This permit, issued on `? - Z u , K L , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) A pumpout facility to serve boats docked at the marina must be installed
and operable prior to occupancy at the reconfigured dock slips.
(2) The marina shall prominently post and enforce a no sewage discharge policy
for boats without holding tanks.
(3) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
-for onshore sewage treatment.
(4) This permit does not authorize the construction of fueling or maintenance
facilities.
(5) No person shall be allowed to live aboard vessels in the marina.
(6) No attempt will be made by the permittee to prevent the full and free use
by the public of all navigable waters at or adjacent to the authorized
work. Use of -the permitted activity must not interfere with the public's

or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
All work must cease when the permit expires on
December 31, 1989
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.

Figure Eight Island Yacht Club, Inc.
New Hanover County
The Subject application has been reviewed for water
quality impacts and the following comments are offered:
1. The proposed project will not require a 401
certification.
2. It is recommended that the applicant install
marine pumpout facilities, establish and enforce a
locked-head policy, and post signs on the docks
prohibiting live-aboards and overboard discharges
of sewage. Unless these conditions are met, it is
expected that fecal coliform violations will
occur. Future violations may cause the closure of
the currently open shellfishing waters nearby,
violating the antidegradation policy in the water
quality standards.

Figure Eight Island Yacht Club, Inc.
New Hanover County
The applicant proposes to remove existing dockage within the Figure Eight Island
Yacht Basin and replace pilings and floating slips. The existing number of slips
total 31. The proposed number of slips is expected to be 31 although it would be
possible to moor an additional 2 to 3 boats. The project is located in waters
classified SA, and currently open to shellfishing.
The project has been reviewed to determine impacts to water quality. The following
comments are provided:
1. The project will not require 401 certification.
2. It is recommended that the applicant install marine pumpout facilities,
establish and enforce a locked.head policy, and post signs.on the docks

accommodate slightly longer vessels on existing dock A and to replace existing
dock B with a new floating dock.

9. PROJECT DESCRIPTION't
The project site is the existing marina serving Figure Eight Harbor Yacht Club, Inc.
The existing docks are, in the opinion of the applicants, unsafe. The area is
classified as SA open water open to the taking of shellfishing and as a primary
nursery area. Water depths in the basin are approximately -8' MLW.
The applicants are proposing to change the dock configuration as shown on sheet 2
of 3. Dock A will be reduced from 13 slips to 7. Dock B will be shifted to the
west and approximately 6 slips will be constructed on the east side. Although
not clearly shown on the plans my understanding is that several finger piers
on Dock A will be lengthened to accommodate longer boats.
10. ANTICIPATED IMPACTS:
The applicants have indicated that no fuel handling facilities will be on the
docks, and that no permanent live aboard conditions will be allowed. They have
also included a copy of a report with the $pplication comparing the presence
of heavy metals at this marina with two other marina/boat yards in New Hanover
County. No boat maintenance occurs at Figure Eight Yacht Club. For those
interested this report is available for examination at the Wilmington Regional
Office. It appears that actual docking spaces provided by the new configuration
may exceed the proposed docking by approximately 3 slips.

On January 27, 1981, we issued general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received October 8, 1985, on
behalf of Figure Eight Island property owners, for a Department of
the Army permit to excavate sand material from Masons Inlet,
Middle Sound, and deposit it as beach nourishment material along
approximately 2,300 linear feet of Atlantic Ocean beach, parallel
to Beach Road South, Figure Eight Island, New Hanover County,
North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished
by the North Carolina Division of Coastal Management. Comments
from Federal review agencies will be furnished to the State.
If your application must be withdrawn from this general
permit process for any reason, you will be written and informed of
its further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

Figure Right Island property owners, for a Department of the Army
permit and a State Water Quality Certification to excavate sand
material from Masons Inlet, Middle Sound, and deposit it along
approximately 2000 linear feet of Atlantic Ocean shoreline as
beach nourishment, parallel to Beach Road South, Figure Eight
Island, New Hanover County, North Carolina. Your-receipt of this
letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the.same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by December 13, 1985, the District
Engineer will deem that waiver has occurred.

Reference the application of Mr. Hal McNeely, representing
Figure Eight Island property owners, for a Department of the Army
permit to excavate sand from Masons Inlet, Middle Sound, and
deposit it as beach nourishment material along approximately 2,300
linear feet of Atlantic Ocean beach, parallel to Beach Road,
Figure Eight Island, New Hanover County, North Carolina. Also,
reference our letter of November 8, 1985, whereby we informed the
Federal review agencies of a change to the application provided by
Moffatt and.Nichol, Engineers.
The Federal agencies have completed review of the proposal as
presented by the application, including the Moffatt and Nichol
change, and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. To avoid periods of high biological activity and sea
turtle nesting, no work will be permitted during the period
between May 1 and November 1 of any year.
b. Prior to any excavation, the permittee will perform a
benthic analysis of borrow sites. Results will be forwarded to
the U. S. Fish and Wildlife Service, Post Office Box 25039,
Raleigh, North Carolina 27611-5039, for review and evaluation
with regard to site suitability.

Reference your application for a Department of the Army permit
to excavate sand from Masons Inlet, Middle Sound, and deposit it
as beach nourishment material along approximately 2,300 linear
feet of Atlantic Ocean beach, parallel to Beach Road, Figure Eight
Island, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWCO80-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the N. C.
Division of Coastal Management prior to performing any such change
or alteration. Such action is necessary as revised plans must be
reviewed and the authorization modified.

Reference the application of the Figure Eight Island Property
Owners, represented by Mr. Hal McNeely, McNeely and Associates,
for a Department of the Army permit to excavate sand from Masons
Inlet, Middle Sound, and deposit it as beach nourishment material
along approximately 2,300 linear feet of Atlantic Ocean beach,
parallel to Beach Road, Figure Eight Island, New Hanover County,
North Carolina. Also, reference our letter of November 25, 1985.
The Federal agencies, including the U. S. Fish and Wildlife
Service, Endangered Species Office, in Asheville, have completed a
more thorough review of the proposal. Formal consultation,
pursuant to Section 7 of the Endangered Species Act of 1973, has
been concluded.
Including the following conditions in your State authorization
will make the proposal consistent with our general permit No.
SAWCO 80-N-000-0291:
a. To avoid periods of high biological activity, including
sea turtle nesting, no work will be performed between May 1 and
November 1 of any year.
b. Prior to the placement of excavated material for beach
nourishment, deteriorated sand bag fabric remnants and other
debris will be removed from the beach.
c. No vegetated wetlands will be excavated or filled.

nourishment material along approximately 2,300 linear feet of
Atlantic Ocean beach, Figure Eight Island, New Hanover County,
North Carolina. Also, reference Moffatt and Nichol, Engineers,
letter of April 10, 1986, and North Carolina Division of Coastal
Management letter of April 21, 1986, regarding realignment of your
sand borrow area in Masons Inlet.
Your revised plans have been reviewed and found to be
consistent with the provisions and objectives of general permit
No. SAWC080-N-000-0291. Therefore, you may continue activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any additional revision of work is required because of
unforeseen or altered conditions or for any other reason, plans
revised to show the change must be sent promptly to this office
and the North Carolina Division of Coastal Management prior to
performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization
modified.

Dear Mr. Parker:
Reference the application of Figure Eight Island Yacht Club,
Incorporated, represented by Henry Von Oesen and Associates, for a
Department of the Army permit to construct floating docks in the
sound between Mason and Rich Inlets, west of Figure Eight Island,
New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included in the
State authorization:
a. No attempt will be made by the permittee to prevent the
full and free use by the public of all navigable waters at or
adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on
all navigable waters on the United States.
b. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without transferring it to a third
party.
