This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) All work will take place in accordance with the work plat drawings and must
conform to all local state and federal building code requirements.
(2) No work shall begin until the 120 foot recession line has been re-established
by a representative of the Division of Coastal Management pursuant to 15
NCAC 07J.0403(b).
(3) The project will comply with all 15 NCAC 07H.0300 Use Standards for the
ocean high hazard AEC.
(4) There shall be a 25 foot minimum separation between the building roof drainage
and the nitrification fields.
(5) In order to avoid impacts from stormwater runoff, the runoff from the parking
lots shall not be channelized toward the roadside ditches.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989 _
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

9. Narrative description
Douglas S-. Fleming proposes to develop a 200' wide section of
oceanfront property located in the Town of Pine Knoll Shores just
2.6 mi west of the Atlantic Beach stoplight on Hwy. 58. The
Jungle Land Amusement Park is directly north of the project site
with the Sea Hawk Motel on the west side and the old Morehead.
Fishing Pier and Trailer Park on the east side.
The property is approximately 489'.deep from the highwater shore-
line to Hwy. 58 and consists of 2.242 acres of real estate. In
recent years the site has been used as a staging area for modular
condominium units being erected in the near-vicinity.. From time
to time the 'site has been used as a dumping ground for used high-
way asphalt and concrete materials. Most of this activity has
leveled the area flat and has been restricted to that section
of the.property landward of a,point about 120' from-the first
line of dune vegetation.
The applicant proposes to develop a 45-room hotel with one full
time manager's live-in unit; a swimming pool, and parking lot.
All of the development, with the exception of the 6' wide wooden
pedestrian accessway,..will take place landward of the PKS build-
ing setback line located 100' from the first line of natural,
stable vegetation. The hotel and parking lot will be landward
of. the CAMA 120' ocean erodible AEC.which applies to large,
immovable structures. The swimming pool, with a concrete apron,.
will occupy approximately 840 sq.ft. immediately in front of the
120' recession line. This oceanfront section of the property
is typical and exhibits a well vegetated primary dune ridge with
an elevation of'4-9' as shown on the workplat drawings. The on-
site inspection revealed that local visitors and tourists utilize
the openess of this let as a way to access the ocean beach by
walking from Hwy. 58 across the dune line.. Several footpaths
characterize the dune ridge. ..
The applicant has provided calculations on their stormwater
management design as well as the ratios of impervious to pervious
surface areas throughout the total project. The reader of this
report is directed to the three page attachment to the appli-
cation.
The actual hotel building which will occupy 5,870 sa.ft. will be
located in a federalflood zone listed as a C-Zone with a con-
- = struction elevation of_+16'. Because of the previous modifica-

the use of support pilings with a tip penetration of at least _

f.ac.il-ity does not appear on the CAMA wor_.k plat drawings. however,
it has been related to this office that a low pressure septic sys-
tem will be installed on the east or west sides of the property
jist landward of the actual hotel building site in those areas which
have been dedicated to open, green spaces. This information was ob-
tained through conservations with the local building inspector.
10. Anticipated impacts
The proposed plan will allow construction of the hotel and still
preserve the integrity of the ocean erodible AEC in front of the
120' recession line. All other. development on the property appears
to be consistent with the CAMA Use Standards for development within
the ocean high hazard area. There is one exception that involves the
possible elimination of public access across the property.
CAMA REVIEW
The projet has been reviewed with regards to the 1981 LUP for the
Town of Pine Knoll Shores. That document classifies the frontal
beach area as conservation and the highground property as develop-
ment. No development constraints can be identified from the re-
view. In addition, the Town of Pine Knoll Shores has properly
zoned this tract of land to allow for commercial development in the
form of a hotel.

On May 19, we made two soil borings on your lot next to the
Sea Hawk Motel, Atlantic Beach. Hole # 1 was at the first sur-
veyor's stake inside the required setback line, 120 feet from high
tide level.
Hole # 2 was about 25 feet back from the line of telephone
poles in front of the lot.
At both locations, the soil texture was fine sand to a depth
of six feet. Permeability in this soil will exceed 20" per 'hour.
The seasonal high water table is at about 50" at Hole #4 -and 60"
at Hole # 2.

9. Narrative description
Douglas S. Fleming proposes to develop a,200' wide section of
oceanfront property located in, the Town of Pine Knoll Shores just
2.6 mi west of the Atlantic Beach stoplight on Hwy. 58. The
Jungle Land Amusement Park is directly north of the project site
with the Sea Hawk Motel on the west side and the old Morehead
Fishing Pier and Trailer Park on the east.side.
The property is approximately 489' deep from the highwater shore-
line to Hwy. 58 and consists of 2..242 acres of real estate. In
recent years the site has been used as a staging area for modular
condominium units being erected in the near vicinity. From time
to time-the site has been used as a dumping ground for used high-
way asphalt and concrete materials. Most of this activity has
leveled the area flat and has been restricted to that section
of the property landward of a point about 120' from the first
line of dune vegetation.
The applicant proposes to develop a 45-room.hotel with one full
time manager's live-in unit; a swimming pool, and parking lot.
All of the development, with the exception of the 6' wide wooden
pedestrian accessway,.will take place landward of the PKS build-
ing setback line located 100' from.the first line of natural,
stable vegetation. The hotel and parking lot will be landward.
of the CAMA 120' ocean erodible AEC which applies to large,
immovable structures. The swimming pool, with a concrete apron,
will occupy approximately 840 sq.ft. immediately in front of the
1201 recession line. This oceanfront section of the property
is typical and exhibits a well vegetated primary dune ridge with
an elevation "of,4-:a' as shown on the workplat drawings. The on
site inspection revealed that local visitors and tourists utilize
the openess of this let as a way to access the.ocean beach by
walking from Hwy. 58 across the dune line. Several footpaths
characterize the dune ridge.
The applicant has provided calculations on their stormwater
management design as well as the ratios of impervious to pervious
surface areas throughout the total'pr:oject. The reader of this
report is directed to the three page attachment to the appli-
cation.
The actual hotel building which will occupy 5,870 sa.ft. will be
located in a federal flood zone listed as a C-Zone with a con-
struction elevation of +161. Because of the previous modifica-
tions to the flat land area of the property, the applicant pro-
poses to fill the building site with approximately 2' of imported
r earthen fill material. This is in compliance with the state's
building code requirements, and the design plans also include
the use of support pilings with a tip penetration of at least
8' into the ground.
i The exact location and design of the primary wastewater. treatment
facility does not appear on the.CAMA work plat drawings. However!

it has been related to this office that a low pressure septic sys-
tem will be installed on the east or west sides of the property
just landward of the actual hotel building site in those areas which
have been dedicated to open, green spaces. This information was ob-
tained through conservations with the local building inspector.
10. Anticipated impacts
The proposed plan will allow construction of the hotel and still
preserve the integrity of the ocean erodible AEC in front of the
120' recession line. All other development on the property appears
to be consistent with the CAMA Use Standards for development within
the ocean high hazard area. There is one exception that involves the
possible elimination of public access across the property.
CAMA REVIEW
The projet has been reviewed with regards to the 1981 LUP for the
Town of Pine Knoll Shores. That document classifies the frontal
beach area as conservation and the highground property as develop-
ment. No development constraints can be identified.from the re-
view. In addition, the Town of Pine Knoll Shores has properly
zoned this tract of land to allow for commercial development in the
form of a hotel.
