Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The bulkhead will extend no more than 10 feet waterward of mean high water as indicated in the attached plat and will be aligned at an average of three feet waterward of MHW. (2) All fill material to be placed below mean high water level will be confined behind the permitted bulkhead. (3) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spill-over of solids into any marsh or surrounding waters. (4) The material used to backfill the bulkhead will be clean and free of any.. pollutants except in trace quantities. Metal products, organic materials, .or unsightly debris will not be used. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. (6) In order to protect juvenile stages of important species of fish, shrimp and crabs, excavation will not be permitted between March 1 and September 30 of any year without prior approval of the Division of Coastal Management in consultation with the Division of Marine Fisheries. (7) The activity must be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction- related discharge (increases of 25 NTU's or less are not considered significant). (8) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (9) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. (10) The permittee will maintain the authorized work in good condition and in conformation with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. (11) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction- related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less are not considered significant. NOTE: The permittee and/or contractor is urged to meet with representatives of the Division of Coastal Management and/or Army Corps of Engineers prior to project initiation. NOTE: An Erosion and Sedimentation control plan will be required for this project. The plan must be filed at least thirty (30) days prior to beginning any land disturbing activity. Submit this plan to the Department of Natural Resources and Community Development, Land Quality Section, 1502 North Market Street, Washington, N.C. 27889. A review of your application received October 16, 1986, for a Department of the Army permit to construct a bulkhead and a pier and to maintain and deepen an existing channel and to place fill material in a wetland area off Mill Landing Creek in Wanchese, Dare County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be written and informed of its further management. ETHERIDGE BIO REPORT PAGE 2 SITE DESCRIPTION: The applicant's property is off of Roanoke Sound on Mill Landing Creek adjacent to Wanchese Harbor Seafood Park project. Part of the applicant's property has been used by the Corps of Engineers as a spoil area for their maintenance dredging in the Wanchese Harbor. Mill Landing Creek is heavily used by commercial fishing traffic which caused erosion along the unprotected shoreline. The shoreline immediately adjacent to Mill Landing Creek is devoid of marsh grass and a 10 foot wide by 100 foot long dock has been constructed under CAMA permit #129-80. This pier is delapidated and in need of repair. In the narrow, relatively shallow cut extending from Mill Landing Creek to Roanoke Sound between the applicant's property and a smaller marsh island, there exist a discontinuous fringe of Juncus roemeria_nus marsh along the high water mark. The applicant proposes to construct a 10 foot wide pier and a bulkhead along the approximately 680 feet of irregularly shaped waterline. The bulkhead is. proposed to be located at the piers landward edge. This will result in the bulkhead extending 10 to 15'feet from the MHW at the corners but averages 2 feet from MHW in most locations. A 280 foot long by 43 foot wide access channel is proposed to provide access by commercial fishing vessels. The excavation is to be accomplished by dragline to a depth of -14 feet, which is consistent with the depth of the adjacent Mill Landing Creek. All spoil will be placed on highground and then pushed behind the bulkhead. This same project was reviewed and authorized under CAMA permit #129-80. The only work accomplished under this authority was the construction of a portion of the pier which will be removed during dredging and then replaced. The only site conditions which have changed is the continued erosion of the land adjacent to Mill Landing Creek. ANTICIPATED IMPACTS: The construction of the bulkhead and pier and the excavation will result in some short term elevated turbidity but this should be localized. The backfilling of the bulkhead will result in the loss of approximately 1,600 square feet of shallow water habitat and 200 square feet of Juncus roemerianus. Excavation of the access channel will result in the deepening of 9,800 square feet of shallow water habitat to -14 feet. CAMA REVIEW: The project site is classified as transition in the Dare County LUP. The proposal is consistent with that classification. Submitted,by: George H.
