Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will be constructed along the alignment of the deteriorated bulkhead. (2) All backfill material will be obtained from a highground source and confined behind the permitted bulkhead. (3) The fill material will be clean and free 'of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. The backfill material will be properly graded and pr ided a ground cover sufficient to restrain erosion within thirty (30) days of project completion. (5) The activity will be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. NOTE: The proposed project is certified under General Water Quality Certification No. 1272 issued on November 10, 1978, for bulkhead construction. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be constructed, in strict accordance with permit plans, on the alignment of the deteriorated bulkhead. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. The fill materia will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. A review of your application received August 13, 1986, for a Department of the Army permit to construct and backfill a bulkhead on Coinjock Bay, near Maple, in Currituck County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. LEE FAST TRACK BIO REPORT PAGE 2 SITE DESCRIPTION: The applicant owns two residential lots on Coinjock Bay at Woodard Acres. The two lots are very low, however support a mobile home which is serviced by a septic tank and drain field. A review of the aerial photography dated 18 December 1984 indicates that lot #13 was bulkheaded and backfilled except for an area where the boat ramp existed. The photos indicated that 1/2 of lot 14 was bulkheaded and backfilled, however a section of this bulkhead was down and had approximately six feet of water behind it. The adjacent lots on either side were bulkheaded. On 10 October 1985 our office issued an exemption letter to the applicant's neighbor to repair his bulkhead which was damaged by Hurricane Gloria. I visited the applicant's property on 21 November 1985 and determined that the damaged bulkhead would require a CAMA permit to replace. My site visit on 7 August 1986 revealed that the shoreline has eroded excessively and the only portion of the bulkhead remaining is from the boatramp west. The neighbors have begun repair of their bulkhead but have not made much progress in a long time. Only pilings and whalers have been installed. The applicant is requesting authorization to construct a bulkhead along the old .alignment which -will result in an al i-gnment 10 feet. waterward of normal water level. The area has been lost since Hurricane Gloria except for 1/2 of lot 14 which was damaged prior.to 18 December 1984. ANTICIPATED IMPACTS: The bulkhead construction will result in some elevated turbidity levels but they will be localized and short term. The backfilling will result in the loss of 1,320 square feet of shallow water habitat. CAMA REVIEW: The project site is classified as rural in the Currituck LUP.
