 foot long by -2 foot basin which will adjoin with the -2 to -3 foot deep waters of Pamlico Sound. This work will be accomplished by dragline and all spoil will be placed on highgroun,d. Also proposed is a 6X20 foot pier over the marsh with a 6X30 foot "T" over the water. ANTICIPATED IMPACTS The dredging will create some short term elevated turbidity levels and should be timed to avoid peak biological activity. The dredging will result in the deepening of 3,000 square feet of shallow water habitat. The spoil will be placed on highground and must be graded and stabilized to prevent its erosion into the adjacent marsh. The placement of the water intake pipe under the marsh will result in the disturbance of 80 square feet of Juncus marsh. The pipeline extension into Pamlico Sound could create a navigational hazard unless properly marked. CAMA REVIEW The project site is classified as Transition in the Dare County Land Use Plan.
