This permit, issued on July 11 , 1986 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The activity shall be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge (increases of 25 NTUs or less are not considered significant). (2) This permit does not authorize interference with the 8-foot-deep, 80-foot-wide federal channel in Wrights Creek and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. The pier will not be constructed closer than 80 feet to the near edge of the Federally maintained channel. (3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (4) It is possible that the authorized structure may be damaged by wavewash by passing vessels. The issuance of this permit does not relieve the permittee from taking all possible steps to ensure the integrity of the permitted structure and the safety of moored boats from damage by wavewash. (See attached sheet for Additional Conditions) 1 This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Frmvirorm-ental setting The applicant awns + 4.0 acres of land bordering Wrights Creek in Beaufort County. Located on the land is a single family dwelling which is served by a septic tank sewage disposal system. The portion of the property on which the dwelling is located has had riprap placed along the shoreline in the past to retard erosion. Located on the property is a 60' long pier which the applicant uses to moor his oaaoercial fishing vessel. Wrights Creek has a federally maintained channel. Proiect proposal The applicant is proposing to lengthen the existing 60' long pier to 110' in length. The additional length is needed for properly mooring the commercial vessel. The water depth at the wateiward end of the proposed pier will be -9' at normal water. Also the waterward end of the proposed pier will be 83' from the near edge of the federally maintained channel. Environmental impact The project as proposed should have a minimal environmental impact. David L.
