(7) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards, (8) The diked disposal area will be constructed a sufficient distance from the mean high water level of any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters, (9) Pumpout facilities shall be provided at the dock prior to occupancy by boats, (10) The permittee shall prominently post and enforce a locked-head policy at the docking facility. (11) All floating structures, other than boats, used for habitation or commerce. B.C.land Sarah Hedgpeth Page 2 9. PROJECT DESCRIPTION: The project will be located on an approximately 7.39 acre tract of land located west of the AIWW and west and east of Airlie Road. At the present time there is a commercial structure (restaurant) located on the property. A recent fire has damaged this structure. On the east side of Airlie Road at the present time the property is boarded by marsh. The predominant species in this approximately 140' wide boarder is smooth cc)rdgrass (Spartina alterniflora). There is also along the landward edge of this marsh a boarder of blackneedle rush (Juncus romerianus) marsh (0'-20'). There is an area of old organic fill (approximately 2? 5i x 40') located just'north of the southern property line. At the present time there is a commercial structure (restaurant) located on the property. A recent fire has damaged this structure. On the east side of Airlie Road at the present time the property is boarded by marsh. The predominant species in this approximately 140' wide boarder is smooth cordgrass (Spartina alterniflora). There is also along the landward edge of this marsh a boarder of blackneedle rush (Juncus romerianus) marsh (0'-20'). There is an area of old organic fill (approximately 25' x 40') located just north of the southern property line. The spoil disposal area is just across the AIWW from the project site. Permission has been obtained from the owner for its use. Present plans do not call for any dredging. Watkins for a Department of the Army permit to excavate a 235-foot-long, 60-foot-wide, 6-foot-deep basin on the Atlantic Intracoastal Waterway (AIWW) off Airlie Road, Wrightsville Beach, New Hanover County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All excavated materials will be confined landward of the mean high water elevation within adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. b. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and at a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. c. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. -2- d. Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and resultant unnecessary siltation. e. No marsh vegetation will be excavated. f. Excavation will not exceed 6 feet below the elevation of mean low water (MLW). g. The permittee's scheme of development, of which the authorized work is a part, contemplates the presence of structures and their attendant utilities on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway. Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the U. S. Army Corps of Engineers acting on behalf of the United States, said lands are needed at any time for any purpose within the scope of said easement. (1) In order to protect juvenile shrimp. and fin fish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management. (4) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. (5) The disposal area effluent will be contained by pipe, trough or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval: All work must cease when the permit expires on December 31, 1987 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (8) The diked disposal area will be constructed a sufficient distance from the mean high water level of any marsh to eliminate. the possibility of dike erosion into or upon any marsh and/or surrounding waters. (9) Pumpout facilities shall be provided at the dock prior to occupancy by boats. (10) The permittee shall prominently post and enforce a-locked-head policy at the docking facility. (11) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (12) No person shall be allowed to live aboard vessels in the marina. (13) The marina shall only be used for docking of vessels associated with the Gray Gables development. No transient dockage, fueling or commercial services shall be offered as Oart of this marina. (14) All covered structures, such as gazebos, associated with the pier will have open sides and will be sited either landward or waterward of marsh wetlands. (15) The existing fill area, in marsh east of Airlie Road, will be returned to grade of the adjacent, unaltered marsh prior to any construction on the pier. This restored area must be inspected and approved by the N. C. Division of Coastal Management and the Corps of Engineers. (16) The headwall and riprap apron will be located landward of marsh wetlands. (17) Maintainable sediment traps shall be installed in catch basins 1, 2 and 3. NOTE: This project is certified under General Water Quality Certification No. 1664, issued on September 8, 1983, for riprap placement and Certification No. 1273 issued on November 10, 1978 for discharges of liquid effluent from diked upland disposal areas. NOTE: Prior to any discharge of domestic wastewater, the permittee must obtain a non-discharge permit for the extension of sewers to the New Hanover County wastewater treatment system. B.
