The basin is approximately 76' x 54' to a depth of -6' MLW. The work is proposed to be done by dragline, producing approximately 1208 c.y. of spoil to be placed on adjacent highground. The project is located on Hog Island Bay, classified SA, and currently open to shellfishing. A 150' bulkhead is also proposed along the channel. The project has been reviewed to determine impacts to water quality. The following comments are provided: 1) The project will require 401 Certification, but should meet the requirements of a general 401 Certification for bulkhead construction. 2. This office has no objections to the project as proposed. I* i Narrative Description The applicant's property is a six-acre tract located adjacent to Hog Island Bay off Hwy..12 on Cedar Island in Carteret County. The pro- perty extends from Hwy. 12 to Hog Island Bay and is about 500' deep. Elevations are 3-5' and soil composition is sandy. The property is predominantly vegetated with mature woody vegetation except for the small areas surrounding the existing residential structures. The shoreline is characterized by a 20-40' wide border of smooth cord- grass marsh which grades into transitional species before becoming woodsland. The proposed project will involve the maintenance of an existing ac- cess channel and basin that was dug prior to permit requirements in 1967. The channel is approximately 100' long by 25' wide and this terminates in a 70' long by 50' wide boat basin at it Vandmost ex- tent. A small access channel extends offshore and historical photo- graphy shows this channel to have been much longer than it is today, having been filled in with silt and sand over the years. A wooden jetty has been constructed on the south side of-the entrance to the channel. The applicant proposes to undertake maintenance excavation of the chan- nel and basin to a depth of -6' MLW. The work is proposed to be under- taken with a dragline and will involve the excavation of 1,208 cu.yds of spoil material which will be placed on the adjacent high ground. A new bulkhead is proposed as an extension.of the jetty which now exists at the mouth of the channel, and the bulkhead will be constructed an average of 2' offshore of the existing bank.and a maximum of 5' off- shore, and backfilled. `Adjacent waters of Hog Island Bay are classified as a primary nursery area by DMF, SA by DEM. and the waters are currently open for the.tak- ing of shellfish. 10. Anticipated impacts Conducting the project as proposed will involve the disturbance of ap- proximately 7,250 sq.ft. of man-made estuarine area by the excavation and approximately 200 sq.ft. of man-made estuarine area will be filled by the proposed bulkhead construction. Spoil disposal will encom- pass about 8,000 sq.ft. of the adjacent high ground with a total area disturbed of about 15,450 sq.ft. The bulkhead will not be positioned farther than an average of 2 feet and a maximum distance of five feet waterward from the mean high water (MHW) elevation contour at any point along its alignment. b. In order to protect juvenile shrimp and fin fish, no excavation or filling will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management. c. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded marshlands. d. No marshland will be excavated or filled. -2- Y. e. The basin and canal will not be maintained deeper than the controlling waters of Hogs Island Bay. f. The temporary placement or double handling of excavated or fill materials within waters or wetlands is not authorized. g. The fill material, to be placed landward of the bulkhead, will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. Narrative Description The applicant's property is a six-acre tract located adjacent to Hog Island Bay off Hwy..12 on Cedar Island in Carteret County. The pro- perty extends from Hwy. 12 to Hog Island Bay and is about 500' deep. Elevations are 3-5' and soil composition is sandy. The property is predominantly vegetated with mature woody vegetation except for the small areas surrounding the existing residential structures. The shoreline is characterized by a 20-40' wide border of smooth cord- grass marsh which grades into transitional species before becoming woodsland. The proposed project will involve the maintenance of an existing ac- cess channel and basin that was dug prior to permit requirements in 1967. The channel is approximately 100' long by 25' wide and this terminates in a 70' long by 50' wide boat basin at it Vandmost ex- tent. A small access channel extends offshore and historical photo- graphy shows this channel to have been much longer than it is today, having been filled in with silt and sand over the years. A wooden jetty has been constructed on the south side of-the entrance to the channel. shore, and backfilled. The applicant proposes to undertake maintenance excavation of the chan- nel and basin to a depth of -6' MLW. The work is proposed to be under- taken with a dragline and will involve the excavation of 1,208 cu.yds of spoil material which will be placed on the adjacent high ground. A new bulkhead is proposed as an extension ,of the jetty which now exists at the mouth of the channel, and the bulkhead will be constructed an average of 2' offshore of the existing bank.and a maximum of 5' off- Adjacent waters of Hog Island Bay are classified as a primary nursery area by DMF, SA by DEM. and the waters are currently open for the,tak- ing of shellfish. 10. Anticipated impacts Conducting the project as proposed will involve the disturbance of ap- proximately 7,250 sq.ft. of man-made estuarine area by the excavation and approximately 200 sq.ft. of man-made estuarine area will be filled by the proposed bulkhead construction. Spoil disposal will encom- pass about 8,000 sq.ft. of the adjacent high ground with a total area disturbed of about 15,450 sq.ft. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance.
