This permit, issued on T/Y/ is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
pennittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) In order to protect juvenile finfish populations, no bottom disrupting activities
will be permitted between February T.,and May 31 of any year without the prior
approval of the Division of Coastal Management.
(2) The piers shall be built in accordance with the submitted plat.
(3) A vegetated buffer zone will be left 'between the previously surfaced parking
lot and adjacent -wooded wetlands to reduce the. amount of any runoff that
could enter the wetlands:
(4) The parking lot will be graded away from adjacent waters and wetlands.
(5) No full service features, such as gasoline 'or oil sales will be provided
at the marina.
(6) The marina shall prominently post and enforce a no sewage discharge policy.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the n. oject is inspected f6r commiance.
Any maintenance work or project modification
not " covered hercunder requires further Departmeatal
approval.
All work must cease when the permit expires on
December 31, 1989

agrees that your project is consistent with the North

and including other appropriate waste disposal information.
(8) All floating structures, other than boats, used for habitation or commerce
(as defined in 15 NCAC 7M.0602) shall be in conformance with local regulations
for onshore sewage treatment.
(9) The activity will be conducted in such a planner as to prevent significant
increases in turbidity outside the area of construction or construction-related
discharge.
(10) Use of the permitted structures must not interfere with the public's right
to free navigation on all navigable waters of the State of North Carolina
and the United States of America.
(11) It is possible that the authorized structure may be damaged by wavewash from
passing vessels. The issuance of this permit does not relieve the permittee
from taking all proper steps to ensure the integrity of the permitted structure
and the safety of moored boats from damage by wavewash.
(12) The permittee will maintain the authorized structures in good. condition and
in conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without transferring it to a third party.

Reference the application of the City of Elizabeth City for a
Department of the Army permit to construct a dock with catwalks
and a pedestrian bridge and install mooring piles on Knobbs Creek,
adjacent to the Knobbs Creek Recreation Center, Elizabeth City,
Pasquotank County, North Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
We recommend that the following conditions be included 1,?n the
State authorization:
a. Use of the permitted structures must not interfere with
the public's right to free navigation on all navigable waters of
the United States.
b. It is possible that the authorized structure may be
damaged by wavewash from passing vessels. The issuance of this
permit does not relieve the permittee from taking all proper steps
to ensure the integrity of the permitted structure and the safety
of moored boats from damage by wavewash. The permittee will not
hold the United States liable for any such damage.
c. The permittee will maintain the authorized structures in
good condition and in conformance with the terms and conditions of
this permit. The permittee is not relieved of this requirement if

SITE DESCRIPTION
The City of Elizabeth City proposes to construct 20 boat slips to be located
on city property on Knobbs Creek behind the Knobbs Creek Recreation Center on
Ward Street in Elizabeth City, Pasquotank County, North Carolina. The lot is
approximately 27 acres in size, with recreational facilities such as ball fields
and tennis courts located upon it. The area proposed for development is approx-
imately 4' above NWL with sandy clay soils. The existing shoreline is a high
bank, with a straight shoreline.
The City of Elizabeth City proposes to construct eleven finger piers, 10' X 3'
for entry to the boats from the shoreline. The piers to be constructed of treated
wooden timbers. The-City of Elizabeth City also pro poses to place 31 mooring pilings,
with the first line of pilings being 10' from shore and 20' apart. The proposed boat
slips will'usurp 400' X 40' of creek along the property's shoreline.
A proposed 4' wide X 20' long bridge on pilings across a slew (15' wide with -1'
water depth) is planned to provide access from a public road adjacent to Foreman Mill
Road. Along this road, a 20 car parking lot will be constructed on existing high
ground adjacent to wooded wetlands.
ANTICIPATED IMPACTS
The boat slips are to be for storage only, with no electric or water hookups
being provided. No pumpout facilities are proposed. The site is in public trust
waters, with the area being classified as conservation. The exact site of proposed
development is high ground, with no low areas.

Reference is made to your recent on-site consultation with
Mr. Jerry Allen, Director, Parks & Recreation Department, in
regard to the proposed boat slips behind the Knobbs Creek
Recreation Center. Following discussions with Ms. Ruth Leggett,
Coastal Land Use Planner, NRCD, I have no problem with the
proposal, as outlined in the attached application. We find this
proposal to be consistant with the existing Land Use Plan, and
recommend that the "conservation" classification be maintained to
ensure the continuance of an increased level of review for any
future development proposals in this area.
