On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received November 8, 1985, for a
Department of the Army permit to excavate an access canal off
Charles Creek, Stump Sound, near Sneads Ferry, Onslow County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and
Harbor Act, has been assigned No. SAWC086-N-067-0044 and will be
coordinated by Mr. Hugh Heine, telephone (919) 343-4725. He is

Reference the application of Mr. Sterling D. Grant for a
Department of the Army permit to extend an access canal off
Charles Creek, Stump Sound, near Sneads Ferry, Onslow County,
North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. In order to protect juvenile shrimp and fin fish, no
excavation will be permitted between the dates of April 1 and
September 30 of any year without the prior approval of the North
Carolina Division of Coastal Management.
b. An earthen plug will be left between the inland extension
and the existing canal until excavation landward of,the plug has
been completed. To prevent unnecessary sediments from reaching
adjacent waters, 24 hours will be allowed to elapse before the
plug is removed.
c. All excavated materials will be confined landward of the/
mean high water (MRW) elevation contour and any regularly or
irregularly flooded marshlands.
d. No excavated or fill materials will be placed at any time
in any marshes or waters of the State.

e. No vegetated wetlands will be filled.
f. Excavation will not exceed 5 feet below the elevation of
mean low water (MLW).
g. The temporary placement or double handling of excavated or
fill materials within waters or wetlands is not authorized.

This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to prevent contravention of Rules of the Coastal Resources
Commission (07H .0208 3(1)(H)) the canal extension is hereby
modified to delete the right angle turn and the section of the
proposed canal beyond that turn. A turning area not greater
than 40 feet in diameter may be centered at the end of the canal
extension that has been authorized (see plat).
(2) In order to protect juvenile shrimp and fin fish, no excavation
will be permitted between the dates of April 1 and September
30 of any year without the prior approvel of the N. C. Division
of Coastal Management.
(3) An earthen plug will be left between the inland extension and
the existing canal until excavation landward of the plug has
been completed. To prevent unnecessary sediments from reaching
adjacent waters, 24 hours will be allowed to elapse before the
plug is removed.

This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

This office has revised earlier comments dated January 26, 1986 concerning the
applicant's proposal to extend an existing canal 200 feet into high ground. The
project is located adjacent to Charles Creek, classified SA.
The project has been reviewed to determine impacts to water quality. The following
comments are provided:
1. The project will not require 401 certification.
2. It is anticipated that the project may cause water quality degredation within
the canal below the water quality standards for waters classified SA, by
extending an existing 1300 foot canal an additional 200 feet. Information
contained within the Coastal Finger Fill Canal Study performed in August 1981
suggests that data collected from a similar canal situation in the Sneads
Ferry area violated D.O. standards at the bottom of the canal. The surface
and mid-depth locations indicates D.O. levels were generally in the 5.5 to 8.6
range. The canal was approximately 1800 feet in length with a 90° bend with
gradual turns beyond the bend.
Upland development runoff could result in the contravention of water quality
standards. It is believed that if upland runoff is diverted away from the
canal, the proposed canal extension would not significantly contribute to the
degradation of the canal as it presently exists. Numerous canals of equal or
greater length and amount of angles have been previously permitted within the
region, without significant degr%dation, according to the 1981 study.

8. Project summary The applicant wishes to extend his existing canal an additional 200'
into highground which is located on his tract of land off of S.R. 1651, Sneads Ferry,
North Carolina.

9(a) SITE DESCRIPTION:
The project site is located at the terminus of a 1,300' long finger canal off of
Charles Creek in Sneads Ferry. The land adjoining the canal is back on a curving
dirt road which gains access from S.R. 1651. A few private residences border the
canal and its fingers have a depth of -4' (MLW) and a width of 30' to 40'. Small
skiffs and fishing boats use the canal. At the end of the canal which tapers to
a point a few patches of cattail exist. Also the bottom consists of mud and silt
and the eroding banks are 4' to 6' in elevation. An existing brick residence is
located at the end of the canal and vacant property with scattered hardwoods
can be seen on the adjacent shorelines. The regular tidal amplitude is only about
1' in height and the adjoining Charles Creek waters are classified as SA and are
primary nursery areas.
9(b) PROJECT DESCRIPTION:
The applicant desires to extend his existing finger canal another 200' into his
upland. The width is to be 20' with a depth of -5' (MLW). The terminus of the
existing canal will be enlarged and cleaned out and extended 80' to the north
where it will turn.90° east and run another 120'. All 740 cubic yards of upland
spoil will be removed by front end loader and dragline to upland sites however
some spoil will stay behind straw bales at the loading area. The purpose of the
work is to give water access to two future residences which will be located on
both sides of the canal extension.
10. ANTICIPATED IMPACTS:
The project as proposed will cause the loss of 100 s.f. of cattail (Typha spp.)
wetland and 400 s.f. of productive mud bottom. It also will convert approximately
1/4 acre of upland into shallow water habitat. The 200' extension could contribute
to degraded water quality in Charles Creek caused by poor flushing characteristics
in the canals. Future stormwater impacts may also contribute to poor water
quality.

to extend an access canal off Charles Creek, Stump Sound, near
Sneads Ferry, Onslow County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result.in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be 'sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.
