Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization and the enclosed plan. Failure to comply with the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. This permit, issued on is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void. (1) The length of the proposed pier will not extend beyond the established pier-head length. The final length will be determined as a measurement from that point on the shoreline identified as the MHW shoreline established during the July 18 onsite visit by Mr. James Mercer of the DCM Morehead City office. (2) The pier will not encroach on the man-made deep water channel that adjoins the project immediately south of the project shoreline. {;3) The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. (4) Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the State of North Carolina or the United States of America. (5) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1989 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Narrative description The project site has the street address df 227 Club Point-Drive in Country Club Point Subdivision. -The warranty deed which ac- companied the application lists the property as Lot No. 1, Block A, Section I within the subdivision located off Hwy. 24 just east of Cape Carteret on Deer Creek, a tributary of Bogue Sound in Carteret County. The property.consists of approximately .7 acre of high ground-pro- perty bounded on the east side by a narrow, man-made canal which was reopened about a year and a half ago. Mr. Dunker, the ap- plicant, maintains about 300' of bulkheaded shoreline along the canal and 100' of marsh frontage along the southern exposure of Deer Creek. Although Mr. Dunker's permanent residency is in New Jersey, he maintains a nice, new single family house on the lot as his vacation home site. It is along this 100' section of his property that he proposes to construct a typical private pier. The 4' wide pier will be posi- tioned about 40' from the western property line and about 60' west of the eastern property line. As shown on the work plat drawings, the proposed pier will have a length of 64' to be measured from the MLW shoreline. This overall length includes a'r-head platform measuring 32' by 6' wide. Contrary to what the work plat drawing indicates, the water depth at the end of the proposed pier is-only -1' deep during low tide.-This was determined during the onsite investigation. This is significant because-a man-made, deep water. channel exists immediately south of the T-head alignment of the pro- pier. The water depths in this channel are -5' during MLW. 10. Anticipated impacts The reason Mr.'Dunker needs a major LAMA permit is because each of the adjacent riparian landowners have objections to the con- struction of the proposed pier. The objections deal with the possi- bility that the applicant will "park"a 32' boat. along the outer T-head platform, thus obstructing public navigation in the deep wa- ter channel and navigation to the entrance of the man-made canal that extends into the subdivision. In addition, Mr. Ruska (an adjacent property owner) believes that.the 32' boat will interrupt their view of the creek. As of this date, the applicant does not own a 32' boat and no intention has'been expressed in the appli- cation to purchase that size boat. The onsite visit clearly revealed that the proposed pier will not interfere with public navigation and that the length of the pro- posed pier will not extend beyond those which already exist along the same shoreline. In fact, Mr. Ruska's pier which is located imme- diately west of the proposed pier location is exactly 65' long mea- suring from-the MHW shoreline: The deep water channel is at least 60-75' wide and'will not be encroached upon by the proposed pier.. The established pier-head line is landward-of that point. Traditional clamming efforts in the form of hand raking will continue to.take place on the south side of the deep water channel in Deer Creek. The property consists of approximately .7 acre of high ground pro- perty bounded on the east side by a narrow, man-made canal which was reopened about a year and a half, ago. Mr. Dunker, the ap- plicant, maintains about 300' of bulkheaded shoreline along the canal and 100' of marsh frontage along the southern exposure of Deer Creek. Although Mr. Dunker's permanent residency is in New Jersey, he maintains a nice, new single family house on the lot as his vacation home site. It is along this 100' section of his property that he'proposes to. construct a typical private pier. The 4' wide pier will be posi- tioned about 40' from the western property line and about 60' west of the eastern property line. As shown on the work plat drawings, the proposed pier will have a length of 64' to be measured from the MLW shoreline. This overall length includes a-T-head platform measuring 32' by 6' wide. Contrary to what the work plat drawing indicates, the water depth at the end of the proposed pier is only -3' deep during low tide. This was determined during the onsite investigation,. This is significant because_a man-made, deep water channel exists immediately south of, the T-head alignment of the pro- pier. The water depths in this channel are -5' during MLW. 10. Anticipated impacts The reason Mr. Dunker needs a major CAMA permit is because each of the adjacent riparian landowners have objections to the con- struction of the proposed pier. The objections deal with the possi- bility that the applicant will "park" a 32' boat- along the outer T-head platform, thus obstructing public navigation in the deep wa- ter channel and navigation to the entrance of the man-made canal that extends into the subdivision. in addition, Mr. Ruska (an adjacent property owner) believes that the 32' boat will interrupt their view of the creek. As of this date, the applicant does not own a 32' boat and no,intention has been expressed in the appli- cation to purchase that size boat. The onsite visit clearly revealed that the proposed pier will not interfere with public navigation and that the length of the pro- posed pier will not extend beyond those which already exist along the same shoreline. In fact, Mr. Ruska's pier which is located imme- diately west of the proposed pier location is exactly 65' long mea- suring from the MHW shoreline. The deep water channel is at least 60-75' wide and will not be encroached upon by the proposed pier. The established pier-head line is landward of that point. Traditional clamming efforts in the form of hand raking will continue to take place on the south side of the deep water channel in Deer Creek. The reviewers of this report are encouraged to examine the project site on,,,the aerial photographs dated 1984 on file with DCM and the Corps of Engineers, reference-Strip 31, Frame 1187 at P-11 between 6 and 9 o'clock.
