Box 13091 Greensboro, NC 27405 Dear Mr. Jennings: Subject: 'Application for Water Quality Certification Richard Jennings Ocean Isle Brunswick County Your application dated October 21, 1985, for a Water Quality Certification under Section 401 of the Federal Clean Water Act as Amended has been reviewed by our staff. Your proposal is to maintenance dredge an existing boat basin, reconstruct a deteriorating bulkhead and construct a boat ramp and dock adjacent to the Atlantic Intracoastal Water Way near Ocean Isle Beach. The issuance of a Water Quality Certification is a finding by this Division that the proposed activity will not cause a violation of water quality standards or discharge guidelines. There is an aspect of the project which causes us considerable concern as to the effect on water quality standards in these waters which are classified SA. This is the fecal coliform that is in sewage which can discharge from boats into the proposed marina basin. Sewage discharged from boats in the boat basin will cause a violation of the fecal coliform standards. In order for us to conclude that sewage discharge from boats will not occur, we would have to be satisfied that the project can and will prevent sewage discharge from boats on a long-term basis. Past experience has been that just providing marine pump-out facilities is insufficient to prevent sewage discharges from occurring. Further we will need to know specifically the type of upland development and marina services you intend for this area so that other aspects of the project such as stormwater runoff can be evaluated. Your Application for a Water Quality Certification is hereby denied. Should you redesign the project from the standpoint of boat operation in such a manner as to satisfy our concerns for water quality protection, I will reconsider this denial. It is suggested that you work closely with our Wilmington Regional Office in any redesign of the proposed project. You do have the right to a review by the Environmental Management Commission, if the denial is unacceptable to you. Your request for Commission review must be in writing, identifying the specific items to be contended, within 10 days of your receipt of this denial. Dear Colonel Hanson: This is in response to the subject public notice proposing to perform maintenance excavation of an existing boat basin and rebuild several deteriorated structures at the old Camp Atlantic Boys Camp, east of Shallotte Blvd., along the AIWW, Brunswick County, North Carolina. The proposed activity involves the dredging of an existing boat basin down to -6 ft. MLW depth and pumping the 17,000 cy. yds. of spoil material to a diked disposal area. The applicant also intends to repair an existing "T" shaped dock and boat ramp to their original specifications. However, the majority of the planned 800 ft. bulkhead repair, is new work and is an attempt to reclaim land that has been eroded. As a result of this activity, approximately 4.6 acres of shallow water bottom habitat will be eliminated by dredging. The proposed bulkheading alignment would directly fill 620 sq. ft. cordgrass ( rtina alterniflora), 1,140 sq. ft. of salt marsh hay ( rtina patens), and 9,600 sq. ft. of intertidal mud/sand bottom. Based on telephone conversations with biologists that have visited the project site, it is apparent that the area exibits no significant sign of previous dredging and, in general, has reverted to a natural productive aquatic system. It should also be noted that the project area is classified by the State of North Carolina as a primary nursery area and is classified as S.A. waters. It is evident that the proposed activity will result in the loss of a valuable aquatic resource, and will cause an unacceptable adverse environmental impact. Consequently, it is our opinion that the subject permit application is contrary to the 404 guidelines and should be denied. Sincerely yours, William L. C. `t'E : Dear Mr. Moul: I have today received today a letter from R. Paul Wilms in the Division of Enviromental Management, denying certification. I then spoke with Bill Mills of the same office, after which I tried to reach Preston Howard (unsuccessfully), and then with John Parker. From the Division of Envoromental Management, the primary concern appears to be sewer discharge from boats in a "marina.'' Mr. Mills called my attention to my application (V-A-2) stating the purpose as - "Commercial Marina." PROJECT DESCRIPTION: The project site is located on a seven acre upland site just east of the old Brick Landing Ferry site which adjoins Shallotte Boulevard along the AIWW in Ocean Isle Beach. A 600' long dirt street known as 7th Street gives access to the site. The relatively low tract is principally made up of Madeland Soils through dredge and Fill operations in the past. It has a 4.1 acre "U" shaped upland disposal site with a 4'-6' high earthen dike in good repair around its entire perimeter. An existing 400' by 500' boat basin connects to the AIWW as illustrated on the attached plats. It has shoaled in to a -2' (MLW) depth. The Camp Atlantic Marina house burnt to the ground last year and it served as'a marine center for the Boys Camp which ran from ocean to sound during the 60s and early 70s. Remnants of a 14' wide by 30':cement boat ramp and a 140' long by 8' wide dock exists on the tract. Also a deteriorated-wooden .bu ead can be seen. 30' to 40' below the MW contour. The two most northern fingers of the tract have experienced severe erosion. Field observations place it near 101/year. Brick and cement rubble lies along the 3' escarpment and the erosion has just about cut landward of the old ramp. The boat basin was previously used by a Virginia dredging company in the past few years as a permanent :mooring site.for its large equipment. The area 3s classi- fied as a primary nursery area and the waters are SA. The applicant let his earlier state permit #130-74 expire for the maintenace excavation work. He still plans to dig the basin down to -6 MLW depth and pump the 17,000 cubic yards of dredge spoil to the diked disposal area. The applicant also wishes to repair his "T" shaped dock and boat ramp in the same dimensions as the existing deteriorated ones. The bulkhead, however, has failed so badly that only 3" to 8" stubs stick out of the mud bottom 30'-40' below MHW at places. Much of the proposed 800' of bulkheading is new work and is an attempt to reclaim land that has been eroded. The purpose of the work is to upgrade the site back to its previous condition when the boys camp was using it regularly.. 10. ANTICIPATED DWACTS: The project will cause the disturbance and loss of approximately 4.6 acres of primary nursery habitat which was previously dug in the past 10 years. The proposed bulkheading..alignment would directly fill 620 s.f. of cordgrass (Spartina alterniflora) and 1,140 s.f. of salt marsh hay (Spartina patens). In addition 9,600 s.f. of mud bottom/sand intertidal will be filled by the bulkheading. An estimated 4.1 acres of, Estuarine Shoreline will be filled behind the existing dikes. Turbidity impacts may::` be great with the dredging activity. Its timing may be crucial to avoid significant' biological cycles.
