Reference your application for a Department of the Army permit
to replace a commercial docking facility on the Atlantic
Intracoastal Waterway (AIWW), Bogue Sound, Cedar Point Community,
Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

On February 6, 1986, we renewed general permit No. SAWCO80-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 11, 1986, for a
Department of the Army permit to construct a private commercial
docking facility and to remove your existing docking facility in
Bogue Sound at your property located in the Cedar Point community,
Carteret County, North Carolina, indicates it to be a candidate
for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be
accomplished by the North Carolina Division of Coastal Management.
Comments from Federal review agencies will be furnished to the
State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act has been assigned No. SAWC086-N-016-0235 and will be
coordinated by Mr. David Baker, telephone (919) 343-4642. He is

The project site is located on the south side of Hwy. 24 in the
community of Cedar Point on the AIWW of Bogue Sound near Swans-
boro, but in Carteret County. This exclusive residential lot
consists of approximately .86-acres of high ground and is iden-
tified as Lot No. 22 in the John S. Jones Subdivision. The
existingtw'o-story house is the most dominant feature on the
lot and is reported to be the old original Coa,sta Guard Station
transported from its site in Emerald Isle some years ago.
Mr. Sam Brown Meadows, III, who is the applicant, recently pur-
chased this property as a place of residence for his family.
Mr. Meadows makes his living by commercial fishing the open wa-
ters of the Atlantic Ocean, particularly in the Onslow Bay area
near Bogue Inlet just south of his home location. Mr. Meadows'
trawler measures 61' long by 18' wide and is currently moored
some 1600' to the east at a friend's private dock. Now that
Mr. Meadows lives near the inlet, he proposes to build a new
dock replacing an old existing pier-structure so that his com-
mercial fishing boat can be tied up in his own backyard. The
work plat drawing shows that the overall length of the proposed
new dock will be some 10-15' shorter than the old existing pier
at the property. The closest edge of the AIWW is approximated
to be 90' away. The accompanying blueline tax map photo shows
clearly the relationship and position of the existing pier struc-
tures in the area.and at Mr. Meadows' property.`
The main leg of the proposed dock will measure 80' long by 10'
wide. A T-head platform will be constructed'measuring 64' long
by 10' wide. The purpose of the 10' width of the proposed pier
is to accommodate a pickup truck to remove and repair the large
nets and trawl doors. No outside mooring piles are required in
the design of this dock; however, the 18' wide trawler boat
will lay parallel to the T=head pier.
The water depth of the outboard end of the proposed pier measures
-6' on MLW. The applicant owns at least 150' of bulkheaded wa-
terfront shoreline property and the new proposed dock will be
situated in the center of the property. No portion of the dock
will be within 151.of the sidelines of the property.
Anticipated impacts

The proposed dock should have little to no impact on the local
marine ecology of the Cedar Point area. The project appears to
be consistent with the 7H Use Standards for construction in the
estuarine waters AEC. A review of the LUP indicates that no de
velopment.constraints exist for this unincorporated area of Car-
teret County.

Dear Mr. Parker:
Reference the application of Mr. Sam B. Meadows III, for a
Department of the Army permit to replace a commercial docking
facility on the Atlantic Intracoastal Waterway (AIWW), Bogue Sound
adjacent to your property in the Cedar Point Community, Carteret
County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. The permittee's scheme of development, of which the
authorized work is a part, contemplates the presence of structures
and their attendant utilities on lands subject to an easement in
favor of the United States for the operation, maintenance,
improvement, and enlargement of the Atlantic Intracoastal Waterway
(AIWW). Accordingly, the permittee will be required to remove
such structures and improvements at his own expense in the event
that, in the judgment of the U.S. Army Corps of Engineers acting
on behalf of the United States, the lands are needed at any time
for any purpose within the scope of the easement. Permanent
buildings will not be constructed in areas subject to easement.
b. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work.

c. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and
signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.
d. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the permitted structure and the safety
of ,moored boats from damage by wavewash. The permittee will not
hold the United States liable for any such damage.
e. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without transferring it to a third
party.

authorizing development in Carteret County at Bogue Sound and the AIWW at Cedar
Point as requested in the permittee's application dated 4/5/86 including

This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) The construction of the proposed dock will be in conformance with the attached
work plat drawing.
(2) The activity will be conducted in such a manner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.
(3) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
work.
(4) The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without transferring it to a third party.
NOTE: It is possible that the authorized structure may be damaged by wavewash
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31. 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

9: Narrative description
The project site is located on the south side of Hwy. 24 in the
community of Cedar Point on the AIWW of Bogue Sound near Swans-
boro, but in Carteret County. This exclusive residential lot
consists of approximately .86-acres of high ground and is iden-
tified as Lot No. 22 in the John S. Jones Subdivision. The
existingtw'o-story house is the most dominant feature on the
lot and is reported to be the old original Coa,sta Guard Station
transported from its site in Emerald Isle some years ago.
Mr. Sam Brown Meadows, III, who is the applicant, recently pur-
chased this property as a place of residence for his family.
Mr. Meadows makes his living by commercial fishing the open wa-
ters of the Atlantic Ocean, particularly in the Onslow Bay area
near Bogue Inlet just south of his home location. Mr. Meadows'
trawler measures 611 long by 18' wide and is currently moored
some 1600' to the east at a friend's private dock. Now that
Mr. Meadows lives near the inlet,.he proposes to build a new
dock replacing an old existing pier structure so that his com-
mercial fishing boat can be tied up in his own backyard. The
work plat drawing shows that the overall length of the proposed
new dock will be some 10-15' shorter than the old existing pier
at the property. The closest edge.of the AIWW is approximated
to be 90' away. The accompanying blueline tax map photo shows
clearly the relationship and position of the existing pier struc-
tures in the area.and at Mr. Meadows' property.
The main leg of the proposed dock will measure 80' long by 10'
wide. A T-head platform will be constructed measuring 64' long
by 10' wide. The purpose of the 10' width of the proposed pier
is to accommodate a pickup truck to remove and repair the large
nets and trawl doors. No outside mooring piles are required in
the design of this dock; however, the 18' wide trawler boat
will lay parallel to the T=head pier.
The water depth of the outboard end of the proposed pier measures
-6' on MLW. The applicant owns at least 150' of bulkheaded wa-
terfront shoreline property and the new proposed dock will be
situated in the center of the property. No portion of the dock
will be within 151.of the sidelines of the property.
10. Anticipated impacts
The proposed dock should have little to no impact on the local
marine ecology of the Cedar Point area. The project appears to
be consistent with the 7H Use Standards for construction in the
estuarine waters AEC. A review of the LUP indicates that no de-
velopment constraints exist for this unincorporated area of Car-
teret County.
