The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The riprap material will not be positioned farther than 5 feet waterward from the face of the exisiting bulkhead. b. No riprap material or any other fill material will be placed in vegetated wetlands. c. The temporary placement or double handling of riprap material within waters or vegetated wetlands is not authorized. d. The riprap material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. ,A* -2- e. The activity will be conducted in such a manner as to prevent a significant increase i-Li turbidity outside the area of construction or construction-related discharge. Under the administrative rules of our regulatory program, denial of required State authorization precludes favorable consideration of a Federal permit. Accordingly, your Department of the Army application is hereby denied, and your file has been retired. Additionally, we received unfavorable comments from the U.S. Fish and Wildlife Service and the National Marine Fisheries Service (copies enclosed). Their reaction to your proposal is the result of anticipated significant adverse impacts. I have provided these Federal agencies' comments to alert you to concerns in addition to those identified in the State's denial letter. While appealing the State permit is the next step in pursuing State authorization, you should be aware that Federal agency comments will be unchanged by the outcome of that appeal. Because of the Federal agencies' influence on Department of the Army permit decisions, it is unlikely a Department of the Army permit would be available unless your project can be modified to lessen its impacts. Forbes Land Corporation for Coastal Area Management Act (CAMA) Major Development and State Dredge and Fill permits to backfill behind an existing bulkhead on Croatan Sound. The project site is located on the Sound at Manns Harbor off of Croatan Way in Dare County. Processing of your application, including onsite inspection and plan review by cooperating state and Federal agencies, is now complete. Based on this review, this office has made the following findings: 1) the existing bulkhead structure is not authorized under state or Federal law; 2) approximately 4050 square feet of shallow water area behind the existing bulkhead is proposed to be filled. This shallow water serves as habitat for juvenile marine species and provides an important contribution to the quality of Croatan Sound. The loss of this area is considered significant from a cumulative standpoint; 3) the amount of fill requested has been objectea to by five cooperating review agencies; 4) the requested fill and bulkhead has been determined to be inconsistent with the following partial listing of Rules of the Coastal Resources Commission: a) 07H.0206(c) Management Objective. Bulkheads for the purpose of shoreline stabilization must approximate mean high water or normal water level; 07H.0208(b)(7)(d) bulkheads may extend below the normal water level to recover the area eroded in the past year. It is noted that the shoreline erosion rate in the project area is estimated at two (2) feet per year. Because of the foregoing, it is necessary that your application request be denied. This denial is pursuant to N.C.G.S. 113-229(e)(5) the dredge and fill law which provides for denial when a project proposal would cause an adverse impact on marine resources and 113-120(2) and (8) which requires denial when the proposal would be denied under the dredge and fill law and anytime it is inconsistent with state guidelines, i.e., Rules of the Coastal Resources Commission. It should be noted that review agencies would be favorable to relocating the bulkhead on an alignment averaging two (2) feet waterward of the normal water level, not to exceed five feet. Should you wish to puruse such align- ment, this office stands ready to assist you and to provide an expedited review. If you wish to appeal this denial of your application request, you should apply in writing within twenty (20) days to Mr. Ralph Cantral, Assistant Director at 919/733-2293. Mr. Cantral is prepared to discuss this matter with you and provide assistance necessary in filing such petition or appeal'. Also, you should be advised that as long as this State permit denial stands, your project must be deemed inconsistent with the N. C. Coastal Management program, thereby precluding issuance of Federal permits for this project. The Federal Coastal Zone Management Act of 1972 (CZMA) gives the right to appeal this finding to the U. S. Secretary of Commerce, within 30 days of receipt of this letter. Your appeal must be based on the grounds that the proposed activity is (1) consistent with the objectives or purposes of the CZMA, (2) is necessary in the interest of national security, and thus, may be federally approved. We recommend that the following conditions be included in the State authorization: a. The bulkhead will not be positioned farther waterward than an average of 2 feet or 5 feet at any point along its alignment from the normal water level (NWL) elevation contour. This will provide sufficient space to negotiate trees and connect to adjacent bulkheads. To ensure compliance with this condition, representatives of the North Carolina Division of Coastal Management and the Corps of Engineers will be available to stake the authorized alignment prior to construction. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or debris will not be used. FORBES LAND COMPANY BIO REPORT PAGE 2 SITE DESCRIPTION An application has been circulated for this request and then put on hold pending receipt of accurate plats. This circulation contains the additional information. The applicant owns a lot on the Croatan Sound at Manns Harbor in Dare County. The sandy soils support some pines and scrub vegetation and gently slopes to the waters edge. No marsh vegetation exist along the shoreline. Approximately thirty feet beyond the normal water contour, an old delapidated bulkhead has been repaired without authori- zation from the state or federal agencies. The annual erosion rate in this area is two feet. The property to the north is bulkheaded and backfilled and the property to the south has an old bulkhead which is not functional and is not backfilled•. The applicant is requesting authorization to backfill the repaired but unauthorized bulkhead. ANTICIPATED IMPACTS The backfilling of the unauthorized bulkhead will result in the filling of 4,050 square feet of shallow water habitat. CAMA REVIEW The project site is classified as community in the Dare County LUP. This project is consistent with that classification. Language in the text states "the use of bulkheads to prevent erosion is an example of uses thet may be acceptable within public trust areas, provided that such use will not be detrimental to the public trust rights and the biological and physical functions of the estuary". If a finding is made 'that this proposal would be detrimental to the public trust rights and the biological and physical functions of the estuary, the proposal would be inconsistent with the'land use plan.
