This permit, issued on f/? VG , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will not be positioned farther waterward than an average of 3 feet nor a maximum of 6 feet from the normal water elevation contour at any point along its alignment at the time of construction. To prevent an unintentional violation of this authorization, representatives of the N. C. Division of Coastal Management and the Corps of Engineers are available to stake the alignment before construction. (2) All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. (3) All fill material to be placed below the NWL will be confined behind the permitted bulkhead. (4) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. (5) No marsh grass will be excavated and/or filled. (See attached sheet for Additional Con This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit myst be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Pr,0j'ec11a5&Aifl?r? and boat ramp at property on SR 1711, adjacent to Clubfoot to I Creek, Craven County 1. 9. -Narrative description The applicant's property is a half acre tract located adjacent to Clubfoot Creek off SR 1711 in Craven County. The property is charac- terized by sandy soils and elevations range from 2' adjacent to the water on up to 9' at the landward end of the parcel. The property is vegetated with domestic yard species, overstoried by live oaks and pine. The structure on the site is the applicant's block residence, a dog pen, and a large frame garage. The shoreline is characterized by several attempts at erosion control,. the most recent being the place- ment of very small rocks from an adjoining project. These extend from the bank offshore about 5' and are very scattered. Some small pieces of marl are also in this nearshore area. (*) The applicant's proposal is to contruct a bulkhead with backfill along the shoreline. The bulkhead is to average approximately 3' offshore along its length, and will be as much as 6' offshore in one location where it turns offshore to a far point on the property. A boat ramp will be constructed in the area immediately adjacent to the pier and this will include two 14' wing-walls which will extend offshore adjacent to the 14' wide by 20' long concrete boat ramp. 10. ANTICIPATED IMPACTS Conducting the project as proposed will involve the disturbance of . approximately 560 sq.ft. of open brackish water habitat with fill ma- terial. Of this, about 280 sq.ft. will be filled by the proposed bulkhead construction and another 280 sq.ft. will be filled by the proposed boat ramp construction. Highground grading surrounding the project will involve another 2000 aq.ft.. Adjacent waters are classi- fied as SA by DEM and are currently closed to shellfishing by the Div. of Health Services. Clubfoot Creek in this area is not a desig- nated primary nursery area; however, Mitchell Creek, which is within close proximity of the project, is a designated primary nursery area by DMF. Narrative description The applicant's property is a half acre tract-located adjacent to Clubfoot Creek off SR 1711 in Craven County. The property is charac- terized by sandy soils and elevations range from 2' adjacent to the water on up to 9' at the landward end of the parcel. The property is vegetated with domestic yard species, overstoried by live oaks and pine. The structure on the site is the applicant's block residence, a dog pen, and a large frame garage. The shoreline is characterized by several attempts at erosion control,. the most recent being the place- ment of very small rocks from an adjoining project. These extend from the bank offshore about 5' and are very scattered. Some small pieces of marl are also in this nearshore area. (*) The applicant's proposal is to contruct a bulkhead with backfill• along the shoreline. The bulkhead is to average approximately 3' .offshore along its length, and will be as much as 6' offshore in one location where it turns offshore to a far point on the property. A boat ramp will be constructed in the area immediately adjacent to the pier and this will include two 14' wing-walls which will extend offshore adjacent to the 14' wide by 201 long concrete boat ramp. 10. ANTICIPATED IMPACTS Conducting the project as proposed will involve the disturbance of approximately 560 sq.ft. of open brackish water habitat with fill ma- terial. Of this, about 280 sq.ft. will be filled by the proposed bulkhead construction and another 280 sq.ft.,will be filled by the proposed boat ramp construction. Highground grading surrounding the project will involve another 2000 aq.ft... Adjacent waters are classi- fied as SA by DEM and are currently closed to shellfishing by the Div. of Health Services. Clubfoot Creek in this area is not a desig- nated primary nursery area; however, Mitchell Creek, which is within. close proximity of the project, is a designated primary nursery area by DMF.
