ADDITIONAL CONDITIONS
(6) The terminal end of the pipeline will be positioned at or greater than fifty
(50) feet from any part of the dike and a maximum distance from spillways
to allow settlement of suspended solids.
(7) A water control structure will be installed at the intake end of the effluent
pipe to assure compliance with water quality standards,
(8) The diked disposal area will be constructed a sufficient distance from the
mean high water level of any marsh to eliminate the possibility of dike
erosion into or upon any marsh and/or surrounding waters,
(9) Pumpout facilities shall be provided at the dock prior to occupancy by boats,

of Coastal Management and the Corps of Engineers,

Dear Mr. Hedgpeth:
Reference your June 24, 1985, request for a permit
modification to the subject permit issued to you on June 1, 1984,
for the construction of a pier with floating docks and mooring
pilings on the Atlantic Intracoastal Waterway off Airlie Road near
Wrightsville Beach in New Hanover County, North Carolina.
We have reviewed your recent request to excavate a 60-foot by
6-foot by 235-foot area beneath the above mentioned structures and
have determined that this work may also be a candidate for Federal
authorization under general permit No. SAWC080-N-000-0291
(enclosed) issued on January 27, 1981. However, in this regard,
we must delay final approval on your request until the
administrative processing of your application has been
accomplished by the North Carolina Division of Coastal Management.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

placement of rip-rap for this project is certified under general certification
number 1664, issued on September 8, 1983, for rip-rap placement.
However, a non-discharge permit is required for the sewer collection
associated with this project. At this time our agency has received no
application for the non-discharge permit. Additionally, a permit may be
required from the Division of Health Services for the raw water treatment
facilities which are found in the club house.

Members of the staff of the Wilmington Regional Office have reviewed the
application for the subject project. The applicant proposes to construct
seven, two unit residential townhouses along Airlie Road at Wrightsville
Beach. The development includes docking facilities along the AIWW, pier,
and gazebo. The proposed site drainage will consist of subsurface 12"
tile and associated catch basins, and will discharge into the AIWW above
the MHW contour. According to OCM, the outfall construction and rip-rap
placement will be above MHW.
This office has no objections to the proposed project. If you have any
questions, please advise.

8. Project summary The applicants propose to develop their high ground property by constructing
seven duplex units. A pier and dock facility with 14 slips is also proposed along the
AIWW.

9. PROJECT DESCRIPTION:
The project will be located on an approximately 7.39 acre tract of land located
west of the AIWW and west and east of Airlie Road. At the present time there is
a commercial structure (restaurant) located on the property. A recent fire has
damaged this structure. On the east side of Airlie Road at the present time the
property is boarded by marsh. The predominant species in this approximately 140'
wide boarder is smooth cc)rdgrass (Spartina alterniflora). There is also along the
landward edge of this marsh a boarder of blackneedle rush (Juncus romerianus)
marsh (0'-20'). There is an area of old organic fill (approximately 2? 5i x 40')
located just'north of the southern property line. The 100-year storm base flood
elevation of 13' is located just landward of the eastern most structure shown
on the plans. This contour is the division between the conservation and rural
services land classification.
The applicants propose to develop the high ground portion of their property by
constructing seven duplex units. These units are all located outside the estuarine
shoreline ACE. They will be served by a central wastewater system tied into the
counties' collection outfall. They will also have central water provided by on-
site wells. The area around the structures will be drained either to two on-site
drainage areas or east of the 32' contour storm water will be collected into a
series of connected catch basins'and drainlines and will be discharged into a rip-
rapped head wall outlet landward of the mean high water contour. Two of these
catch basins now call for sediment traps. Approximately 210' of pier will be
constructed to serve a 213' dock with 14 spaces. This dock will be located 85'
landward of the near edge of the AIWW channel. Present plans do not call for any
dredging. The applicants also show in plans two other structures associated with
the pier. A.-.combination covered gazebo/deck area is located just waterward of the
edge of the marsh. This structure is approximately 500 s.f. in area. Another
structure is located over the wetland area. It is approximately 300 s.f. in area.

The applicant proposes to construct a 14 slip marina basin for a
7 unit duplex townhouse development previously permitted in 1984. The
basin dimensions are proposed to be 235' by 60', to a depth of -6 feet MLW.
The project is located in the AIWW, currently classified SC. On December
1, 1985, these waters will be reclassified SA.
The project has been reviewed to determine impacts to water quality.
The following information is provided:
1. The project will require 401 certification, but should meet
the conditions for a General 401 certification for the
discharge of liquid effluent from a diked disposal.area.
2. It is expected that fecal coliform violations may occur
as a result of the marina usage.. The applicant.has not
proposed the provision of marine pump-out facilities or
locked head policy. It is believed that if the applicant
modifies the project to limit the amount of boat slips to
10 total, and provides pumpout facility and.enforces a
locked head policy, that fecal coliform standards for
waters classified SA will be adequately protected.

December 1, 1985 they will be SA. The area is a secondary nursery area and is
closed to shellfishing.
The applicants propse to develop the highground portion of their property by
constructing seven duplex units. These units are all located outside the estuarine
shoreline AEC. The will be served by a central wastewater system tied into the
county's collection outfall. They will also have central water provided by on-
site wells. The area around the structures will be drained either to two on-site
drainage areas or east of the 32' contour stormwater will be collected into a series
of connected catch basins and drainlines and will be discharged into a riprapped
head wall outlet landward of the mean high water contour. Two of these catch.

waterward side (east) of the basin will be set 85' landward of the near edge of the
AIWW channel. No access.channel is needed. A deck will be provided on the access
pier. The spoil disposal area is just across the AIWW from the project site.
Permission has been obtained from the owner for its use. Present plans do not call
for any dredging. The applicants also show in plans two other structures associated
with the pier. A combination covered gazebo/deck area is located just waterward
of the edge of the marsh. This structure is approximately 500 s.f. in area.
Another structure is located over the wetland area. It is approximately 300 s.f.
in area.
10. ANTICIPATED IMPACTS:
It was anticipated in the original report that dredging would be eventually necessary.
Other areas in the nearby vicinity of the project have been permitted. The location
of the dredging between the MLW contour and the AIWW should minimize the impacts of
the project.

In reference to Harry Watkins' letter dated September 25, 1985, we would
agree to allow you to deposit a maximum of 1,500 cubic yards of spoil on
our spoil island area across from Airlie Road. We would ask a price of
$0.50 per cubic yard for placement of 1,500 cubic yards.
We, however, do not feel it is in our best interests to have our property
designed as a permanent spoil site for maintenance dredging in the future.

Reference the application of Mr. B. C. Hedgpeth, represented
by Mr. Harry C. Watkins for a Department of the Army permit to
excavate a 235-foot-long, 60-foot-wide, 6-foot-deep basin on the
Atlantic Intracoastal Waterway (AIWW) off Airlie Road,
Wrightsville Beach, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. All excavated materials will be confined landward of the
mean high water elevation within adequate dikes or other retaining
structures to prevent spillover of solids into any marsh or
surrounding waters.
b. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and at a maximum distance from spillways
to prevent dike erosion and to allow adequate settlement of
suspended solids.
c. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area in order
to ensure maximum settlement of suspended solids.

d. Flow from the diked retention area will be confined by
pipe, trough, or similar device to a point at or below the mean
low water (MLW) elevation contour to prevent gully erosion and
resultant unnecessary siltation.
e. No marsh vegetation will be excavated.
f. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
g. The permittee's scheme of development, of which the
authorized work is a part, contemplates the presence of structures
and their attendant utilities on lands subject to an easement in
favor of the United States for the operation, maintenance,
improvement, and enlargement of the Atlantic Intracoastal
Waterway. Accordingly, the permittee will be required to remove
such structures and improvements at his own expense in the event
that, in the judgment of the U. S. Army Corps of Engineers acting
on behalf of the United States, said lands are needed at any time
for any purpose within the scope of said easement. Permanent
buildings will not be constructed in areas subject to easement.

This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and dotes set forth below. Any violation of these terms may subject
pemtittee to a tine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile shrimp. and fin fish populations, no excavation
or filling will be permitted between April 1 and September 30 of any year
without the prior approval of the Division of Coastal Management.
(2) No marsh vegetation *iili be excavated.
(3) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW).
(4) All excavated materials will be confined above mean high water and landward
of regularly or irregularly flooded marsh behind adequate dikes or other
retaining structures to prevent spillover of solids into any marsh or surroun-
ding waters.
(5) The disposal area effluent will be contained by pipe, trough or similar
device to a point at or below the mean low water level to prevent gully
erosion and unnecessary siltation.
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval:
All work must cease when the permit expires on
December 31, 1987
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

ADDITIONAL CONDITIONS
(6) The terminal end of the pipeline will be positioned .at or greater than
fifty ( 50 ) feet from any part of the dike anu a maximum distance from
spillways to allow settlement of suspended solids.
(7) A water control structure will be installed at the intake end of the effluent
pipe to assure compliance with water quality standards.
(8) The diked disposal area will be constructed a sufficient distance from the
mean high water level of any marsh to eliminate. the possibility of dike
erosion into or upon any marsh and/or surrounding waters.
(9) Pumpout facilities shall be provided at the dock prior to occupancy by boats.
(10) The permittee shall prominently post and enforce a-locked-head policy at
the docking facility.
(11) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for onshore sewage treatment.
(12) No person shall be allowed to live aboard vessels in the marina.
(13) The marina shall only be used for docking of vessels associated with the
Gray Gables development. No transient dockage, fueling or commercial services
shall be offered as Oart of this marina.
(14) All covered structures, such as gazebos, associated with the pier will have
open sides and will be sited either landward or waterward of marsh wetlands.
(15) The existing fill area, in marsh east of Airlie Road, will be returned to
grade of the adjacent, unaltered marsh prior to any construction on the
pier. This restored area must be inspected and approved by the N. C. Division
of Coastal Management and the Corps of Engineers.
(16) The headwall and riprap apron will be located landward of marsh wetlands.
(17) Maintainable sediment traps shall be installed in catch basins 1, 2 and
3.
NOTE: This project is certified under General Water Quality Certification No.
1664, issued on September 8, 1983, for riprap placement and Certification
No. 1273 issued on November 10, 1978 for discharges of liquid effluent
from diked upland disposal areas.
NOTE: Prior to any discharge of domestic wastewater, the permittee must obtain
a non-discharge permit for the extension of sewers to the New Hanover
County wastewater treatment system.

NOTE: Plans and specifications of all water system improvements must be approved
by the Division of Health Services prior to the award of a contract or
the initiation of construction (as required by 10 NCAC 10D .0900 et.
seq.). For information, contact the Engineering Planning Branch, 919/733-2460.
NOTE: An Erosion and Sedimentation control plan will be required for this project.
This plan must be filed at least thirty (30) days prior to beginning any
land disturbing activity. Submit this plan to the Department of Natural
Resources and Community Development, Land Quality Section, 7225 Wrightsville
Avenue, Wilmington, NC 28403.
NOTE: The first duplex unit west of Airlie Road is in an A12 flood hazard zone
with a base flood elevation of 13 feet. This structure must be constructed
above this elevation.

Reference your application for a Department of the Army permit
to excavate a 235-foot-long, 60-foot-wide, 6-foot-deep basin on
the Atlantic Intracoastal Waterway (AIWW), off Airlie Road,
Wrightsville Beach, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

On January 27, 1981, we issued general permit No. SAWCO80-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of the application, submitted on your behalf by
Mr. Harry C. Watkins, received October 18, 1985, for a Department
of the Army permit to excavate a 235-foot-long, 60-foot-wide,
6-foot-deep basin on the Atlantic Intracoastal Waterway (AIWW)
associated with previously approved dockage off Airlie Road,
Wrightsville Beach, New Hanover County, North Carolina, indicates
it to be a candidate for Federal authorization under this general
permit. Accordingly, the administrative processing of your
application will be accomplished by the North Carolina Division of
Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
