'Narrative'descHption Laura Fulcher and Nathaniel Sylvester own Lots 19 and 20 respectively on Neptune Drive off the Deer Creek in the Town of Cape Carteret Carteret County. These co-applicants propose to excavate one high- ground boat basin on their common property line. The basin will measure about 40' wide and 60' long by -4' deep on MLY. The ex- cavation will include the displacement of a fringe marsh dominated by salt marsh cordgrass measuring 18-24' deep by 40' wide. In or- der to properly connect to the natural deep water, an additional area of bottomland will be excavated m-easurina 15-18' deep by 40' wide. The.proposed project will be accompliahed by the dragline meathod and will produce approximately 2,880 cu.yds. of spoil ma- terial. The spoil will be contained on the Fulcher's highground property and utilized as landscaping material associated with the proposed house construction. The project plans also call for meter'of the proposed boat basin the entrance channel through the the bulkheading of the entire peri- which will include both sides of fringe of marsh grass. 10. ' 'Anti'cipated 'i'mpacts No significant numbers of clams or oysters were encountered through the course of the open water field investigation. It is noted, how- ever,Ahat the SA waters of i)eer Creek are open to shellfishinq. The proposed project wild directly displace about 720 sa.ft. of salt marsh. It is also important to note that the distance of 100' will be maintained between the proposed boat basin and the existing sep- tic tank located on the Sylvester property as well as the proposed septic system on the Fulcher property. Box 769 Morehead City, North Carolina 28557 RE: Fulcher/Sylvester Permit Application Cape Carteret Dear Jim, I have revised the referenced drawings per your instructions of November 26, 1985. The dock on the adjacent property (Sylvester) extends approximately 15 feet to 20 feet away from high ground where it encounters deep water, and we would have to dig approximately that distance offshore. Remember, we are somewhat limited in our ability to reach very far, because the digging machine will be a dragline and the buckets cannot swing very far because of the limited boom lengths. The proposed septic tank will be located on the west side of the house and more than 100 feet away from the water. All drain lines will extend toward the street (west and south). (1) In order to preclude contravention of Rules of the Coastal Resources Cammission (07H.0208(b)(1) (A) the width of the entrance channel through the fringe marsh is hereby reduced to twenty (20) feet (see attached plat revised by DCM and dated 2/17/86). No excavation will take place outside of this new alignment. (2) Both sides of t* entrance channel through the marsh will be bulkheaded as illustrated on the work plat (sheet 1 of 3). (3) Excavation will not exceed 4 feet below the elevation of mean low water (MLW). (4) In order to protect juvenile shrimp and fin fish, no excavation will be per- mitted between the dates of April 1 and September 30 of any year without the prior approval of the N. C. Division of Coastal Management. (5) An earthen plug will be left between the inland basin and the waters of Deer Creek until excavation landward of the plug has been completed. To prevent unnecessary sediments from reaching adjacent waters, 24 hours will be allowed See attached sheet for Additional Condi This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. A review of your application received November 4, 1985, for a Department of the Army permit to excavate a 70-foot by 40-foot by 4-foot boat basin and construct a 180-linear-foot bulkhead on Deer Creek adjacent to Bogue Sound at your properties off Neptune Drive, Cape Carteret, Carteret County, North Carolina, indicate it to be a candidate for Federal authorization under this general permit.
