Reference your application for a modification to Department of
the Army permit to place fill material in the waters and wetlands
of Mill Creek associated with the installation of a sewer
interceptor in Jacksonville, Onslow County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable, modified State authorization
and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in
a violation of Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

Reference the September 15, 1986 request of the City of
Jacksonville for a modification to State and Federal
authorizations to place fill material in the waters and wetlands
of Mill Creek associated with the installation of a sewer
interceptor in Jacksonville, Onslow County, North Carolina. The
newly proposed work includes two additional subaqueous crossings
in the upper reaches of the New River.
We have no objections to this modification and do not
recommend any additional conditions for inclusion in State
authorizations.

CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Iaws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to City of Jacksonville
pursuant to an application filed on the 16th day of October, 1986 to
place fill in Mill Creek and Hammonds Branch for sewer line crossings.
The Application provides adequate assurance that the discharge of
fill material into a wetlands area adjacent to the waters of Mill Creek
and Hammonds Branch in conjunction with the proposed sewer line
crossings in Onslow County will not result in a violation of applicable
Water Quality Standards and discharge guidelines. Therefore, the State
of North Carolina certifies that this activity will not violate Sections
301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in
accordance with the application and conditions hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the Stream is 25 NT(J's or less
are not considered significant).
2. That any, fill used in the bedding and filling of
the subaqueous creek crossings be clean and free
from any toxic materials.
3. That the temporary'placement of the spoils in the
swamp-area be done in such a way that will minimize
the areal extent of impact.
4. That the applicant restore the swamp area to its
original condition as proposed.
Violations of any condition herein set forth shall result in
revocation of this Certification.
This Certification shall become null and void unless the above
conditions are made conditions of the Federal Permit.

Onslow County
The applicant proposes two subaqueous creek crossing to complete
their sewer service expansion project. The crossings involve Mill
Creek and Hammonds Branch measuring 20 feet and 35 feet across,
respectively, by 2.5 feet wide. Both Mill Creek and Hammonds Branch
are classified SC. Included in the project is the temporary
placement of spoils in 404 wooded swamp area.
The project has been reviewed to determine impacts to water quality.
The following comments are offered:
1. The project will require a 401 certification for the subaqueous
crossing and the temporary fill of the 404 area. The following
condition should be incorporated into the certification.
a. That any fill used in the bedding and filling of the
subaqueous creek crossings be clean and free from any toxic
material.
b. That the construction be done in such manner that turbidity
increases not exceed 25 NTUs.
c. That the temporary placement of the spoils in the swamp area
be done in such a way that will minimize the area$ extent of
impact.
d. That as proposed the applicant restore the swamp area to its
original condition.
This office has no objection to the project as proposed provided the
above conditions are met.

Narrative description
The City of Jacksonville needs to modify their existing major
CAMA Permit No. 194-85, to allow for two minor (subaqueous) creek
crossings of their ongoing sewer expansion project along Mill Creek
and another small tributary of the Upper New River above the Hwy.
17 bridge in Onslow County.
Last year state and federal authorization was given to the City to
install a 30" pipeline crossing in Mill Creek near the Hender-
son Drive intersection. Since that time, the pipeline work has
continued throughout the various residential developments which
border the upper reaches of Mill Creek and Hamptons Branch.
Today, a redesign in the pipeline system calls for two additional
creek crossings both of them near River Street, The first location,
known as MH No. 9A will make a 201 crossing of Mill Creek in a
very developed area of the city. The new primary sewer line has
already been installed along the NW side of the existing creek.
These are SB inland waters of the state that receive runoff water
from a well developed urban area. The SE shoreline at this loca-
tion is well stabilized by a concrete bulkhead as shown on the work
plat drawings. In addition, most of the high ground immediate to
.the concrete bulkhead is also covered with impervious surface areas
in the form of concrete and asphalt driveways. As proposed, a 2.51
wide ditch will be excavated across the creek. Once the pipeline has
been installed, the ditch will be backfilled with bedding stone and
protective concrete encasements.
The second site is known as MH 12A and is located close to Hickory
Court. This is a neighborhood characterized by more upper class
homes that have been built in the past 10 years. The proposed sewer
pipeline will cross a 351 section of the creek known as Hamptons Branch
and a 401 section of woodedcwamp area. About 25 cu.yds. of spoil
will be removed from this location and temporarily stockpiled in the
wooded swamp before being removed from the site. No coastal wetlands
are present at either of the two sites, and the applicant proposes to
restore all affected surface areas.
Anticipated impacts
This project should be conducted in the winter months of the year
when juvenile finfish populations will not be impacted. Construction
techniques employed by the contractor will greatly reduce the down-
stream silt and sediments during the installation phase.

Narrative description
The City of Jacksonville needs to modify their existing major
CAMA Permit No. 194-85, to allow for two minor (subaqueous) creek
crossings=of their ongoing sewer expansion project along Mill Creek
and another small tributary of the Upper New River above the Hwy.
17 bridge in Onslow County.
Last year state and federal authorization was given to the City to
install a 30" pipeline crossing in Mill Creek near the Hender-
son Drive intersection. Since that time, the pipeline work has
continued throughout the various residential developments which
border the upper reaches of Mill Creek and Hamptons Branch.
Today, a redesign in the pipeline system calls for two additional
creek crossings both of them near River Street, The first location,
known as MH No. 9A will make a 20' crossing of Mill Creek in a
very developed area of the city. The new primary sewer line has
already been installed along the NW side of the existing creek.
These are SB inland waters of the state that receive runoff water
from a well developed urban area. The SE shoreline at this loca-
tion is well stabilized by a concrete bulkhead as shown on the work
plat drawings. In addition, most of the high ground immediate to
the concrete bulkhead is also covered with impervious surface areas
in the form of concrete and asphalt driveways. As proposed, a 2.5'
wide ditch will be excavated across the creek. Once the pipeline has
been installed, the ditch•will•be backfilled with bedding stone and
protective concrete encasements.
The second site is known as MH 12A and is located close to Hickory
Court. This is a neighborhood characterized by more upper class
homes that have been built in the past 10 years. The proposed sewer
pipeline will cross a 35' section of the creek known as Hamptons Branch
and a 40' section of woodedcwamp area. About 25 cu.yds. of spoil
will be removed from this location and temporarily stockpiled in the
wooded swamp before being removed from the site. No coastal wetlands
are present at either of the two sites, and the applicant proposes to
restore all affected surface areas.
Antici2ated impacts
This project should be conducted in the winter months of the year
when juvenile finfish populations will not be impacted. Construction
techniques employed by the contractor will greatly reduce the down-
stream silt and sediments during the installation phase.
