Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. This permit, issued on 7/aga/OV , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) In order to protect juvenile shrimp and fin fish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management. (2) No marsh grass will be excavated and/or filled. (3) Excavation will not exceed 4 feet below the elevation of mlean low water (MLW). The canal's maximum (top) width will be maintained no wider than 15 feet. (4) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTUs or less are not considered significant. (5) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the plat. (See attached sheet for Additional This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Jones for a Department of the Army permit to maintain a canal and basin and construct a boat ramp off the Brunswick River near Leland, Brunswick County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. The area, north of and parallel to the canal, used to retain the material resulting from the original excavation of the canal has completely reverted to vegetated wetlands; and therefore, it is not acceptable as a retention area for the proposed maintenance. Double-handling of excavated material would cause significant damage and is not practical. Thus, as the work cannot be accomplished by dragline, the following conditions are based on using a small hydraulic dredge. We recommend that the following conditions be included in the State authorization: a. In order to protect juvenile fin fish populations, no excavation will be permitted between the dates of March 1 and November 30 of any year without the prior approval of the U.S. Fish and Wildlife Service. b. The area north of and parallel to the canal will not be used to retain excavated materials. Prior to commencement of l* -2- ?. A work, a high ground retention area will be identified and approved by the Corps of Engineers. c. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded wetlands within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. d. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. e. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. f. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and resultant unnecessary siltation. g. Excavation will not exceed 4 feet below the elevation of mean low water (MLW). The canal's maximum (top) width will be maintained no wider than 15 feet. h. No wetland vegetation will be excavated. i. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Jones Page 2 9(a) SITE DESCRIPTION: The project site is located along the Brunswick River .l mile North of the inter- section of S.R. 1464 with S.R. 1703 in a small subdivision in Leland behind the Wilson's grocery store along U.S. 74-76. The applicants lot is located at the end of Fairview Drive on a high bluff over looking the river. A new residence is being built on the property. An existing 15' wide by 250' long access channel and 15' x 30' boat basin is found at the base of the hill. It goes almost dry during low tidal conditions. The:bottom consists of mud and silt and marsh on either side of the channel consists predominantly of cattail (Typha spp.). A few scattered patches of sawgras (Cladium spp.) and arrowhead (Sagittaria latifolia) are found along the boat basin. A thin fringe of giant cordgrass (Spartina cynosuroides) lines the edge of the channel. A 300' long by 15-20' spoil berm follows the edge of the channel where dragline spoil was placed previously. It is vegetated with a mixture of upland grasses and remnant sedges. The site is a primary nursery area and the waters are S.A. 9(b) PROJECT DESCRIPTION: The applicant wishes to perform maintenance excavation of the 15' x 250' boat access channel and 15' x 30' boat basin to a -4' depth. Also he plans to install a concrete boat ramp which will messure 15' x 20' along the bank of the basin. It will require #10 cubic yards of concrete to be placed below the MHW contour. Also approximately 950 cubic yards of mud bottom will be removed by dragline to the adjacent 300' x 15' spoil area. A silt fence is to be aligned around its perimeter. 10. ANTICIPATED IMPACTS: This maintenance activity as proposed will cause the excavation of ±125 s.f. of giant cordgrass and cattail marshland along the edge of the channel as well as ±4,075 s.f. of relatively productive bottom. Also ±25 s.f. of arrowhead and sedges will be filled due to the ramp. A mixture of upland grasses and wetland sedges and some cattail marsh will be disturbed by the spoil placement. It will be very important that adequate spoil barriers be placed around the perimeter of this narrow spoil site to prevent accidental filling of adjacent high marsh areas.
