As described in the attached letter, the waters
immediately west of the causeway are highly productive and
sometimes open for shellfishing. Any additional sources
of pollution in the area may completely remove the
shellfishing use.
The threat of pollution is particularly high since the
10 slips would serve residents who do not live near the
docks and there are no plans for on-site sewage disposal
or on-site management. Further, the permit has no
restrictions on who could use the slips.
Apparently, people from out of town could rent the
slips and spend weekends on their boats. The probability
of discharges would be particularly high in this
situation. The waters west of the causeway will have to
be permanently closed to shellfishing to protect public
health from these discharges.
We request that more stringent controls be implemented
through permit modification or any other appropriate
means. Please notify us of any proposed permit
modification for this project.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
1. This project will not require a 401 certification.
2. In order to protect adjacent waters from
stormwater runoff, a 30-foot buffer should be
maintained between any part of the parking area
and MHW. The current design indicates the
northeast corner of the lot is 5 feet from MHW.
3. The existing road should remain in its natural
state and not be graveled or paved.
4. The adjacent waters are closed and not likely to
be reopened so the agreement on marinas would
allow such a project with strict management
controls on sewage discharges such as:
a. Pumpout facilities must be provided.
b. A locked-head policy must be established
and enforced.
C. Signs must be posted along the docks
prohibiting any overboard discharge of
sewage and any live aboards.

These waters are not likely to be opened; therefore the project
appears to be in accord with the MOA between DEM, CAMA and DHS.

c. That signs be posted prohibiting live aboards and the
overboard discharge of sewage into the surface waters.
6. This office has no objection to the project provided the above
conditions are met.

Dear Mr. Hardee:
Through our coordination with the North Carolina Department of
Natural Resources and Community Development, we have been informed
that your application for State authorization to construct docking
facilities in Beaufort Harbor north of Pivers Island in Beaufort,
Carteret County, North Carolina, has been administratively put on
hold due to a dispute over property ownership of the subject
parcel of property. We have no such provisions under the
administrative rules of our regulatory program. Accordingly, your
Department of the Army application has been retired without
prejudice.
This administrative action will not hinder your further
coordination with the North Carolina Division of Coastal
Management. If we are informed that a favorable resolution has
been reached, we will reactivate your application and process it
to completion as expeditiously as possible.

Narrative description
The applicant's property is a half acre tract located on the east.
side of the Pivers Island Road (SR 1208) near Beaufort, Carteret
County. The property is irregularly shaped,.having been formed by
filling on a tidal sand spit beginning prior to permit requirements.
The property is 2-3' in elevation and consists of predominantly sandy
soils mixed with scallop shells and other debris. Bordering Beau-
fort channel, the shoreline is bulkheaded; the backfill of the struc-
ture, however, is incomplete. On the point of the spit is an exist-
ing pier to which several dilapidated fishing vessels are moored..
The shoreline on the north is bordered by 50-100' wide fringe of
coastal wetlands dominated by smooth cordgrass.
The applicant is proposing a gravel parking area and pier close to
SR 1208 and on Beaufort channel.
10. Anticipated impacts
Construction of the project will involve the disturbance of 2,700
sq.ft. with the proposed gravel parking area, and the consumption
of 10,400 sq.ft. of public trust area with a pier and piling place-
ment to accommodate ten boats.
The adjacent waters are classified as SA according to DEM and are cur-
rently closed to shellfishing according to the Div. of Health Services.

Reference the application of Mr. Ron J. Hardee for a
Department of the Army permit to construct docking facilities in
Beaufort Harbor, north of Pivers Island, Beaufort, Carteret
County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. This permit does not authorize the interference with any
existing or proposed Federal project, and the permittee will not
be entitled to compensation for damage or injury to the authorized
structure or work which may be caused from existing or future
operations undertaken by the United States in the public interest.
b. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on
all navigable waters of the United States.
c. If the display of lights and signals on the authorized
structure is not otherwise provided for by law, such lights and

signals as may be prescribed by the U.S. Coast Guard will be
installed and maintained by and at the expense of the permittee.
d. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper 'steps
to ensure the integrity of the permitted structure and the safety
of moored boats from damage by wavewash. The permittee will not
hold the United States liable for any such damage.
e. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without transferring it to a third
party.

Dear Mr. Hardee:
On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 4, 1986, for a
Department of the Army permit to construct docking facilities in
Beaufort Harbor north of Pivers Island, Beaufort, Carteret County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will.be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and

4, 9. Narrative description
The applicant's property is a half acre tract located on the east
side of the Pivers Island Road (SR 1208) near Beaufort, Carteret
County. The-property is-irregularly shaped, having been formed by
filling on a tidal sand spit beginning prior to permit requirements.
The property is 2-3' in elevation 'and consists of predominantly sandy
soils mixed with scallop shells and other debris. Bordering Beau-
fort channel, the shoreline is bulkheaded; the backfill of the struc-
ture, however, is incomplete. On the point of the spit is an exist-
ing pier to which several dilapidated fishing vessels are moored.
The shoreline on the north is bordered-by 50-100' wide fringe of
coastal wetlands dominated by smooth cordgrass.
The applicant is proposing a gravel parking area and pier close to
SR 1208 and on Beaufort channel.
10. Anticipated impacts
Construction of the project will involve the disturbance of 2,700
sq.ft. with the proposed gravel parking area, and the consumption
of 10,400 sq.ft..of public trust area with a pier and piling place-
ment to accommodate ten boats.
The adjacent waters are classified as SA according to DEM and are cur-
rently closed to shellfishing according to the Div. of Health Services.
