This permit, issued on b is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead alignment will approximate the mean high water level. (2) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (3) An earthen plug will be left between the inland canal and the Northeast Cape Fear River until excavation landward of the plug has been completed. To prevent unnecessary sediments from reaching adjacent waters, 24 hours will be allowed to elapse before the plug is removed. (4) Excavation will not exceed 4 feet below the elevation of mean low water (MLW). (5) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (6) The instream turbidity shall not be increased by more than 50 NTUs as a (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. The applicant proposes to provide boat access for his property by constructing a simple pier and the excavation of a boat slip. William G. Mathis Page 2 9. PROJECT DESCRIPTION: The project is located on the west bank of the Northeast Cape Fear River. The isolated nature of the location is such that one should probably contact the applicant to arrange for a meeting. However for the more adventuresome the following directions are provided. Locate the intersection of S.R. 1411 and S.R. 1509 in Pender County. (Just east of Burgaw.) Travel approximately one mile south on S.R. 1411. Two paths will be on your left. One has a yellow iron gate. Select the non-gated path on the north (blue-flagged) and travel along both sides of an existing field ditch approximately 0.5 miles. Turn right between two fields and travel across to the opposite side. Turn left and then look for a newly cleared road on the right (again marked with blue flagging). Travel down the road to the river and the project site. The project is located along the bank of the river on separate high knolls (see field sheet). The applicant is proposing a bulkhead along the shoreline and around a proposed boat slip. A pier will be constructed approximately 170' south of the boat slip. The bulkhead will be aligned at or above mean high water for 42' along the bank. It will then turn to surround a boat slip. The dimensions of the slip are approximately 30' x 8. Approximately 20' of the length is in highground. The other 10' is offshore. The proposed depth is -4' at MLW. Approximately 50 cubic yards of material will be excavated by backhoe and will be retained on highground behind the proposed bulkhead. The pier will be constructed on a separate piece of highground. The pier will extend 8' from mean high water and will also have a 6' x 12' "L" and the waterward end. 10.
