An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1990 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (2), Al, 1 floating structures, other than boats, used for habitation or commerce (as defined in.15 NCAC`7M.0602) shall be in conformance with local regulations for onshore sewage treatment. (8) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. The bulkhead will be constructed on a direct line between the two, near ends of the adjacent bulkheads. The bulkhead will be positioned no farther waterward than an average of 2 feet from the normal water elevation contour. b. All backfill materials will be obtained from an upland source and confined landward of the permitted bulkhead. c. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. d. A review of your application received November 26, 1986, for a Department of the Army permit to construct and backfill a bulkhead and construct a pier with slips and pilings on the Pamlico River, Washington, Beaufort County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. We are considering authorization of the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification may be required under the provisions ofSection 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. In accordance with our administrative regulations, 60 days after receipt of a request for certification is considered a reasonable time for State action. This property was purchased in 1985, and plans are being prepared to convert the old warehouse into abed and breakfast inn. The plans for the inn have been approved on a local and State level and have been certified by the Dept. of Interior, Parks and Recreation Division in Atlanta, Ga. The pier is a very intergral part of the inn and the property, because of restoring the "wharf" concept. Please review the enclosed information,.-and thank you in advance for your consideration. Project summary The applicant is proposing to develop a bed and breakfast facility with a 160' long pier with 20 finger piers. -I,. Environmental setting The applicant owns a 140' by 146' lot on the Pamlico River within the city limits of Washington, on which is located an old brick warehouse which was constructed prior to the Civil War. The building has been vacant for many years. The entire property is bulkheaded except for one short section where the bulkhead is broken. At this point some erosion is occurring. No wetland vegetation is present on the property. Project proposal The applicant is proposing to convert the old warehouse to a bed and breakfast facility. An integral part of the development is the restoration of the original wharf concept which will be done by the construction of a 160' long pier which will have 20 finger piers with accompanying tie pilings. The slips will be used for permanent mooring as well as temporary mooring for customers of the bed and breakfast inn. The proposed pier will extend beyond the established U.S. Pierhead and Bulkhead Line, however, the City of Washington has given approval for this action. Also, the waterward end of the proposed pier will be kept 90' from the near edge of the federally maintained channel so as to avoid any navigation problems. The bulkhead to be constructed will be 45' in length and will average + 2' beyond the NWL. The bulkhead will be connected to two adjacent bulkheads.
