(1) The pier with floating dock must not extend waterward greater than one-third the width of Sherron Creek as measured from mean high water to mean`;`high water, and in no case block the mean low water channel. (2) This pier is permitted for simple residential riparian access and may not be converted into another use without modification of this permit. (3) No attempt will be made by the permittee to prevent the full and free use by the public of a1-1 navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. (4) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party. (5) The activity shall be conducted in such a manner as to prevent significant increases in turbidity outside the area of construction or construction-related discharge. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31. 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. Proje ct summary The applicants propose to construct a single family group pier 600' by 4' into Sherrow Creek whereby 25 lot owners of "Edgewater" Subdivision would have the- -rights of water access just S.E. of Shallotte off of N.C. 130. "Edgewater" c/o Frank Lennon Page 2 9. PROJECT DESCRIPTION: The applicant's propose to construct a 600' long elevated wooden pier across black needlerush marsh (Juncus roemerianus) adjacent to the Edgewater Subdivision located off of Highway 130 along Sherrow Creek. A 20' by 10' floating "T" will be also constructed just below the mean low water line. Twenty-five residential lots will be served by this group application. Presently only 2-3 of the lots are built upon. A "U" shaped asphalt drive gives access to the lots. Water depths in Sherrow Creek measure -2' to -4' (MLW) near the proposed pier. The creek is 60' - 80' wide and is classified as a nursery area. The waters are also classified as S.A. 10. ANTICIPATED IMPACTS: There will be some shading of the black needlerush marsh but this will be minimal since the pier will only be 4' wide. The transient boat mooring will only accommodate one or two small skiffs at any given time. No negative impacts to the nursery area or ambient water quality is anticipated. The pier may obstruct navigation if it does not exceed one-third the navigable width of the creek at this location. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without transferring it to a third party.
