FROM: Dennis Ramsey SUBJECT: Modified Application for CAMA Permit Galleon Bay Enterprises Onslow County The Subject application has been modified by letter dated January 24, 1986 to delete the proposed tennis courts from the project. This deletion resolves a portion of the stormwater aspects of the project as described in my November 19, 1985 memo to you on this project. The modification does not address the runoff from the proposed gazebo. Unless the gazebo is located so as to provide a 30-foot undisturbed buffer from MHW contour or the applicant can demonstrate that the stormwater runoff from the 100-year, 24-hour event can be retained on site, it is expected that fecal coliform water quality standards in the adjacent SA waters will be violated due to stormwater runoff from the rooftop. The applicant wishes to delete the construction of the tennis courts previously proposed. This office provided comments relative to the project dated October 25, 1985 concerning the 30 foot buffer area between the tennis courts, gazebo and the plane of mean high water. The applicants letter does not concern the aspects of the gazebo. Unless the proposed gazebo is relocated at least 30 feet landward from the MHW contour or the appli- cant can demonstrate that stormwater runoff from the rooftop can be retained on site during a 100 year-24 hour storm event, it is expeted that fecal coliform standards for waters classified SA will be violated due to the direct runoff from the roof surface. I understand from our conversation that the only concern prohibiting issuance of this permit is the storm water runoff effected by the proposed tennis court and its proximity to the 30' buffer of necessary separation to mean high water. In view of the problem, I have decided to eliminate the tennis court from this application for evaluation at a later date. A tennis court and gazebo is also proposed at the site located adjacent to the AIWW, classified SA, at this location at North Topsail Island. The project has been reviewed to determine impacts to water quality. The following comments are offered: 1. The project will not require 401 certification. 2. The proposed gazebo and tennis court is located within 30 feet of the mean high water contour.. A 30 foot-undisturbed natural buffer must exist between impervious surface areas and the mean high water contour. The applicants have also failed to demonstrate how stormwater runoff will be prevented from entering adjacent waters from the gazebo and tennis court. 3. This office has no objection to the construction of the pier, providing that no dredging of the existing channel will take place to facilitate larger boats. 4. It is expected that the project as proposed will violate water quality standards unless the applicants modify the project to provide sufficient stormwater management facilities to acc :te the 100 year storm .event. Project summary The applicants propose to build a 500' by 6' multi-family residential pier along the south side of a shallow man-made canal north of Tradewinds Drive in Galleon Bay Subdivision. Also proposed is a tennis court and a gazebo. GALLEON BAY ENTERPRISES - c/o JOHN COUCH PAGE 2 9. PROJECT DESCRIPTION: The project site is located along the south and west shoreline of a shallow man-made finger canal on the northern end of the Galleon Bay Subdivision on North Topsail Island, Onslow County. The 30 acre site is comprised of unbuildable lots along Tradewinds Drive and has approximately 500 linear feet along the southern bank of this canal. No marsh fringe follows the path of the project along this side of the canal however extensive mixed high marsh exists along the northern side adjacent to the AIWW. The bottom of the canal is quite shallow with an average depth of -2' (MLW). The bottom is comprised of mud/silt sediments. The area surrounding the canal is low in relief with a canopy of myrtle and yaupon shrubs. The applicants have an option from Dr. Hunter Heath for this end of the subdivision and wish to use the pier as a combination fishing platform and small boat transient dock. Also proposed is the construction of a 20' by 20' wooden gazebo and sun deck and a tennis court along the estuarine shoreline. An existing boat ramp will be repaired at the end of Marina Way with the same dimensions as the original 12' by 30' concrete ramp. The purpose of this work is to use the site as an amenity package for some quadra- plexes they are building along the oceanfront which was permitted last winter under a CAMA minor permit. The waters are SA and the canals adjoin secondary nursery along the AIWW. 10. ANTICIPATED IMPACTS: The proposed 500' long pier which parallels the canal will not obstruct navigation nor excessively shade marsh vegetation. Since the canal is very shallow small motor boats will be the only ones that can moor along the transient walkway. No dredging is anticipated. The tennis court makes up the extent of impervious surfaces and is within the 30% rule. The two proposed 16' by 32' sun decks on either side of the gazebo and the 400 s.f. gazebo itself are typical upland uses and must not be allowed below the mean high water mark. Some temporary turbidity impacts are anticipated with the pier construction activities since water jets will be utilized. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval.
