This would not be the first time that fueling facilities have been placed along public walks or near multi-floor residential structures. However, it is not a common occurrance for a project under permit. Your comments on the water quality and safety aspects of this proposed modifi- cation are requested by September 3 in order that action can be taken. I will attempt to get an opinion from City officials and will share same with you. This permit, issued on , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. RE: MITIGATION (1) The loss of the 13,362 square feet of salt marsh cordgrass necessary for marina construction will be mitigated offsite at a ratio of 2 to 1. The mitigation will be conducted as outlined in "Mitigation Plan for Dockside Project, Morehead City, North Carolina", dated February 15, 1985 (not attached). (2) A 7.5 feet width border of salt marsh cordgrass, in lieu of the 15 feet border originally proposed on plats 2 and 3 of 3 dated March, 1984, will be reestablished along the rear property line adjacent to the Town of Morehead City's bulkhead, after excavation of the marina. RE: EXCAVATION (1) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surroun- ding waters. See attached shee This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1987 In issuing this permit, the State of North. Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit #214-84 Page 2 of 3 ADDITIONAL CONDITIONS (2) The spoil area will be properly graded and provided a ground cover sufficient to restrain erosion within thirty (30) working days of project completion. Excavation by hydraulic dredge: (3) The disposal area effluent will be contained by pipe, trough or similar device to a point at or below the mean low water level to prevent gully erosion and unnecessary siltation. (4) The terminal end of the pipeline will be positioned at or greater than fifty (50) feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended solids. (5) A water control structure will be installed at the intake end of the effluent pipe to assure compliance with water quality standards. (6) The diked disposal area will be constructed a sufficiew-, distance from mean high water level or any marsh to eliminate the possibility of dike erosion into or upon any marsh and/or surrounding waters. Excavation by dragline: (7) Any fill material placed waterward of the bulkhead for the earthen and wooden "crossing" will be removed upon completion of excavaticn. (8) Fill material from the "crossing" will be confined in a manner consistent with Condition #1 for excavation. RE: MARINA OPERATION (1) The marina will display a sign showing the location of the nearest pumpout facility, listing the telephone numbers of local septic tank pumping services and including other appropriate waste disposal information. (2) The marina shall prominently post and enforce a locked-head policy for boats without holding tanks. (3) All floating structures, other than boats, used for habitation or commerce (as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations for onshore sewage treatment. GENERAL (1) A 15 feet setback from the eastern property line of the Fiddler's Green property will be observed until all concerns expressed by the adjacent eastern property owners have been satisfied. (2) Stormwater runoff from the parking areas and buildings will be directed towards the existing stormwater drainage system of the Town of Morehead City. (3) The development will be constructed so that a minimum of 30% of the terrestrial area is composed of permeable surfaces. (4) The activity will he conducted in such a manner as to prevent s-gnificant increases in turbidity outside the area of construction or construction-related discharge. J_ . NOTE: Plans and specifications of all water system improvements must be approved by the Division of Health Services prior to the award of a contract or the initiation of construction (as required by 10 NCAC 10D.0900 et. seq.). For information, contact the Engineering Planning Branch, 919-733-2460. NOTE: An Erosion and Sedimentation control plan will be required for this project. This plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. Other buildings on this tract of land include an existing restaurant and a "model unit" for future condominium sales. Along the shoreline area the applicant has given to the Town of Morehead City an. approximately 12' easement which is currently being bulkheaded as a part of the town's waterfront revitalization project (see State Permit No. 162-83). Directly landward of the bulkhead and within the town's easement, a pedestrian promenade will also be constructed. Waterward of the bulkhead the.applicant's-shoreline can be c aracterZzed as having a 0-60' border.of SpartinA'alterniflora marsh vegetaion. The wester portion of the shoreline, beginning at the right-of-way ati4sth St. and traveling for about 105 lin.ft. in an easterly directioier svoid of wetlands vegetation and has an existing boat rn 265' of shoreline tending to the water. The remaining approximately 265' 5-60' border to the east is characterized by having an approximately of Sgartina altern_iflora marsh fan average of 40') which is in a some- what distressed nature because of frequent movement of migrating sand material in portions of.the marsh areas.. Adjacent property to the east has been bulkheaded and consists of a proposed condominium/marina complex which is yet to bee constructed (see State Permit No. 47-74). The adjacent property the east is the 4th Street right-of-way which is currently bulkheaded and has no wetlands vegetation present. The applicant is proposing to develop this tract of land into a pro- posed condominium/marina complex. On the highground portion of the property the existing buildings are to be removedand three newofuild ings are to be constructed. Spoils from the proposed dredgi the marina site will be pumped into the condominium ste and used to in- 9.t5' MSL. Two crease the existing elevations to approximately of the proposed condominium units will each be about 6 stories high and contain 30 units each with ground level parking provided under- neath each building. The app cated that the entire draining from the parking lot and buildings will at -2- be-directed towards the town's drainage systems which are located on 4th'and 3rd Streets. These drainage systems empty directly into the water. The sewage and water needs for this proposed development are to be handled by the town of Morehead City's existing sewar and water systems. The applicants are also proposing to dredge the areas in front of their. property as well as the area in front of--the `4th Street right-of-way. Plans included with the application indicate that about 170-280' wide by 430' long area of high ground marsh, intertidaland shallow water areas will be dredged to depths ranging along the bulkhead of approxi- mately +3' to a final project depth of -6.5' MLW. The applicants are proposing to create a new intertidal zone of about 15' in width along the bulkhead which.is to be sprigged and planted with'Spartina alterni- flora marsh. The existing pier is to be removed and three new pier systems, each about 6' wide, will be constructed with a mooring ca- pacity of 65 boats The applicants have also secured permission from the adjacent property owner to the east to construct finger piers off of his previously permitted pier (which is not being constructed yet), in order to have an additional capacity of 17 slips at this location. The approximately 17,500 cu.yds. of materials which will be dredged by this proposed project will be pumped to high ground and behind approxi- mately 10' high dikes. Effluents from the dredging operations are pro- posed to be placed in the existing storm drainage systems at 4th St. 10. Anticipated impacts The project as proposed will result in the construction of three condo- minium buildings which will contain a total of 112 units. The highest building will be about 108' above the proposed ground elevation of 9.5' MSL.. About 2.4 acres of this site will be covered by impervious sur- faces-with approximately 8,325 sq.ft. of permeable surfaces being left. All of the permeable surfaces will be located along the shoreline area, and the applicant has indicated that 30% of the area within the estua- rine shoreline AEC will be left permeable. All storm water runoff from the entire project is to be directed to the existing storm drainage system of the town which directly enters Harbor Channel through drain- age pipes. The proposed dredging will result in the excavation of approximately 5,600 sq.ft. of high ground, about 10,600 sq.ft of Spartina alterniflora marsh, approximately 21,500 sq.ft. of intertidal area, and about 60,200 sq.ft. of shallow to semi-deep water bottom areas. The approximately 17,500 cu.yds. of excavated material is to be pumped to highground and confined behind earthen dikes. The excavation of the marsh areas is proposed to be partially offset by the planting of an approximately 430' long by 15' wide border of Spartina'alterniflora marsh along the water- ward toe of the bulkhead. A total of three piers will be constructed by the applicants which, in conjunction with the utilization of the adjacent pier to the east, will -3- provide boat mooring capabilities for.about 82 boats.. The locations of the piers are to be at the edge of the U.S. harbor line. The-applicant has been questioned concerning the availability of spoil areas for fu- ture maintenance, and has indicated the possibility of using Sugar Loaf Island or performing future maintenance by barge with adjacent spoil barges. OPE.,;?,ricrt f 4 r f s 9: Narrative description The applicant's property consists of an approximately 2.8 acre tract of land located adjacent to Arendell Street and Harbor Channel, and betwwwn 4th and 3rd Streets, in the Town of Morehead City Carteret County. The highground portion of the property has primarily been developed with an existing hotel/motel complex which is known as "The Jefferson Motel Lodge." Other buildings on this tract of land include an existing restaurant and a "model unit" for futurecondominium given shoreline area the applicant has approximately 12' easement which is currently being buseeeaded aPermit part of the town's waterfront revitalization project State No. 162-83). Directly landward of the bulkhead and within the town's easement, a pedestrian promenade will also be constructed. Waterward of the bulkhead the applicant's shoreline can be characterized as having a 0-60' border of Sp'arti:na altef1atathe marsh Fighteoftwayoat 4theSteSandu portion of the shoreline, beginning id of any traveling for about 105 lin.ft. in an easterly directio is void system of wetlands vegetation and has an existing boat ramp 265' of shoreline tending to the water. The remaining approximately to the east is characterized by having an approximately 5-60' border of Spartina alterniflora marsh fan average of 40') which is in a.some- what distressed nature because of frequentmovement of migrating sand material in portions of the marsh areas. The intertidal area is characterized by having scattered aounts of coon oysters and shell fragments. The offshore very shallow until reaching about 120' past MLW where the depthsbecome approximately -8' MLW. Adjacent property to the east has been bulkheaded and consists of a proposed condominium/marina complex which is yet to bto the east e constructid• (,see State Permit No. 47-74). The adjacent property the 4th Street right-of-way which is currently bulkheaded and has no wetlands vegetation present. The applicant is proposing to develop this tract of land into a pro- posed condominium/marina complex. On the highground portion of the property the existing buildings are to be removed and three new build- ings are to be constructed. Spoils from the proposed dredging of the marina site will be pumped into the condominium steaed to in- crease the existing elevations to approximately 9.t5' above MSL. Two of the proposed condominium units will each be about 6osiories high and contain 30 units each with ground level parking p s will .heath each building. The main roof height of these building be about 81' and will be located up to 41' landward oftde bulkhead. Separating these buildings from the bulkhead and p grassed lawn area. The third building will be located just north and in the center of the property, and will be about 10 storiesPigh. The main-roof height of this b?hedadditionaleparkinglOrequi.rements for for this building, as well as th-e other buildings., will be provided on the remainilgcantthassiof the lot by the construction of an asphalt- area. The app cated that the entire draining from the parking lot and buildings will 4 . f` r -2- be directed towards. the town's drainage systems which are located on 4th"and 3rd Streets. These drainage systems empty directly into the water. The sewage and water needs for this proposed development are to be handled by the town of Morehead City's existing s-ewar and water systems. The applicants are also proposing to dredge the areas in front of their property as well as the area in front of the 4th Street right-of-way. Plans included with the application indicate that about 1.70-280' wide by 430' long area of high ground marsh, intertidal and shallow water areas will,be dredged to depths ranging along the bulkhead of approxi- mately +3' to a final project depth of -6.5' MLW. The applicants are proposing to create a new intertidal zone of about 15' in width along the bulkhead which is to be sprigged and planted with Spartina-alterni.- flora marsh. The existing pier is to be removed and three new pier systems, each about 6' wide, will be constructed with a mooring ca- pacity of 65 boats. The applicants have also secured permission from the adjacent-property owner to the east to construct finger piers off of his previously permitted pier (which is not being constructed yet), in order to have an additional capacity of 17 slips at this location. The approximately 17,500 cu.yds. of materials which will be dredged by this proposed project will be pumped to high ground and behind approxi- ma.te.ly 10' high dikes. Effluents from the dredging operations are pro- posed to be placed in the existing storm drainage systems at 4th St. 10. Anticipated impacts The project as proposed will result in the construction of three condo- minium buildings which will contain a total of 112 units. The highest building will be about 108' above the proposed ground elevation of 9.5' MSL. About 2.4 acres of this site will be covered by impervious sur- faces with approximately 8,325 sq.ft. of permeable surfaces being left. All of the permeable surfaces will be located along the shoreline area, and the applicant has-indicated that 30% of the area within the estua- rine shoreline AEC will be left permeable. All storm water runoff from the entire project is to be directed to the existing storm drainage system of the town which directly enters Harbor Channel through drain- age pipes. The proposed dredging will result in the excavation of approximately 5,600 sq.ft. of high ground, about 10,600 sq.ft of SpatLjna alterniflora marsh, approximately 21,500 sq.ft. of intertidal area, and about 60,200 sq.ft. of shallow to semi-deep water bottom areas. The approximately 17,500 cu.yds. of excavated material is to be pumped to highground and confined behind earthen dikes. The excavation of the marsh areas is proposed to be partially offset by the planting of a.n approximately 430' long by 15' wide border of S a? rtina'alterniflora marsh along the water- ward toe of the bulkhead. A total of three piers will be constructed by the applicants which, in conjunction with.the utilization of the adjacent pier to the east, will t 3- provide boat mooring capabilities for about 82 boats. The locations of the piers are to be at the edge of the U.S. harbor line. The applicant has been questioned concerning the availability of spoil areas for fu- ture maintenance, and has indicated the possibility of using Sugar Loaf Island or performing future maintenance by barge with adjacent spoil barges. We have met on-site with the applicant and representatives of state and federal review agencies to discuss the proposed project. Our major concern was the destruction, due to dredging of the boat basin, of approxi- mately 10,600 sq. ft. of Spartina alterniflora. To offset this loss, the applicant has agreed to mitigate this loss by planting an approximately 430 ft. long by 15 ft. wide Corder of S. rtina alterniflora along the waterward toe of the proposed bulkhead. Carteret County, North Carolina Dear Colonel Hanson: We have reviewed the above application and offer the following observations: ° The increasingly prevalent practice of linking residential housing and marina facilites does not bode well for future water quality or fish and wildlife values in many areas of coastal North Carolina, However, this project would be within current permitting standards if the extent of miti- gation plantings were increased to the amount of wetlands lost through construction (10,600 sq. ft.). We recommend the permit be conditioned to reflect same. ° An increased volume of non-point runoff will merely be looped through the storm drains back into the Harbor Channel. It would be valuable for some agency to sample the benthic communities in the intertidal areas affected by these dis- charges to determine if additional safeguards are warranted to protect the constituent populations there.
