(1) The proposed breakwaters shall be placed in strict accordance with the attached plats. (2) The proposed breakwaters shall be constructed with 1/4" spacing between sheating as shown on the submitted plats. (3) The activity shall be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge (increases of 25 NTUs or less are not considered significant). (4) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation. (5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. Project summary The applicant proposes to construct a wooden breakwater in front of his property in New Begun Landing Subdivision in Pasquotank County on New Begun Creek. FRANK W. HOLLOWELL BIO REPORT PAGE 2 SITE DESCRIPTION The applicant's property is located in Pasquotank County in New Begun Landing Subdivision at the mouth of New Begun Creek and the Pasquotank River. The existing lot is approximately 1.2 acres and is approximately 4 feet above NWL and has a clay soil. The lot is currently undeveloped with native trees and shrubs upon it. A small wooden deck for picnicking with steps to the water is located along the shore- line. The applicant proposes to keep this lot natural and use it only as a family picnic area. The only development proposed is 2 offshore breakwaters, one 60' long and the other 40' long. These proposed breakwaters are approximately 25' offshore and are to be constructed to a height of approximately 6" above MWL. The breakwaters will be constructed out of wooden material and have 1/4" spacing between each board of sheating to allow for water circulation. ANTICIPATED IMPACTS The proposed project will result in the placing of 2 offshore breakwaters totaling a distance of 100' along the shoreline of the Pasquotank River. The proposed breakwaters will be located approximately 25' offshore and will affect approximately 50 square feet of bottom area.
