This permit, issued on T_?• is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Channel and Basin Excavation
(1) This modification authorizes: a) the use of steel sheet pile in place
of wood b) reversing the basin plan thus constructing the ramp on the east
side and piers on- the west and c) shifting the basin, with no change in
dimension, approximately 10 feet westward as shown on the revised plat.
(2) In order to protect juvenile shrimp populations, no excavation or filling
will be permitted between April 1 and September 30 of any year without
the prior approval of the DCM.
(3) Excavation will not exceed 6 feet below the elevation of mean low water
(MLW).
(4) Vegetated wetlands will not be excavated or filled.
(5) No excavated or fill material will be placed at any time in any marsh or

issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.

surrounding waters outside the alignment and fill area indicated on the
plat.
(6) All excavated materials will be confined above MHW and landward of regularly
or irregularly flooded marsh behind adequate dikes or other retaining structures
to prevent spillover of solids into any marsh or surrounding waters.
(7) The disposal area effluent will be contained by pipe, trough or similar
device to a point at or below the NWL to prevent gully erosion and unnecessary
siltation.
(8) The terminal end of the pipeline will be positioned at or greater than
50' from any part of the dike and a maximum distance from spillways to
allow sediment of suspended solids.
(9) A water control structure will be installed at the intake end of the effluent
pipe to ensure compliance with water quality standards.
(10) The activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside the area of construction or construction-
related discharge. Increases such that the turbidity in the waterbody is
50 NTU's or less are not considered significant.
(11) The diked disposal area will be constructed a sufficient distance from
the MHW level oriany marsh to eliminate the possibility of dike erosion
into or upon a marsh and/or surrounding waters.
(12) The temporary placement or double handling of excavated or fill materials
within waters or vegetated wetlands is not authorized.
Other Construction
(13) Riprap material used to construct jetties must be clean and free of toxic
residues. Riprap must be of sufficient size as to not be washed away by
wave action.
(14) The bulkhead, on the parameter of the basin, will be constructed in strict
accordance with permit plans.
(15) The permittee will maintain the authorized work in good condition.'and in
conformance with.the terms and conditions of this permit. The,•permittee
is not relieved of this requirement if he abandons the. permitted activity
without transferring it to a third party.
(16) The waterward end of pier will be marked with reflective tape or similar
material to reduce the likelihood of a boating accident.
Protection and Archaeological Resource
(17) In the event that archaeological resources are encountered, either underwater

or on the permittee's highground, all work will cease immediately and the
permittee or his agent will notify the Division of Environmental Management,
the Corps of Engineers and the Division of Archives and History. Additionally,
North Carolina G.S. 70, Article 3, The Unmarked Human Burial and Human
Skeletal Remains Protection Act, requires any individual discovering an
unmarked burial to report such a discovery to the county medical examiner.
The county medical examiner will determine if the remains are under his
jurisdiction. If not, the Chief Archaeologist, N.C. Department of Cultural
Resources, will be contacted.
(18) The permittee must post and enforce a no sewage discharge policy for the
boat basin.
(19) Living aboard boats docked at the marina is not authorized under this permit.
NOTE: Any additions to the basin facility that would commercialize the operation,
such as fuel dispensing or additional docks or pilings, would require
a modification of this permit.

Dear Mr. Ellinwood:
Reference your application for a Department of the Army permit
to excavate an access channel and basin area, install jetties, and
construct an L-head docking facility on Adams Creek, in Merrimon,
Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization and the
enclosed plan. Failure to comply with the State authorization or
conditions of the general permit could result in a violation of
Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

SUBJECT: Application for CAMA Permit

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
1. The project does require a 401 certification but
meets the requirements of General Certification
No. 1272 and No. 1273 for bulkheads and upland
spoil disposal areas, respectively.
2. The primary spoil disposal area is the only area
appropriate for disposal of spoils from the
hydraulic dredging. Removal of spoils from the
primary spoils area to provide additional capacity
should be done only after the spoils have been
adequately dewatered.
3. The basin should be restricted such that no more
than 10 boats can be docked at any time.
4. The following restrictions should be imposed to
assure sewage discharges do not occur to the SA
waters:
a.. Pumpout facilities must be installed.
b. A locked head policy must be established and
enforced.
co Live aboards and transient dockage shall be
prohibited.
d. Signs should be posted along docks
prohibiting overboard discharges of sewage
and addressing conditions in b. and c. above.

The applicant proposes to maintain an existing channel and basin,
construct channel and shoreline jetties, bulkhead the basin, and 6
boat slips in addition to a boat house. The project is adjacent to
Adams Creek, classified SA and open to shellfishing.
The project has been reviewed to determine impacts to water quality.
The following comments are offered:
1. The project will require 401 certification, but should meet the
conditions of the general 401 certification for bulkheads and
hydraulic dredge disposal in the primary spoils area.
2. That the primary disposal area is the only area appropriate for
the disposal of spoils from the hydraulic dredging. The removal
of the spoils from the primary area to provide additional
capacity should be done only after spoils are dewatered.
3. At no time should this basin be modified to accommodate more
than 10 boats.
4. It is recommended that the following conditions be required to
protect the waters from fecal coliform violations:
a. That a pump out facility be installed.
b. That a lock head policy be established and enforced.
c. Live aboards and transient dockage not be allowed.
d. That signs be posed on the dock prohibiting overboard
discharge of sewage, and addressing conditions b and c
above.
5. The rock jetties should be constructed out of rip-rap material
in such size as not to be disturbed by wave action, and consist
of clean rock or masonry material free of debris or toxic
pollutants.

9.. Narrative description
The applicant's property is a 62-acre tract located at the end of SR
1321 on Adams Creek and Neuse River near Merrimon in Cart Fet County.
The property is divided into two tracts: a 3-acre parce? which is lo-
cated the applicant's residential structure, and a 59-ac e parcel ad-
joining to the north/northwest which is composed of woods and marsh.
In total, the applicant has approximately 2200 lin.ft. of shoreline
approximately 400' of which is bulkheaded in the vicinity of the resi-
dence. A 10-30' wide sandy beach or berm exists between the water
and land along the remaining shoreline footage.
The home tract is characterized by sandy soils on about 4' elevations.
The property is bulkheaded by a timber bulkhead on the east and a
stone bulkhead on the west. A steel sheetpile bulkhead exists in.
the mouth of the basin, the basin interior being unbulkheaded and
completely filled in at the mouth.
The basin and channel was dug between April 1973 and December 1974
which was covered by State Permit No. 62-73 issued to Mr. Leo R. Dixon.
In 1980, Mr. Wmn. J. Carroll secured a transfer and renewal of this
permit for maintenance of the basin mouth. According to current
photography, the channel is almost indiscernible since the previous
excavation.
The applicant is proposing to maintain the existing basin and channel
to -6' MLW. -The channel maintenance will be by hydraulic dredge,
with spoil being deposited in the previous diked disposal area east
of the applicant's residence and basin, and also in another diked
disposal area located on the western parcel about 500' of SR 1321.
Two combination wood/rock jetties will border the 40' wide channel
on either side and parallel this channel for 150' on the east side
and 250' on the west side. A 6' wide pier will be built over the
western jetty with a 10' by 40' "L" shaped dock at the end.
The basin will be excavated by dragline and spoil placed in the hy-
draulic dredging spoil area and between the basin and residence. The
basin will be bulkheaded, a boat ramp constructed'in the northern
corner, six slips constructed on the east side, and a 30' x 33' boat
house placed on the west side. Excavated materials will be used in
various places in the applicant's yard.
The western parcel is mostly woods, predomin,ently with pines, gum,
oak and myrtle. Some previously farmed fields on the parcel are
being overgrown with various scrub species. A marsh gut makes up
on the center of the parcel and consists of a natural 3-acre pond
surrounded by coastal wetlands, black needlerush and giant cordgrass.
A 20' wide to 100' wide sand berm separates this gut from Neuse River
and Adams Creek. The applicant is proposing to construct rock jetties
measuring 25' long by 6' wide by no more than 1' high along this 1800'
of shoreline. In total, 36 jetties are proposed though placement

will be experimental and will not exceed-two per 100' in any one
location.
10. Anticipated impacts
This project will involve the excavation of approximately 3,000
cu.yds. of predominently sand material from 29,000 sq.ft. of pre-
viously altered channel and basin area. Another 1200 sq.ft. of
shallow estuarine area will be covered by the rock placement in
the channel/jetty construction. The piling placement and bulkhead
construction will produce some short term turbidity in the imme-
diate project area.
The placement of the rock jetties along the shoreline of the western
parcel will fill approximately 3600 sq.ft. of near-shore estuarine
area with about 72 cu.yds. of rock material. The loss of bottom
area may be offset by the habitat these structues can provide.
Highground disturbance for spoil disposal and leveling will involve
approximately 54,400 sq.ft. on the home tract and 120,000 sq.ft.
in the designated area on the western tract.
Adjacent waters are classified as SA by DEM and are open to shell-
fishing according to the Div. of Health Services.

Dear Mr. Parker:
Reference the application of Mr. George H. Ellinwood for a
Department of the Army permit to maintain an access channel and
basin, install wooden jetties, place riprap material and construct
bulkheads and docking facilities on Adams Creek, Merrimon,
Carteret County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included'in the
State authorization:
a. The bulkhead, on the parameter of the basin, will be
constructed in strict accordance with permit plans.
b. All excavated materials will be confined landward of the
normal water elevation contour within adequate dikes or other
retaining structures to prevent spillover of solids into any
vegetated wetlands or surrounding waters.
c. The terminal end of the pipeline from the dredge into the
diked retention area will be positioned at or greater than 50 feet
from any part of the dike and at a maximum distance from spillways
to prevent dike erosion and to allow adequate settlement of
suspended solids.

d. A water control structure will be installed at the intake
end of the effluent pipe leading from the retention area in order
to ensure maximum settlement of suspended solids.
e. Flow from the diked retention area will be confined by
pipe, trough, or similar device to a point at or below the normal
water elevation contour to prevent gully erosion and resultant
unnecessary siltation.
f. Vegetated wetlands will not be excavated or filled.
g. Excavation will not exceed 6 feet below the elevation of
mean low water (MLW).
h. The temporary placement or double handling of excavated or
fill materials within waters or vegetated wetlands is not
authorized.
i. The permittee will maintain the authorized work in good
condition and in conformance with the terms and conditions of this
permit. The permittee is not relieved of this requirement if he
abandons the permitted activity without transferring it to a third
party.
J. The activity will be conducted in such a manner as to
prevent a significant increase in turbidity outside the area of
construction or construction-related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less are not
considered significant.

Enclosed is the application of Mr. George H. Ellinwood for a
Department of the Army permit and a State Water Quality
Certification to dredge an access channel and basin area, install
rock/concrete jetties, and construct an L-head docking facility in
Adams Creek in Merrimon, Carteret County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request
for certification in accordance with Section 325.2(b)(ii) of our
administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by July 7, 1986, the District Engineer
will deem that waiver has occurred.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received April 29, 1986, for a
Department of the Army permit to dredge an access channel and
basin area, install jetties, and construct an L-head docking
facility at your property on Adams Creek off S.R. 1321 in
Merrimon, Carteret County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit.
Accordingly, the administrative processing of your application
will be accomplished by the North Carolina Division of Coastal
Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
application by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such
confirmation should you begin work.

9., Narrative description
The applicant's property is a 62-acre tract located at the end of SR
1321 on Adams Creek and Neuse River near Vlerrimon in Cart ret County.
The property is divided into two tracts: a 3-acre parce nwhich is lo-
cated the applicant's residential structure, and a 59-ac K parcel ad-
joining to the north/northwest which is composed of woods and marsh.
In total, the applicant has approximately 2200 lin.ft. of shoreline
approximately 400' of which is bulkheaded in the vicinity of the resi-
dence. A 10-30' wide sandy beach or berm exists between the water
and land along the remaining shoreline footage.
The home tract is characterized by sandy soils on about 4' elevations.
The property is bulkheaded by a timber bulkhead on the east and a
stone bulkhead on the west. A steel sheetpile bulkhead exists in.
the mouth of the basin,.the.basin interior being urbulkheaded and
completely filled in at the mouth.
The basin and channel was dug between April 1973 and December 1974
which was covered by State Permit No. 62-73 issued to Mr. Leo R. Dixon.
In 1980, Mr. Wmn. J. Carroll secured a transfer and renewal of this
permit for maintenance of the basin mouth. According to current
photography, the channel is almost indiscernible since the previous
excavation.
The applicant is proposing to maintain the existing basin and channel
to -6' MLW. The channel maintenance will be by hydraulic dredge,
with spoil being deposited in the previous diked disposal area east
of the applicant's residence and basin, and also in another diked
disposal area located on the western parcel, about 500' of SR 1321.
Two combination wood/rock jetties will border the 40' wide channel
on either side and parallel this channel for 150' on the east side
and 250' on the west side. A 6' wide pier will be built over the
western jetty with a 10' by 40' "L" shaped dock at the end.
The basin will be excavated by dragline and spoil placed in the hy-
draulic dredging spoil area and between the basin and residence. The
basin will be bulkheaded, a boat ramp constructed in the northern
corner, six slips constructed on the east side, and a 30' x 33' boat
house placed on the west side. Excavated materials will be used in
various places in the applicant's yard.
The western parcel is mostly woods., predominently with pines, gum,
oak and myrtle. Some previously farmed fields on the parcel are
being overgrown with various scrub species. A marsh gut makes up
on the center of the parcel and consists of a natural 3-acre pond
surrounded by coastal wetlands, black needlerush and giant cordgrass.
A 20' wide to 100' wide sand berm separates this gut from Neuse River
and Adams Creek. The applicant is proposing to construct rock jetties
measuring 25' long by 6' wide by no more than 1' high along this 1800'
'of shoreline. In total, 36 jetties are proposed though placement

will be experimental and will not exceed two per 100' in any one
location.
10. Anticipated impacts
This project will involve the excavation of approximately 3,000
cu.yds. of predominently sand material from 29,000 sq.ft. of pre-
viously altered channel and-basin area. Another 1200 sq.ft.'of
shallow estuarine area will be covered by the rock placement in
the channel/jetty construction. The piling placement and bulkhead
construction will produce some short term turbidity in the imme-
diate project area.
The placement of the rock jetties along the shoreline of the western
parcel will fill approximately 3600 sq.ft. of near-shore estuarine
area with about 72 cu.yds. of rock material. The loss of bottom
area may be offset by the habitat these structues can provide.
Highground disturbance for spoil disposal and leveling will involve
approximately 54,400 sq.ft. on the home tract and 120,000 sq.ft.
in the designated area on the western tract.
Adjacent -waters are classified as SA by DEM.and are open to shell-
fishing according to the Div. of Health Services.
